In this video, we discuss intestate succession. In this succession process, the entire inheritance is given to the compulsory heirs at hundred percent, and no free portion is available for non-compulsory heirs unlike in the testamentary succession. Though there are a lot of similarities between the testamentary and intestate succession, there are also some noticeable differences among them.

Thank you for sharing your expertise for free. You explained the subject eloquently but in very clear and understandable terms. All over the country, professors of law should follow your teaching style. I say this because most law professors I'd been under are more confusing than clarificatory. Some even use the classroom as a podium to assert coercive authority instead of assuming an enlightening presence. God bless po and more videos.

I haven’t been taught or came across this law. I am an illegitimate child but never inherited a penny from my father, 1999 when he died. My half brother (father’s legitimate son) had registered me in 2007 as his sister before he died but his surviving sisters, wife and children havent told me of any share; not that I need it, it’s a matter of finding out how honest are some people whether they are educated or pheasants it’s a matter of conscience and dignity! Its interesting to learn from your video, thanks a lot, looking forward for more videos!

MY QUESTION IS WHO HAS THE PRIORITY IN ADMINISTERING THE ESTATE INTESTATE.. which of the surviving. children of the decedents have priority.. BOTH PARENTS HAVE PASSED AS WELL AS THE OLDEST OF FOUR (4) children..

Hello my father's elder brother died and his wife died many yr back no son and daughter . My father and my grandmother and grandfather also expired . Now the jamabandi shows property in name of my father's elder brother, my father's 2 younger brother and 1 part of my father is in name of me (son) , my sister and my mother . And there are 4 sisters of my father who all are married and their is no mention of their name in jamabandi . Then who is the heir of my father's elder brother property.

pano po kaya yung joint or account sa bank.sinabi kc s terms and condition ng bank na ung naiwang account ay mapupunta sa existing account holder..pero dahil mandatory requirements pa rin ang ejs para mabayaran ang estate tax ay sinasabi pa rin ni bank na nka depende cla sa terms and condition na binabanggit sa joint or account/survivorship agreement at walang magagawa ang ejs para mapunta sa heirs yung share ng estate.ano po ba ang tama dto?

The land was owned by our grandparents but the Eldest Son titled it in his name when the family discovered his deed . He promised to recoveyed it to his mother, until the death of his mother there was no reconveyance but it was discovered recently because they concealled it while the other heirs is still alive , after the death of several heirs it was discovered by the only surviving heirs that he reconveyed it to another siblings now that it was discovered they filed cases but it was dismissed due to lack of jurisdiction , the 2nd siblings divided it to his children without giving the heirs of the 4 heirs . How can the other heirs have their share?

If there's a will, the estate will be divided half will go to the illegitimate children, and half will be the free portion. If there's no will, the entire estate will be shared equally by the illegitimate children.

If yung parents po ng asawa nyo po ay may last will and testament, kung ano po yung nakasaad dun sa last will and testament yun po ang magiging basehan. Pero pag wala po, hati po sila magkapatid po. Kung magkano ang value ng mga properties na naiwan ng parents divided by them equally.

Ikaw as wife at father or mother lang puede magmana ng property ng iyong husband kung wala kayong anak. Kung patay na pareho parents nya then 100% syo, walang legitime ang brother/ sister nya.

Should brothers and sisters or their children survive with the widow or widower, the latter shall be entitled to one-half of the inheritance and the brothers and sisters or their children to the other half.
