Luxury watch dealers can choose to be the good guys or the bad guys. Luxury is a Manichean industry built on trust due to the money and value involved. Trust is hard to gain and easily lost. Tonight, Tim Mosso discusses eight luxury watch dealer abuses, how to recognize them, and how to avoid them. Whether you buy your next watch from The 1916 Company or not, we want to be a point of reference for the industry. This is a buyer's guide for watch buyers of all budgets and tastes.
Tim Mosso started buying watches at age 22 following his college graduation. Watch number one was a Swiss made Bulova Accutron Spaceview purchased from Time Source Jewelers in Huntington. Since that first watch, Tim has bought a host of his own watches and witnessed tens of thousands of watch sales through The 1916 Company. But it's the feedback from fans and clients that has shaped Tim's view of the luxury watch retail industry.
From forced bundling of unwanted watches to brusque salesmen to prejudice on the showroom floor, Tim has seen it all or heard it all. This episode focuses on the ways that luxury watch buyers can protect themselves from common abuses at the retail level. Often, the worse can happen when a watch is shipped to a distant seller with no strings attached - or money is sent to a dealer who doesn't have the advertised watch in stock. Other times, factory boutiques ignore significant purchases of same-brand watches purchased through conventional authorized dealers; no purchase history is acknowledged despite hundreds of thousands spent!

I'll put it on my list of future show topics. It's a subject of huge interest to me since I think you get more value in pocket watches - especially vintage - than in wristwatches. Also, even mass-produced American pocket watches (especially those!) are great timekeepers and incredible feats of precision engineering. Complications that would cost hundreds of thousands of dollars in wristwatches can be had for Toyota Camry money in a pocket watch. And things like chronometer escapements can be had for under $10K. Great show Tim. Addressing your point at 19:00; FPJ does not have anything in their catalog that I can buy directly from the boutique without "building a relationship". I know individual experiences can vary but this has been mine. I'm two states away from the closest boutique and can't go to the events that are supposedly meant to build a relationship.

Almost impossible to get a watch from the Journe AD without living close to it. I have reached out to all US AD’s and half of the overseas AD’s without a single reply. I live in the central US so secondary market is really my only choice. I guess it depends on how many Elegantes one has to buy to get a Monopoussoir at AD as to whether ultimately it’s more expensive or not. Overall the process is patently unfair but not unique to Journe. Same process for Patek, AP, and Vacheron as well.

I'm sorry to hear that. It used to be possible to order a Chronometre Souverain or an Octa Lune in almost any case even without prior history. But there are some incredible independents available these days and dating back to the 1990s if we consider used options. Even the hugely regarded early 1990s Daniel Roth watches are still available and comparative bargains as neo-vintage. Svend Andersen did a perpetual calendar for Alain Silberstein that's beyond awesome -- and a million other cool things like this. Best, Tim

Tim, you are spot on about the luxury watch outrages. The bundling or being forced to buy a brand or jewelry that I do not want to buy a watch I really want is truly outrageous! How outrageous? I do not bother to step foot into a Rolex or Patek Philippe AD anymore so I can keep my dignity. Thankfully the gray market does not play these "Pandemic Games" like the ADs still are. BTW, several of the 8 outrageous you mentioned I have experienced at the 1916 Organization. Specifically, the Patek Philippe Boutique in Miami Florida, and the Radcliffe AD after it became owned by The 1916 Corp. I will avoid these boutiques since they clearly do not want/or need new clients, and made it known to me.

I live in Zürich Switzerland. If go into a watch shop that treats me without respect (very rare), I just leave and go next door or across the street. Every shop knows this. That is why it is very rare.

I try to keep it from overwhelming the rest of my life. My work week isn't necessarily longer than others, but 100% of my office time is tasked and productive. I take no lunch or breaks, just eat a big breakfast and dinner, spend no time spinning wheels in chit-chat, and avoid meetings unless strictly required. Meetings are where workdays are wasted. I'm a pretty creative person, so I don't have any problem keeping the pump primed with ideas and projects. Where things sprawl a bit is the social media side since I stay active here on YT, on Instagram, my facebook page, and in Whatsapp groups with clients well outside of work hours. But watches are always on my mind. I spend a lot of time on weekends and evenings studying watchmaking. Best, Tim

Your point about prejudice, that is one reason I love Vegas, the watch dealers do not care what you wear because anyone who walks in can be stupid wealthy. In two other cities, which I which I will not name, dealers did not care about one’s clothes but what is on your wrist.

In general, I avoid other YT watch channels. The only ones I follow deal with things like repairs, restoration, and watchmaking. Honestly, some of the other YT channels suffer petulant hosts, grating voices, and puerile subject matter. It's must-not-see TV. Best, Tim

No, really just a coincidence. It's designed to look like the top of an automotive engine with induction manifold at center and valve covers on the flanks. Engines tend to be longer than they are wide. Check out the overhead view of a Buick Nailhead Super Wildcat V8 to see a good example. The resemblance to the Roth watches is an unintended consequence. I've pretty much always been treated cordially at ADs in New York City, and I don't look like any kind of baller. You see all kinds of people in all kinds of dress, and I think they treat everyone with respect, because they figure you never know who has the cash to drop. I was once at the Tourneau (pre-Bucherer) on 5th Avenue looking at a Nomos. I saw another sales lady showing two guys around the store. They looked like construction workers, speaking broken English. I happened to be next to the used Rolex case. They start looking at the Rolexes, and one points at a chronograph. He tries it on. How much? $16,000. I'll take it. Will that be credit? Debit. He plunks down his card, they do the deal, and they start to leave. He says something about Patek. Not here, try the other Tourneau around the corner, she says. And off they go.

Weiben, assuming you have visited the NYC luxury watch boutiques in the last 3 months or so, how safe is it to buy a watch without the threat of being robbed once you are outside? I was thinking of taking the train to Penn Station, but not sure how safe it is to have a luxury watch on my wrist.

I was at a Grand Seiko boutique just today (didn't buy anything, though). I wear luxury watches (mostly Grand Seiko) everywhere, at all times, day or night, and I worry not a jot, and no one has ever said boo to me. I pretty much never worry about my physical safety (except at the hands of the sociopathic drivers), and we're talking in places like the South Bronx. And yes, I take the subway, LIRR, Metro North, NJ Transit with no worry either (I've been on all of the above except LIRR in the last couple of months, always wearing a watch). Once time the salesperson at the Grand Seiko boutique put the Grand Seiko bag in a plain bag, which was a nice gesture, but for me unnecessary. You could ask for that if it worries you.

I am a California attorney with antitrust experience. Regarding Hermes bags and tying in general, the threshold substantive legal question is proof of the anticompetitive use of market power in the tying product. This analysis requires that the relevant market be defined and that the anti-competitive effect be demonstrated. This is easy to allege and hard to prove. As Abbott and Wright observe in Hylton, Keith N. Antitrust Law and Economics. Elgar, 2010: “bundling would not constitute unlawful tying if the purchaser simply desires to purchase less than the entire bundle of products offered for package sale at a reduced price. Rather, to prevail on an unlawful tying claim, the plaintiff would have to show an exclusionary effect on other sellers as a result of plaintiff’s thwarted desire to purchase substitutes for one or more items in the bundle from other sources that harms competition in the market for the tied product.” This means that the plaintiff needs to prove that sellers of the tied products (the stuff you don’t want so that you can get the stuff you do want) are harmed. The legal standard is not “I can’t buy what I want at MSRP.” It is also worth noting that class action suits are not easy. The class must be certified. The defendant will fight the certification of the class. If the class is certified, it will then move to the settlement phase. At this point the defendant will use the class to get rid of all the similarly situated plaintiffs by agreeing to the largest class possible and then proposing a settlement which includes minor changes to business practices, a lot of money for the plaintiff’s attorneys, a spiff for the representative plaintiff and useless coupons for class members. We all ignore these class action settlement post-cards in the mail because claiming the coupon is too much trouble and opting out, thereby preserving your rights, is merely an opportunity to hire an attorney. The recent settlement of the real estate brokerage industry is the rare exception where an anti-trust class action suit changes an industry and gets meaningful damages for the class. As a matter of economics, the core issue is that there are only two ways to allocate products -- by price or by quantity. Looking at watches, Rolex could decide to let retailers sell Submariners at the market clearing price, which is what the goods trade for in the secondary market. This would eliminate the perceived shortage of Submariners. It would also eliminate flipping. You see this with car manufacturers that let dealers set their own retail prices - the dealer adds the "Additional Dealer Mark-Up" to the hot cars, thereby selling new cars at the market clearing price. And everyone complains that the dealer is gouging them, when, in fact, the dealer is merely allocating by price instead of favoritism. Instead of allowing "Additional Dealer Mark-Up", Rolex is enforcing MSRP under the Colgate Doctrine. Rolex has decided to set the MSRP below the market clearing price, thereby creating a shortage (at MSRP demand > supply). This shortage means that the retailer must allocate the products by some system other than price. And what do retailers do? They use a system of favoritism in which they reward what they perceive to be good customers. In essence, the hot watches become a rewards program for good customers. And the fact of the matter is that if what you really want is a Submariner, you are dollars ahead buying a Submariner for a premium in the secondary market instead of losing money on watches you don't want in order to get the one watch you want at MSPR. It is also worth noting that for luxury goods makers, some customers are worth more than money -- they are advertising assets. Allocating a scarce item to a famous person to display in public is better for the brand image than selling it to me at any price.

You know how technical antitrust cases can get, so this could be quite a fight. Still, a few thoughts. 1) I followed that real estate case, and wow was it transformative. We still don't know how this will change the long-term course of the industry 2) I've wondered whether there's a substantive difference between Birkin bags and other $20,000+ handbags sold by many other luxury vendors in the segment. Anti-competitive charges won't stick if it's clear that many independent sellers are offering interchangeable options for competitive prices. Honestly, even if bundling clearly happened, this seems like Hermes' strongest argument to derail the case. There's no shortage of expensive handbags from countless different manufacturers, and Hermes has many competitors in its segment. I'm not sure the court will be sympathetic to the pleas of brand snobs if a logo is really the only commodity Hermes controls. 3) While Hermes' marketing department will claim otherwise in advertisements, the existence of functionally interchangeable competing products should be a core component of its defense and that of any other luxury brand accused of anti-competitive practices. Can't get a Submariner? Omega Seamaster! Can't get a Ferrari 12cilindri? Aston Martin DB12! 4) Put another way, is this like Amoco Ultimate 93 being priced at $4.50 per gallon -- plus a mandatory Coke and M&M's purchase at the GasMart -- while Shell V-Power 93 costs $4.50 per gallon across the street with no snack purchase requirement? If it's the same basic gasoline, and one station simply demands a snack purchase premium for the name "Ultimate," would there be viable lawsuit? Wouldn't the clear answer be "no, just go to the Shell station and stop complaining." Best, Tim

And remember that a tying case requires that you show impacts in the tied products (scarves?). This is a completely different matter of proof than the real estate case, which was basically that the major players in the market had conspired to set prices in that market.

I think you can still walk into a Blancpain AD and buy (either on the spot or after a month or two) a FF. Then, after you have appreciated how awesome that is, you will the likely choose a Villeret over most other dress watches in the price segment.
