I notified my employer that I would be taking time off, several weeks in advance. It was approved. One day before my time off started, another manager informed me that SHE was the one who was supposed to be informed. I told her I was unaware of that. She replied "Now you do". End of conversation. I started my time off the next day and got a call from another employee that the manager was looking for me and was informed that I had the week off. At the end of the week, a third manager called me to inform me that I had been terminated for taking unapproved time off. The state employment commission took a dim view of their tactics. It did not go well for them. Toodaloo!

It's really not. It's the corporation agreeing to compensate you, and your boss deciding that part of that compensation isn't good for her. It is a tripartite misalignment and should be addressed as such. If you pretend that it is a simple matter of wage theft, your outcome is likely to be worse.

When I first started working I had an otherwise bad boss who had a really good policy: he insisted that people take at least one solid week of vacation each year. The other days could be used for 3-4 day weekends, etc., but you had to take a full week off. He said vacations were to rest and forget about work, and it was easier to do that when you're gone for a longer period.

Had that happen once. Was in a trucking job and the business manager loved denying time off. I told her, in no uncertain terms, that I would be taking my vacation from and to and while I was away if she would be so kind as to email me if I should be looking for employment elsewhere that that would be helpful. Got back from my vacation and she was noticeably missing. Asked the owner of the company and found out that she had been denying nearly all of the drivers their allotted time off and she got her walking papers for it.

Watching your videos always make me appreciate living in Germany even more! I got 30 vacation days and there is nothing like a "sick day". When you're sick, you're sick! When sick, I can stay at home up to 3 days. If the sickness continues I have to see a doctor to get a certificate. Just telling how long, not the kind of illness. And if someone is chronical ill or has been ill for a longer time - the employer offers a talk to discuss what can be done to help the employee!

Unlimited PTO is just an accounting scam. I work in Finance and my company CFO was absolutely giggly when they implemented this because he knew that the managers would deny at least half of the requests and that they would be saving a ton of money on carrying any PTO debt. This has been a nightmare for everyone. We can't take more than 4 consecutive days off, and we can not take PTO immediately before or after a holiday. We have to ask for PTO at least three weeks before the date. Once denied, there is no recourse to appeal (HR ignores the request). If we manage to take more than 10 days off in a year, it is noted in our performance reviews as a negative issue.
@Erowens98

I’m nearly 40. I just wanted to make a quick comments all the younger generation about boundaries. In my early 20s I was very subservient and a people pleaser. But then later on, I became more assertive about my boundaries and one thing that you need to know you only need to flex your muscles about your boundaries just a few times before people understand what line they’re able to cross with you. I had a boss that wanted to criticize me in a group chat. I spoke to her directly, and in a serious tone immediately after it happened. I never had any issues after that. The best part about boundaries is once you’re able to clearly indicate what you’re willing to tolerate. Most people don’t want to overstep those boundaries. So it definitely gets easier..

Some states *do not* let employers mess around with hourly workers missing mandatory breaks and lunches or employees being denied the time off they've accrued. Since our vacation pay was far below what we could make by being on the sales floor, most of us planned on just using the extra cash as a Christmas bonus to ourselves. Come Thanksgiving the store manager decided to reverse the policy and told us we would have to use the time or lose it. Since we all had 3-4 weeks worth of time banked we informed him that since would have to use our vacation days before December 31st that he would need to find trained coverage for the most profitable departments in the store. The next day we all had our vacation paid out to us. Funny thing is the numbskull tried it again the next year with the same result.

Something to remember when watching these wonderful videos is to do your due diligence regarding employment law in your country and/ or state. For instance, most states in America are "employee-at-will", which means employers can fire workers without providing any reason whatsoever. The only time they can't is when the employee can prove it was due to prejudice against a protected class, e.g. religion, race, disability, age, gender, pregnancy. Best advice, get any and all communications at work via email, as all of it can be used as evidence (works both ways, so don't say anything stupid).
@AllThePeppermint
@AllThePeppermint 4 месяца назад
Except that there are still circumstances where even "at will" states have to provide good reason for firing an employee, apart from protected classes, or else they face legal issues, like wrongful termination. And it isn't wise to fire your most productive and reliable employees, although some managers like to as a way to flex.
@ladyofthemasque
@ladyofthemasque 4 месяца назад
That's not actually true. They still have to provide a *legitimate* reason, and it also cannot be due to retaliatory measures, etc. It's just that they don't have to jump over nearly as many hoops. Folks, always document everything, and talk to employment rights lawyers!
@Mortlupo
@Mortlupo 4 месяца назад

Building off @Mortlupo's reply, firing you for not participating in illegal things INCLUDES not using your PTO. Check the labor laws. It is not legal for them to deny you part of your compensation, whether that's pay for the hours you've worked or the PTO in your contract. So, if a job ever tells you they fired you over this, write it down and save any communications about it to present to a lawyer and the labor board.

Now I have had four years of fantastic supportive bosses who have all protected my personal time and made sure I got every day I asked for. It has never been “we don’t have availability” but rather, ok let’s train someone so you have backup for that time.

I worked at a McDonald's hamburger restaurant back in the 1980's. I took the week around Christmas off for vacation, but since it was so close to the end of the year, I got paid for it in January. When I tried to take more time off during the new year, I was told I couldn't since I'd already used my allowed time for the year. I called HR and I don't know what came over me, but I argued calmly and firmly (I shocked myself) and told them I took the time off the year before. It's not my fault we got paid every 2 weeks, and I received the vacation pay in January. They actually apologized and said I was right and granted my time off.

I had a very similar occurrence about 18 years ago with a supervisor that told me that a week vacation would no be approved. Then I found he had requested 2 weeks off and it was granted. Needless to say that both he and the Personnel division got in deep shit when the Assistant County Manager opened the formal Union complaint a few days later. My supervisor couldn't justify his denial of my leave and was give a formal verbal chastisement.

*1)* Because a lot of people will cave to the bullying and abuse (and make no mistake, that's what this crap is) and will try to stick it out and suck it up, even when they shouldn't. *2)* Managers hate promoting people who are highly competent; it makes them worried that said competent people will be promoted into their jobs and they'll be out a cushy slot, so instead they much prefer to promote mediocrity. *3)* C-suite folk LIKE managers like this, because managers who bully their subordinates into not taking vacation/PTO days, staying late w/o overtime pay, and doing the jobs of multiple people at once for the salary/wages of a single employee not only earn the corporate fat cats more money via all the extra work done, but _save_ them money as well. Why hire more people when you can just bully some poor schmuck into doing the work of 3-4 people instead?

I had that with an ex manager. He refused my time off because we were always too busy for me to take it. Even to take sick leave for some surgery I was having. He wouldn't employ qualified people to help me only people I would have to take time training, which meant longer time not having time off. I burnt out several times over several years because of that. Had to stay because we were building a house and I needed long term employment at that time. Moved on and much happier and supported now. Even being a supportive leader myself.

Back in the old days in a certain state teachers were given business days by that state. The law said that admin could not make teachers give a reason and they could not punish them for taking off right before a holiday . I brought a copy of the law to school. Admin told teachers they would dock them if they took off then. After the first long weekend a few teachers took a day then. I did not. I was called in and told I would be docked for that day even though I was at school all day. I said they might not want to do that.

I had a manager who got so shitty one day because I was leaving early (i was feeling unwell and also 6 months pregnant, so didnt want to take chances). I let them know like an hour before I'd be going, and got several teams messages about how its a bad look and he "appreciated" more notice - my team and I had literally covered for him two days prior when he was too hungover to work, with no notice. I screenshotted the messages, sent them to our HR manager, along with a phone call for a verbal complaint, left and got stress leave for the rest of the week (me and my bub were fine). The next week, the manager is grovelling apologies and suddenly willing to "accommodate your needs" - I'd been asking to stop taking on new clients so i could finish my current ones for weeks as it was coming up to October, and I went on maternity leave in the January (right after Christmas shutdown). He now has a failing counselling practice after he left cause he didn't get what he wanted from higher up, has been banned from engaging with my organisation, and I have a new, respectful manager, and a healthy bub.

"Hey, I need to take my two weeks of vacation time". "Oh, we're too busy for you to take time off for vacation." End of year three: "Hey I need to take my accumulated three weeks of vacation. "Three weeks?" "Yeah, the two weeks we were 'too busy' for me to take off, along with this year's vacation" "Oh, those two weeks you didn't take are GONE, buddy." "I hereby give you two weeks notice that I quit."

I have seen this in action. Colleagues holiday requests were being declined, as too many people were off - surprise in school holidays. One year as the holiday list was being sent around I stuck the Staff Handbook page on top which said you may choose your first two weeks between 1 May and 30 September. So lots did. When the management objected everyone said it’s in the Staff Handbook. They had to back down.

@citypavement I always plan for vacations on my team: we review your plan for how your responsibilities will be covered while you're out - who is doing which task while you're out, or which tasks will have to wait for you to get back. I validate that your list works, and we go over any "ad hoc" things where you are THE person to answer it are NOT going to get answered while you're out. And hopefully you've told your usual "customers" about your absence so they know they can't ask for it in that time span. Yes, needs may come up, and so I ask for a way to reach you while you're out (fyi, I have *never* called someone while they are out - I tell people it better be an actual emergency or I'm not calling, and they know I mean it). So that's one way you handle things responsibly, make sure you've got things covered, but making sure you WILL get a complete break when you want to be out. And nobody gets to say "but I NEED thar report!"

Man if I hadn’t used my leave in three years my manager would be basically forcing me to go on holiday. The more leave balance you have the more your employer has to pay you out if you leave. In any case not possible where I work, we have a mandatory shut down period and even those that have to work during that time are given their two weeks at another time. That’s two out of the five weeks leave a year we’re entitled to

this reminds me if when i had SURGERY booked for MONTHS and my old boss at my old cadetship job kept trying to book meetings with me that day and the rest day after it.... under the guise of "oh i keep forgetting that you have that because you're just ALWAYS here 😊!" like ok. you'll remember someone else's dental surgery and give them the WEEK off.... but the minute i have a colonoscopy booked for 3 months it's "whoops sorry. but can't you PLEASE just come in anyway, on the day.... to show your trustworthiness to the team bc you barely ever book leave???" absolutely the f*** not, thanks. leave me alone. also the time when i had leave booked the day after a concert (because i stayed overnight in a hotel in sydney)... but the minute work started i got called by this boss like "where are you???? there's no leave in your calendar that you've invited me to." on my end, though, when i got home to my work laptop, there WAS leave booked in my outlook calendar..... that she kept saying to me that it wasn't there..... but "take the day off anyway then, i guess. if you must 🙄". it turned out the next day when i went into work, that she'd called me bc they literally only had 3 people left in the back office (as per usual). everyone else was either doing fieldwork or sick or on their own late christmas break leave. so then i got the blame for "not arranging phone coverage well enough" and "not inviting me to your leave request" when it was literally in my goddamned calendar.... and they should've been able to cover my ONE DAY ABSENCE for me anyway, imo. so glad i left a place that couldn't manage for ish. not my problem that you apparently can't manage one day without your trainee on the damned phone, which i wasn't even meant to be doing 5 days a week by the end of that program. y'all need to get your ish together.
