The plaintiff worked for the defendant’s airport transportation company. She says the defendant didn’t pay her, so she’s suing for what she’s owed. The defendant argues she found out the plaintiff was a repeat felon and that the plaintiff claimed she was working when she was actually in jail. She’s countersuing for loss of revenue and projected loss of revenue.

Just because you have a record doesn't mean you're a bad person or don't deserve to work and make money. The issue with the plaintiff is that she should've told the truth in the beginning.

​@oldageisdumb I used to have a boss who would "talk excitedly" and aggressively, just like the defendant. If you responded to him with "please stop yelling at me" he wpuld gaslight and say "I'm not yelling. I'm telling you how it is." In the calmest, most demure voice. He was a nightmare boss, and he took advantage of us employees. What upu claim isn'tyelling, is very much yelling. You're confusing it with screaming. No, she wasn't screaming at the judge. But she was yelling.

In Shelby County in TN. You get a speeding ticket and if you forget about it, and don't pay it, they suspend your license.

Here in RI also. Heck, they'll suspend your license for not paying for a parking ticket in some towns and cities, which is BS. I hate when JM says she doesn't believe in certain things just because she hasn't heard of them before or hasn't experienced the same.

She didn’t have a copy of the endorsed/cashed check, which seems like one of the most basic pieces of evidence you would provide when trying to prove that you have paid someone for anything. Then she didn’t have her laptop which is where she claimed to have evidence that the plaintiff didn’t put a particular job on the calendar.

I agree! She shouldn’t have been a 1099 to begin with! She should be a W2 employee, but the Employer wanted to commit tax fraud and not pay taxes on her “employee”. Plus! It is an Employer’s responsibility to keep records on hours worked and checks issued, then cashed. Employer should have been penalized IMO. Plaintiff should go to The Department of Labor and report them for withholding pay.

For those who did not get the most important part the Plaintiff was hired as an independent contractor a 1099 or a vendor, because the defendant was a cheap a hole and didnt want to pay SS, medicare, taxes, health benefits , unemployment tax and overtime. The plaintiff should of gone to the state labor board in her state and if they found that the defendant was engaging in treating employees as contractors they would of been fined more severely by the state and would of prob granted the plaintiff more punitive damages for violations of labor laws. In California employers can be fined 7x the amount of the pay in question in these cases. If that HR chump would of done her job she would of advised the defendant not to do this type of hiring.

I don’t think the plaintiff lied about not getting paid for 4/23-4/27. The defendants said that they owed like $250 for the following week and $300 for the week after that… so why did her 4/14-4/27 paystub only have her getting paid $280? Seems like they only paid her for one week of work, and the plaintiff wasn’t claiming for 4/14 week, only the 4/23 week.

Umm I'm sorry but just because someone has a felony does NOT make them a bad person necessarily. Sometimes people get themselves into situations that result in something bad happening. That then results in them having a record. However, most people who are felons. Have learned from their mistakes and do what's necessary to rebuild their lives. So don't categorize them all by saying felons are bad, dishonest people.

Her criminal record has NOTHING to do with her job performance. The judge isn't God and shouldn't act like one. We ALL have done stupid stuff in our past or even present the only difference is some got caught while others got lucky. Same type of thing happened to me. I do skilled home health care, meaning I work with quadriplegics and paraplegics. I’ve been doing this for years. Usually just one client and I stick with them until the end 😢. I was looking for new client (my previous had passed a few months before) and i found a new job with a client. It takes months to get to know a clients care, it’s very specific to them. I had one day of training because the girl was replacing herself. That should have been my first clue. The next day on my first solo shift, it took me 7 hours to get everything done. It’s only supposed to take 4. I was working my booty off for a whole week trying desperately to get faster at job. Then on Friday I was in car accident that wasn’t my fault. I still went in but my hands were severely burned from airbag, and my whole body freaking hurt. I told her I would just be moving a little slower and she fired me right when I finished the shift in agony. Then she didn’t want to pay me for the week of absolute hell working with her.

Private duty is almost ALWAYS hell because is private pay patients BELIEVE THEY ARE ENTITLED to behave any kinda way I had employer go thru household garbage and grill me about wht I WAS EATING she had an eating disorder and BELIEVED everyone should eat like her I was on my way to overeating a disorder in its itself which was enforced by this women screaming at me about my food

The plaintiff - who doesn't know or have run across a person like her? The owner didn't do due diligence while hiring. Considering what the company is making providing drivers what they are paying employees is minimal and they know it. Who lets an untested employee handle their business and just go out of town? She's lucky she lost only two customers.

I agree that the defendant shouldn't be granted a successful counterclaim - she wasn't able to properly validate the loss of income. Her demeanor dropped near the end of the case, because she was frustrated. But so did the plaintiff's - she looks like she could gather a full head of verbal and physical steam, lol. And $12.50/hour isn't bad for what basically is unskilled labor - Florida's hourly wages are quite low, compared to most other states.

"Habitual felony offender status" is definitely not just a suspended license for speeding tickets. It's so funny that as soon as the Judge stated she would allow the Defendants to come up with the proof(the check was cashed), the Plaintiff got so flustered and changed her story. Plus, when the Defendants looked into the hours the Plaintiff said she worked, they found she was fudging her hours and adding hours when they were obviously closed or when no one worked. That's what you get when you allow employees to keep track of their own hours and just submit them for payment.

I'm not sure what's wrong with a person with a felony ( i dont have one never been to jail just saying) Sometimes people do things as kids and it follows them for life doesnt mean they are a bad person. Is the judge going to let the damn plaintiff finish even one sentence!!! It may look a certain way but sometimes you find out through explanation that that's not exactly how it was.

Regardless I believe, wages cannot be withheld for any reason even if they owe because that's when a bill or suit comes in specifying for damages from the employer.

Both the plaintiff and defendant seem like lovely people. Thats sarcasm just for clarity. Plaintiff's history and not having her paystubs so just makes stuff up to bring to court. Defendant yelling at the judge for her own not being prepared and blaming and expecting an employee to pay for a lost client and potentially manipulating peoples pay based on their performance with that "for excellent work" comment.

I think in this case, there is a reason why the plaintiff did what she did with her name. We don't know if she had an ex-husband after her and she didn't want to have the right name on her drivers license or whatever. But I think that's something that she's been called a felon, when you look up with some felons due to break the law and to me, this is a mishap. If I would've been her, I would've called the state of Colorado and had everything emailed to her so she could've shown the judge that it was dropped. Now this defendant to me, she's a piece of work. The woman worked fine before she found out she was a felon, but because she had that word felon attached to her, all of a sudden she became untrustworthy and unable to work properly and and and and. I think she was ridiculous and I'm glad she didn't get a penny and has to pay. She's a poor little school girl in the playground and the girl next to her said shoot, she yells at the girl, You're going to go to hell for saying that word. Paalease!!🙄🙄

You can see that the plaintiff is owed something and the defendant is being shady! If they are so worried about their employees, they can do background and credit checks. The fact that she had the suspended license has nothing to do with her job.

That’s obviously how the plaintiff pronounces her name. In the introduction of the litigants the announcer pronounced her name tie-nuh. Also the plaintiff never corrected anyone for saying it that way.

Her record don't stop her from getting paid. Both were trying to milk the other. The defendant is rude AF and Judge let her go on and on.

4,000 in court preparation...?? She was trying to get paid for having done a self audit with her own accountant. Lady the work done would be absolutely nessecarry regardless of the plaintiff trying to sue you. How do you keep a accountant and not have the check stubs and information on who got paid and if they cashed the checks..?? Your account sucks or you don't know what your supposed to keep track of, what are you gonna do if you get audited...??

Most judge shows..both parties get paid a fee to appear on the show but the money owed isn’t, that’s why she says sometimes pay the man/lady…they get like a $300 appearance fee only…

Ok, I have a CDL, a professional driver, why is this lady solely relying on one person to dispatch drivers? That is her mistake. Also hiring someone that cannot provide credentials before ytheir first day is a red flag. What type of onboarding does she have, she just hires anybody and now she’s mad she lost business.

Some "Felons" do change their spots.....To say on national tv dont hire felons....why dont you say well i didnt do background checks very good did i??? Sometimes when you do a background check and get that info you ask your potentual employees what happened....The defendant has alot to learn still in my opinion.....

I don’t think the plaintiff was being purposefully deceitful, it seems she’s foolish but thinks she’s self-assured and that probably causes her to make poor decisions. She even admitted most of her proof was from her memory, then later when asked a different question said she has a bad memory. I agree with the judge’s decision, because whether she meant to do it or not, the plaintiffs credibility was faulty. It’s just lucky for her the defendant was also unbearable and rude.

An I-9 form needs to be completed within the first 3 days of employment, or you shouldn't work. Two forms of ID are needed, unless you are using something like a passport.

If the plaintiff took the call and was supposed to log it in, so that the person could be picked up and yet they weren't, then the only person at fault is the person taking the call, and the person that didn't get picked up isn't likely to trust that company in the future, so is more than likely to cancel their contract with them, the judge was being quite nasty to the defendants, when they weren't at fault in the slightest...
