The entire purpose of "Zoning Laws" is to provide a channel for the elite to displace the poor they don't like under the guise of "Public Improvement".

Slight issue with how they did the "rezoning" though, the application form for Texas can take 10-12 weeks to be finalized but everything else that HAS to be done by law (research, planning, notifying all affected parties about it ect) for even a small area can take between 24-48 months (so 1-2 years) to complete before any rezoning can even officially be done. They can't just go "Oh this is no longer a zone that allows for mechanic shops as it's now a yuppy fucks "premium" spot" and be done with it, it just doesn't work like that.

This situation sucks, but the reality is most people don't stay with their vehicles, or even go to the shop with their vehicles unless they are on a trip away from home and that's one of their only options. While a local business might get occasional customers from the auto repair shop, they certainly won't get tons. Either way, this type of thing simply shouldn't happen. You remove incentives for people to take the chance and actually go into business, if they risk some burocrat deciding they aren't trendy enough for the location in the future.

there will be more of those workers and they get to tax each and every one of them. Plus, the value of the property will be higher so that's more taxes. It's all about money, they don't care about the people.

Everyone should be allowed vegetable gardens; that should be seen as a sacred human and civil right, and any regulation against it as an attempt to prevent us from having food autonomy. No one is harmed by their neighbors raising fruits and vegetables- this is getting outrageous.

The US has had a terrible record for liberties for small businesses for decades now. Small business owners are basically crushed under the regulatory capture implemented by mega corporations who know they're nearly the only ones who can afford to meet all the onerous regulations and codes across the country. It's amazing how many other counties actually have more small businesses than big chains because they're free to earn an honest living. In Japan, for example, there's no zoning regulations against running most types of businesses straight out of your home. You want to open a shop or provide haircuts out of your property? Just do it.

And the municipal/county/state/federal division in particular limits what your LOCAL government can do, because they exist at the whim of a higher level of government. Failing to grandfather him very arguably violates the takings clause. The trick is though, you have to take them into court, there is no element of the government that polices itself (at least, there isn't in the current incarnation of our system)

Once you legally own something, nobody should be able to dispossess you of it outside of highly extreme and rare circumstances and only then if you are compensated double its market value at that time and only with your permission, unless the situation is one regarding a serious crime committed on the property and the property seizure was being done to compensate victims. Government is just a thuggery group for big business protection and advancement in this country. Sometimes counties will try to profit personally from criminal seizures AKA robberies AKA takings, but what I see is more frequently they act as the muscle for big business.

On the other hand, someone opened up a canoe factory in a garage in my neighborhood and the neighbor is getting pelted with fiberglass dust all the time. Their ability to enjoy their private property has been destroyed by someone who opened up a small business. As a small business owner, I don't think hurting other people with a business is acceptable.

I think there is a false comparison to having a man who owns a garage compared to a woman who wants to build two homes on her tiny property compared to someone who wants to house homeless people and concentrate them in residential areas. Those are 3 very different cases. While I support the man with the garage, I do not support the other two.

Even if he would eventually win a legal case to remain in business, he has to spend the time, money and other resources to see a lawsuit through to the win. The municipality has more resources and can outwait most plaintiffs to win by default.

Why not just request that you install better exhaust equipment? Did you consider trying to fight it? I'm really sorry to hear what happened. You got to fight these things. Even if you lose you've got to fight these people. They're not all-powerful. The worst they can do is send Pigs around to lock up your business but at that point you can make a demonstration and hopefully get on the local news drawing attention to the matter. You could also just report the matter to your local news, and have them cover it thus embarrassing these local officials. As soon as the city council looks like a group of bullies causing harm to a peaceful local business for no reason they may have backed down. Also I'm sure you could have sued them for just compensation and damages that they were choosing to inflict on your business and loss of revenue. You can't just roll over when these things happen, that's what they're betting on. These thugs look down on local businesses in their community instead of having maximum respect for them as the backbone of their town. If they had any respect for you they would have offered you full compensation at the first at a minimum. Yes yes these criminals have some local goons at their command but that doesn't mean they're all powerful. You have to fight these guys in court. It's all about extracting tax revenue from major corporations. Dallas bean counters most likely determined that they could get more in property tax revenue and sales tax revenue from a company with deep pockets. The irony: They ended up with a fitness studio which most likely provides even less income than the auto shop. The real story is businessmen and women work behind the scenes to call in favors from their council members to drive out their competition or build a new business.
