The answer is that even if Costello is truthfully reporting what Cohen told him, they know that Cohen lied to Costello and was still trying to protect Trump. Particularly, that Cohen had NOTHING on Trump he could give the Southern District to get a lighter sentence. In fact, in their indictment of Cohen, they identified Trump as an "unindicted co-conspirator". And in their Sentencing Memorandum for Cohen, said that Cohen had kept Trump informed about the situation with Daniels and followed his orders.

It’s not a crime to have your attorney arrange for the payments and the details. It’s not a crime to take your attorney’s advice on how to do it. It’s not a crime to pay your attorney back for having done this. It’s not a crime for a bookkeeper, who isn’t you, to label those payments as “legal expenses”.
