Sometimes, attorneys in mock trial get the “honor” of crossing over-the-top, crazy, aggressive witnesses that are super hard to reign in and control. So, in this episode, I’ll share my favorite tips for maintaining control of the courtroom whenever you run into a witness like that on cross-examination.

I would just like to say thank you so much for creating this channel! Through your videos, you helped me win best attorney in both rounds. I went into this Mock Trial season barely knowing anything about being an attorney, but you've made me feel so confident now :)

Haha wish I saw this video sooner! I was acting like a stubborn, aggressive investigator for the person crossing me and they clearly got irritated…The judge ended up telling their team to be less aggressive on cross questions🤣

Hey there! My team could use more pointers on common objections in mock trial. How to make them, what are they based on (RoE), how to defend against them. I see you already have some videos specific to certain objections, but any tips on relevance, hearsay and its exceptions, etc. Also, drawing the distinction between questions that sound leading on direct but are ok to ask in court. One last thing, they were allowing student-attorneys to qualify police detectives as experts - these are fact witnesses and furthermore voir dire is not permitted under our rules. How do they argue this next time?

Lots of questions! Let me try to answer them. First, I have videos on... Relevance: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-qYf1H2Z_hm0.html Hearsay: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-A6qd7bb09Jw.html Hearsay Exceptions: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-29JcEQ0ZGDk.html Second, I cover objections top to bottom in this 45-minute podcast with Amanda Mundell, co-author of the fabulous "Winning Objections" book. Should answer a lot of your more general questions. ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-DDbzQ1Nau1I.html Gonna talk about leading questions a little bit more in an upcoming video. Generally, ask only open-ended questions in direct exams unless you really need a leading question--should be 1-2 at most per direct. I don't think officers should be experts because I agree they are fact witnesses. They aren't interpreting anything. Your best bet is to make an argument under Rule 702a that the opinion won't actually assist the trier of fact. Rule 403 could come in handy, too. Hope this helps!
