British documentary originally shown on Thursday 16th March 2006 about the Norfolk farmer, Tony Martin who shot a burglar dead in his home in August 1999. Martin was convicted of murder, later reduced to manslaughter on grounds of diminished responsibility, and served three years in prison, having been denied parole.

If they hadn't broken into his house then they would not have been shot. End of story. He didn't go to their house looking for someone to shoot. They came into his home uninvited.

Tony Martin had a Hero fantasy. He wanted this to happen. He suggested to his neighbours he wanted someone to break in so he could shoot them. He shouldn't have had guns. He got a PUMP action shotgun (that had been outlawed for over 15 years) that he "found" . HE SHOT a 16 YEAR OLD BOY IN THE BACK. He wanted this to happen. He wanted to kill someone. He had his wish.

He opened fire at the boys when they were running away, that meant they were no longer an active threat to him which therefore means it was not reasonable force to shoot them in the back.

What is wrong with you? The old man broke the law!!! He didn't have that paper he was supposed to have when the people broke in. Yes! .. he would be dead right now as we speak , had he not violated the law by defending himself with a gun that didn't have a paper, but at least he would be a law abiding dead person. my house was broken into 7 days before Christmas. All of our Christmas gifts were gone along with all of our electronics and they even stole all the food. Devastated. However the community found out and it turned out to be one of the best Christmases I have ever had. People gave so much that I was able to share with family neighbor family and friends. Thank God for Jesus

Right. The CRIMINALS ARE SCUMBAGS. BUT is the punishment for burglary death. They were unarmed and posed not threat. They didn't have the chance to interact with the homeowner. The way Tony Martin acted. How he LEFT his house to stay in a hotel out is house was proved to be not normal. He could have scared them off at any point. a 16 year old boy DID NOT need to be shot. Tony Martin was WAITING for this happen. HE had a fantasy about killing people and THIS is what he did. You NEED to look into this case. HE had a FANTASY about killing intruders. He had an illegal gun. He wanted to kill burglars. He GOT HIS WISH.

I think you're missing the point here. If he hadn't broken into someone else's home, to steal someone else's property, he wouldn't have been killed. The victim is the man who served a year in jail over protecting his own life.

It's more often the case that a householder gets killed by burglars, than the other way round. Tony Martin may have been beaten to death, if he hadn't got a gun.

Same thing happened here in the west of Ireland to a farmer named Padraig Nally, they broke into his house more than once and he was at the end of his thether and shot dead the burglar. He was convicted of Manslaughter and did a year in jail, got a retrial and was finally acquitted and set free. I believe he did the right thing you should be able to protect yourself if something like that happens in your own house. The men in Tony and Padraigs case would be alive today if they weren’t thieving scumbags and had a normal job, harsh truth!

The reason he was sentenced and incarcerated was that he is an extremist who openly wanted to shoot trespassers, used excessive force instead of reasonable force (should have turned on lights, asked for hands shown, and not fired upon learning they had no firearms/machetes/axes/etc.), lied to the police, owned two unlicensed firearms and one of those firearms had been outlawed, evaded police instead of calling them or going into a station on his own, and I believe that there are no official *self-defense laws* in the U.K.

@@redram5150 That analysis ignores one key fact, my friend: the law does not decide who is guilty and who is innocent in an English court. Neither does the judge. Only the jury can do it. Judges can sometimes direct a jury to return a verdict of not guilty, but no-one has the power to force a jury to convict. Ever. In Martin's case they found him guilty by a majority of ten to two. That means two of them rejected all the legal advice and all of the prosecution arguments, and found him innocent (which they were perfectly entitled to do). The other ten could have done exactly the same if they wanted to, and no-one could have stopped them. But they didn't - because they believed he was guilty. So when people complain about the law protecting criminals and the system being broken, perhaps they ought to consider the possibility that the problem, from their point of view at least, is nothing to do with the law or the system, and everything to do with the fact that not everyone shares their opinions?

I don't think anyone feels sorry for the burglars. Considering their ages it would have probably been nicer if they were just arrested and maybe we're able to reform their lives and become law-abiding citizens. At the same time, they did make the conscientious choice to engage in a criminal act knowing full well it may have dire and lethal consequences. Mr. Martin did what he had to do to protect himself and I cannot fault him for that. I may have done the same under such circumstances.

Your point shows that there was a track record of people breaking into his property. What makes this case interesting is that it shows the flaws of the legal system. If TM was to be imprisoned due to protecting his house then the law itself should change to give homeowners more rights. People who use the argument 'but he broke the law' or 'this is the law' don't stop to think maybe the law itself is flawed? Just because something is legally right doesn't make it morally right. it was legal to have slaves at one point, should we have stuck to the 'this is the law' argument when people were trying to ban slavery? No, of course not, human morals changed and with it so did the law. the reasonable force argument is flawed to the point where some homeowners might not even bother to protect themselves just because they might fear the repercussions after. The last thing anyone should worry about when their house is being invaded is how much force can I use that might be deemed reasonable? Just that split-second thought could be the difference between life and death and why? because we have a law that talks about reasonable force. If someone breaks into your house your only thought should be on YOUR and whoever you are with survival. Not the safety of the disgusting bastard whos broken into your home. Think of it like this, the burglar whos in front of you has already broken one law by entering your house. Who is to say they won't break another by killing you? The thing is you don't know and you shouldn't need to waste time thinking about it either. Protect yours and your loved ones and call it a day.

The guy was a dickhead. I live in the UK, and when I had guns in my house I made it my business to find out what you can and cannot do in these situations. It wasn't difficult to find out, and it wasn't difficult to understand. It is actually your legal DUTY as a firearms or shotgun certificate holder to know the law regarding firearms use, just as it is your legal duty as a driver to know the rules of the road. Ignorance of the law is never an excuse, and if Martin hadn't the common sense to learn what his responsibilities were and what he was and was not entitled to do, then whose fault is that? He got what he deserved, as far as I'm concerned.

@y r I would first lock my door and make noise( turn on TV or radio, music) to scare away them. If that doesn't work, I would yell and fire into air. Or I would escape to neighbours and together with them, I would find a way. But to be honest with you, it is scary to put yourself into his position. You don't know what lurks inside the house and night. Even if he fired and shot the thieves, he must have turn on the lights and seen what he had done with his action. And when had seen those were only little bastards to steal for money, he could have called the police and ambulance or neighbours. Anyway, unfortunately whatever we say or claim will not bring a lost life again. And mad people will do whatever they want.

Someone who breaks into your home while you are there has already taken the decision for both of you that if a confrontation happens, there will be violence. They evaluated the risk and decided that they are ready to do you harm if caught. This is not about somebody defending their home, this is about somebody fearing for their life.

Nicely put, but in Martin's case that is still open to debate. The incident involved two competely separate offences: one (the murder/manslaughter charge) could only be decided by a judge and jury; but he was unquestionably guilty of the other, and the judge had no choice other than to impose a custodial sentence. Martin's shotgun licence had been revoked because he wrecklessly and disproportionately discharged a 12 bore at someone during an altercation at his property a few years earlier, so he already had a track record of malicious and dangerous behaviour with legally owned firearms. That means that on the night of the shooting, he had already been declared unfit to own one. Furthermore, the weapon he used on the night of 20th August 1999 was not technically a shotgun, but a Section One Firearm, because it was capable of firing more than three shots without reloading. Illegal possession of one of these is a very serious offence, for which there is no legal excuse. Martin must have known that he was breaking the law, and because of his history the court could not possibly let him walk free. He would have been jailed anyway, regardless of the verdict concerning Fearon and Barras.

This simpleton's analysis ignores one key fact: governments do not decide who is guilty and who is innocent in English courts. Neither does the law. Or judges. Only juries can do it. Judges can sometimes direct a jury to return a verdict of not guilty, but no-one has the power to force a jury to convict. Ever. An english jury consists of twelve randomly-selected people who act as representatives of the general public, and in Martin's case they found him guilty by a majority of ten to two. That means two of them rejected all the legal advice and all of the prosecution arguments, and found him innocent (which they were perfectly entitled to do). The other ten could have done exactly the same if they wanted to, and no-one could have stopped them. But they didn't - because they believed he was guilty. So when people whinge and whine about the law protecting criminals and the system being broken, perhaps they ought to consider the possibility that the problem, from their point of view at least, is nothing to do with the law or the system, and everything to do with the fact that not everybody shares their ridiculous opinions? Just saying.

@Jack Williamsactually there has been more then few shootings by legal gun owners defending themselves against house breakers with no indictments or loss of gun rights the last one last year near heathrow the fella didnt have a certificate and killed a one smashing his way into caravan he was not charged with any homicide . he was only charged with having a shotgun without a certificate an affence that be charged as either a summary or an indictable charge. the CPS pressed for an indictable conviction when he pled guilty at the magistrates court, and thus got 18 months when he was sentenced at the crown court

Watch again: the murderer got convicted... Yes the burglars are wrong but guess what: both sides can be (and are) wrong... If he'd have fired his gun as he said he did there wouldn't have been an issue for him, but he fired, relocated to get closer and fired again. This proves that he was not in danger and he knew it: he ran after them instead of being terrified and trying to get away. After that he hid the gun, why would he do that if he had just saved his own life with it? He knew he was not in danger when he fired the gun, that's why he hid it, that's why he didn't call the police. You can see it in the interview, he is an extremely stubborn man with no empathy. Everyone who would have shot a burglar in self defense would feel empathy, a form of guilt over shooting a human, even if that human was a piece of shit burglar, he instead shows no emotion over the whole thing and maintains that he shouldn't. I'm not saying you shouldn't defend yourself or your family, just that this man didn't do that, he went out of his way to chase a burglar and attempted to execute him and then lie about it while he hid the evidence...

The reasonable self defense law is silly because it doesn't take into account human nature and presumes that someone is going to act level headed and calm in a situation which must be terrifying. I do feel bad for Fearon, he was a young kid who was a victim of circumstance and his up bringing that normalises such behaviour - But I do think charging a homeowner for the death of a burglar is ridiculous, at the most Tony maybe should have got a conviction for excessive force with a suspended sentence. There is something very wrong with a judicial system that places an equal footing on a homeowner and a burglar.

@@markusjohnson6558 To each their own opinion I suppose, yet I think that in this case the homeowner was rather suspicious in his actions to shoot a burglar, move and then shoot again (which shows clearly it was not out of fear, at least the last shots weren't). That first shot could've been out of fear, but terrified people typically start shooting and don't stop until they run out of bullets, out of panic they empty their magazine/clip. Him moving sort of seems like it was an execution. This is further made plausible by him saying for years that he would love to kill a burglar, so clearly not out of a terrified state but pre-meditated. Then, after shooting someone he leaves the house (why?) while he knows he just shot someone, moved and shot him again so likely fatal wounds... I think that the law should not allow lethal force in a burglary, so that a judge can look over the case and see that as it was here there was more than just a bit of self-defense out of a terrified homeowner. If it was the father of a family who was upstairs, terrified, he might've felt some added fears and a judge would likely make an exception for that. Happened here, a juweler got robbed, the wife got so scared she fired a gun through the door in blind panic (hitting her husband but not killing him). She killed one of the two robbers using an illegally owned gun. The judge took the gun and basically told her to stop having illegal weapons, no sentence was delivered against her as the circumstances explained her actions.

I like that the 'expert' says that a pump action shotgun is a tool for controlling a large number of people, and that a 'normal' person would have no reason to own one. Well I'll tell you something; I have a pump action shotgun that I bought for the specific purpose of using it to kill a burglar if they present a threat to myself or my family. xdoctorbeatx The man was referring to the specific model of the shotgun, not the action itself. Riot shotguns are used for riot-control & law-enforcement. That’s their primary purpose. Pump-actions are legal in Britain, over 24” in length. Tony Martin at one time, owned that shotgun legally years ago & he didn’t surrender it, when they were banned from civilian ownership in 1988, after the 1987 Hungerford Massacre-as his license for it. Probably expired & back then, the police weren’t as strict or as efficient as most details of gun owners were held on paper-files- especially police forces in rural England.

Every one of those jurors would've been in a much better position to make a decision if they'd known how it feels to hear in the dead of night someone trying their doors, to be terrified, & then hearing em' making entry, shaking from terror & the stairs creaking as they make they way up to where the juror is..........cos' if they had they might've come to a decision that didn't victimise the victim. Shameful jury.

this very thing happened in my town just a few weeks ago and not only was the homeowner NOT charged with a crime but the ppl who were trying to break in was charged with murder of their friend because he died in the commission of a crime. all the burglars are being charged with murder in the first degree, i don't see how this is any different.

There are few things that undermine your feelings of safety than having your home broken into and some stranger rifling through your stuff!! The only thing that would be worse is being raped. I say this as a woman who's home was violated, when I was living alone. The disgust and sense of being violated ran through me every time I entered my home after it happened. It was very traumatic!!! Tony did the right thing. As for the criminal with a record of 29 violations, screw him, he got EXACTLY WHAT HE DESERVED!!!

The jury convicted Martin on the basis of observable evidence, mate. Forensics proved that Martin's account could not be true; and because he had opened fire without warning, had shot Barras in the back and Fearon as he was trying to get out of a window, they were persuaded by the prosecution argument that Martin had made up his mind to kill or injure right from the start, and had no intention of letting anyone escape. That's murder, plain and simple; not just in UK law but in the judicial system of every western country I can think of. If Martin had acted reasonably he would have got away with the murder charge, but would have been jailed for the firearm offence anyway.

My heart goes out to you Mr Tony Martin. No one should be chased out of their home by a bunch of lawless petty criminals that offer nothing to the world they reside in other than sorrow and heartache. I agree, just as long as you act in legitimate self-defence and with reasonable force. Tony Martin did neither, which is why is ended up in jail. I made in my business to find out what I can and cannot legally do in these situations when I kept guns in my house. It wasn't difficult to find out ,and it wasn't difficult to understand. As far as I'm concerned, if he didn't have the common sense to appraise himself of his rights, then he shouldn't expect to get away with it. Ignorance of the law is never an excuse.

where i grew up anyone who tried to steal from farmers runs the risk of getting shot i have shot at a group of men who had cut the fences of a neighbors property driven a cattle truck through and were about to steal a heap of Angus cattle from the paddock i just shot the tires out with my grandfather Lee Enfield .303 spooking the cattle away from the thieves then they fled on foot i repaired the fence then called the cops but i live in Australia where we have castle doctrine i was licensed at the time my reward was a deep freezer full of Angus beef and a bbq steak with damper bread

The fact that at the beginning of the programme we were told that the woman had been burgled three times and Tony Martin had also been burgled before shows that the police force was a total waste of time - further qualified by the fact that they admiteed they could not 'talk' to each other across the county lines. Totally ridiculous. What confidence can the locals have that they have any protection at all from being burgled ? Tony should not have been prosecuted and it would perhaps have sent a message out to scumbags like those that they will get more than they ask for if they try and burgle vulnerable people.

Obviously this area was burgled over and over again. The police should have been doing much more than having a stupid farm watch meeting, why should the people be the ones to police the area? This guy was burgled three times!! He was living in fear. There was nothing wrong with the way he lived - it was his choice to live the way he wanted to, it was his land!! 95 % of the UK were behind this farmer and his right to defend himself and his property. Why did he creep down the stairs? well, who in their right mind would come charging down stairs, not knowing if the burglars had knives. weapons, ??? This pair of twits, have some nerve to think they were in the right! No people do not deserve to die, but if you go into situations that you should never be in, don't expect a good outcome!!

How can it be premeditated, when someone breaks into your house? Can't believe that burglar had the cheek, to take the morale high ground, stating Martin should have rang police. Don't break into people's properties, otherwise hell mend you. You'd be in a blind panic if you had an intruder. Who's going to say to themselves..." I must only use reasonable force" to protect myself. Panic would take over. Like it probably did with Martin. Why is the law protecting the bad guys?

Come off it, mate. Martin was jailed for exactly the same reason that several thousand people are sent down every year: he told a pack of lies in court, and they were comprehensively destroyed by the evidence. He tried to pull a fast one and it backfired on him, so whose bloody silly fault is that?

I think they said it was premeditated because his neighbour had reported Tony said if anyone broke in to his house again he would shoot them. Personally, I don't think that's the same as premeditating a murder. I don't think the case would've divided the country if the burglar wasn't young.

@@plantlifeforever6994 Actually Martin had said the same thing in public on multiple occasions and in front of multiple witnesses - including the local police! The witness testimony certainly strengthened the case against him, but from what I understand it was regarded as premeditated when it became obvious that Martin had lied about the circumstances in which he opened fire. Martin claimed that he fired the first (fatal) shot because he panicked when a light was shone in his eyes. However, forensic evidence proved that from where that shot was fired, the pellets had to pass through a narrow gap in the wall. No stray pellets were found anywhere around the gap, so it had either been an extremely lucky shot, or Martin had aimed very carefully. This cast doubt on his story, and strongly suggested that rather than firing in surprise, he had lain in wait for the two men, effectively ambushing them. This is a big no-no in english law: setting traps and ambushes are regarded as premeditated acts, which in turn invalidates the plea of self-defence. It also meant that it is likely Martin was nowhere near as frightened as he said he was, and again, this was destructive of his plea of self-defence. The jury accepted the prosecution argument that Martin deliberately lied about the light, because he knew the truth would incriminate him. This is one of a number of lies Martin told in court, and which ultimately sealed his fate.

How many times have police killed someone with excessive force? How can a civilian be expected to do any better in a terrifying circumstance? It seems the intruders have more rights than the homeowner. I believe that if you break into someone's home it is at your own risk.
