the trademark was transfered into a Irrevocable trust from the creator/settlor transfered into the trust

Is a trademark be counted as real property if someone THAT KNOWS the trademark because they got a cease and desist and used it in commerce and as a result the company that STOLE the tm and benefit profit and you can prove it with a purchase of services via invoice that shows that rhe registered owner has suffered loss now can prove ACTUAL DAMAGES im in Australia, and the tm is Registered and the company that benefited from the Registered tm and they KNEW it was Registered through a cease and desist would this work?

@@princessruth9155 i found out how to sort it in Australia, Australia Constitution 1901 sect 51 (xxxi) is the go they used personal property IP that has a owner attached to the thing, the criminals that took the tm for public use BUT didnt PAY just Compensation FOR the Property (Intellectual Property) also the TM is in a irrevocable trust with a pour-over will and choice of law the cook islands the trust has a arbitration clause as well in U.S.A is the 5th amendment Property Rights AND title 15 USC 1117 and Allan v Cooper is a IP case law my discovery is like no other as it gives me power to pierce through their corporate veil, even the 11th amendment has no power to protect municipal government BECAUSE they ARE Criminals this is what i learnt in 8 months since i first saw this video
