The worst possible way to approach an employment attorney: The Emotional Leverage Gambit 

Emotional pleas, broadly speaking, to people you have no relationship with are manipulative. That being said, I'm sure by the time someone approaches an employment attorney, they might have already suffered months or years of emotional damage at the hand of their employer(s) and accumulated a great deal of stress.

Mental instability in itself is hard to deal with, mix that in with the seriousness of litigation and you have increased the difficulty of managing the case successfully.

Your video highlights several things. 1.) The people that are most often contacting employment attorneys are often extremely depressed because of the discrimination that they were subjected to, and because the path to obtaining justice in these matters is so difficult. 2.) This byproduct of the marketplace in which employment attorneys are seeking to make a living by helping such people obtain justice for the wrongs that were done to them, can be extremely harmful and depressing to the attorneys as well. As an age discrimination victim and survivor, who is still actively pursuing their case, I can honestly say that I can see both sides of this issue, and your video makes me feel for you attorneys as well. All I can say is thank you for doing the hard work that you are doing, and hang in there. America’s workers need you, just like America needs soldiers, sailors, policemen, etc. to protect all of us. But it is often a hard and sometimes thankless job, and God Bless You all for doing it.

Question: If an employment attorney is hired on a contingency basis, and she accepted your case. It was against a HUGE corporation and it was my young new attorney against their 3 corporate attorneys is it possible that my attorney could be bought out to purposely throw the case? Hardly put any time into the case and then tell me there was so much documentation against me she didn’t want to take it in front of a judge, but she would try to get as much as possible as a settlement Ended up getting a small settlement even tho they completely fabricated scenarios and HR created documents to substantiate lies told. Why would she cave like that? She acted so disinterested in the case and kept trying to tell me they had their ducks in a row which they didn’t and LIED. So they were let off the hook with a small settlement ( above 10 grand but below 20 grand). Can large corporations buy out your lawyer? Some of the stuff was hilarious to see and read. I was raked over the coals, words put in my mouth, mobbed by younger gen in my group and other people afraid to stand up for me.

I have not tried 40 attorneys yet- but I am learning what to say and what not to say and how to say it. Thank you so much for your videos! I know by Saturday, I will have something compelling and solid that would make the little "$$$$ding ding ding ding$$$" jackpot sound go off in any attorney's mind. Again, thank you!

Vince, have you ever represented a case of a terminated support person? The EEOC and Job Application Network both speak of this, and I believe it's a rare situation.

I am now 2 years and 1 month into my EEOC complaint… my former employer refuses to let them investigate and simply wants to make me an offer… this was 6 months ago… is there a way to speed this up?

I've had a case with the eeoc for 2 years, feels like I'm getting no where. And my lawyer was from a Google sponsored ad(doesn't seem to really care) that doesn't do litigation... seeing I feel my case is strong and I would like to pursue litigation.. am I able to just switch go a litigation lawyer if I'm ready to request RTS?

Vince! Question for you. Very shortly after filing a charge, a person got an email stating that the EEOC is deferring the charge to their state agency. Is this generally a positive? Negative? Dependent on the state? Under what circumstances should they ask for it to be sent back to the EEOC? Thanks!

Thank you for convincing me not to hire an attorney. I'm fighting a fairly low dollar fight to correct a record, it's more about right than money, and not worth an attorney's time.

I completely agree, and i love that you both realize a wellness check should be done as well as understand that in some circumstances it might make things worse and you have to use your best judgment when you make that call. Also the story you told.. oh my god.. "I thought you'd be more upset" ... I would've said (though maybe only in my head) "well i am now!" He literally tried to traumatize you. As you said, he's just a terrible person, not someone who actually needs help. Well, it sounds like he does need help, just not for depression. When it comes to those who do need help, though, and you might feel conflicted about whether or not a wellness check might help, i have a suggestion that may or may not be useful. And I make this suggestion as someone who has bad depression and anxiety but has gotten the help i need to maintain it, and i don't believe even in my worse states in the past i would ever say i was gonna do THAT to an attorney, but i digress. In some situations i could see saying something like "if you feel that way, I really could only consider your case if you check yourself into a hospital and take care or your mental health first. I can understand that this has been stressful for you, but I could only potentially represent you if get treatment for these feelings." I don't know, there may be issues with that statement, legal or otherwise. But again, as someone who has dealt with those feelings in the past, i could see that being a bit of a wake up call. And maybe once the person is properly treated they either realize they don't have a case and don't bother you again, or maybe, they really do have a case but were unable to articulate it in their mental state. Maybe you actually would be able to win a ton of money for them and you once they have the treatment they need. Or maybe I'm totally wrong. But i figured it might be worth the suggestion.
