TRESPASS or ACCEPTABLE Foot Crossing Use? LOCO WORKINGS at Water Orton with D1015 & 69009 24/06/24

The spotters using the foot cross between Water Orton and Coleshill Parkway got the attention of a few drivers today with the use of their horns - Is this acceptable use of a foot crossing? Put what you think in the comments section..
See a mix of loco workings passing through Water Orton including 69009 and D1015 returning back to Kidderminster SVR from the weekends gala activities at Keighley & Worth Valley Railway.

Hello, Speaking as a former Train Driver I find the utter crass stupidity of those numb-nuts on the foot crossing totally unacceptable. The footage needs to be urgently passed on to the BTP before one of them gets killed and a Driver gets traumatised. They need to be made to understand that they DO NOT pratt about on or near the railway lines! 😡

That behaviour can spoil it for everyone else. Camera+tripod just inside the fence line is one thing. People should be off the Permanent Way and behind the fence when trains pass.

It’s a public right-of-way, so as long as they stay on it it’s not trespassing. But it’s still a safety hazard

A crossing is not to stay or stand, is to CROSS when its safe to do as the name suggests. Hope it helps.

What on earth are those clowns doing. They are putting themselves and passengers in danger not to mention train crew. They are giving trainspotting a bad name. Keep off the permanent way!!!

Foot crossing is to CROSS not to stand, and the latter is the issue.

OK, anyone who follows my channel will know im a regular at all Water Orton locations and also am ex BR with track awareness. I was also there myself for an hour filming while awaiting the LE's but you dont see me in your video because i dont wander around on the crossing but remain in a place of safety. When I arrived, these two 'photographers' where on the fast line footbridge. They came over to me and were indeed wandering around as seen in video which was indeed unecessary. Please note, although i was there (check out my last upload) you never saw THREE people trackside. I never cause drivers any concern and we always have a friendly wave and/or a toot. Im placing this fact on record as i dont wish to be associated with this behaviour. It might be of some irony to note that the one in white hat is a retired former DB driver and both were on a day visit from the North and thankfully not regulars in this area. Water Orton is naturally a popular location for many of us and long may it be so for those of us who don't look for bad publicity or to cause concern to drivers. Some who are known personally are quite happy to see us enjoying our interest.... hopefully they appreciate we are not all as irresponsible. Regards, Brian.👍

I agree with this, while I may not be in the water orton area, i always make sure I am a safe distance away from the track while filming at crossings

@@Transportationspotting Thankyou, it has to be admitted that although we are all 'guilty' of using these crossings we are actually trespassing. They are as others have said for the purpose of crossing the tracks in a safe manner to maintain a public right of way. We have to accept we have no right to remain between the boundaries. The BTP/NR & Drivers however appreciate we are in the main causing no harm and can often inform them of any criminal or anti social behaviour which I've also done in the past (emergency numbers should be in our phones). Sadly, its where large groups of us gather that causes concern for drivers. I prefer to be anti social and on my own but there's far too many of us to expect that. Anyway, thanks for highlighting this and let's hope it hits home.

Foot crossings are just that for crossing the line on a public right of way. They are not for hanging around on. Any filming should be confind to the public side of the fence. This behaviour could result in the closure of the crossing causing inconvenience to those with a legitimate reason to use the footpath

Definately trespass/misuse of foot crossing. Nice shot of loco move to Kiddy. Water Orton is still a great place for freight. I wish Network Rail would stop vegetation growing out of masonary. Nice O.B. As time allows will be watching it and others in full on my big screen T.V:

30 years + in the railway industry as a front line worker tells me these 2 are definitely 💯% trespassers - i'd even go further and say they could be flagged as potential suicide risks. They should have been flagged to either Network Rail or the local British Transport Police

Trespass. In an age where people are getting more stupid, this is becoming more of a problem. Makes me really angry, they have no thoughts whatsoever for the drivers or the people that clean up after such unfortunate accidents.

That is not true. People with a true interest in the railways take safety as a true matter. Unfortunatly a considerable number os "wannabes" class themselves as true enthusiasts when they have no idea what is that about for pure ignorance of the rules. That is sad.

I don’t think it’s strictly trespass as it’s part of a public right of way however it is dangerous behaviour given the proximity to the line and the continuous walking out onto the line etc so misuse for sure

the fact they kept walking back and forth across the active lines is not good, we used to have foot crossings near portobello junction (Wolverhampton) and it was where me and my mate used to spot trains, we used to sit on the fence and not move back and forth you think adults would know better then I did aged 12

I would sincerely hope that someone has used GSM-R to warn signallers and maybe get them some attention , seriously that is unfair to working crews and the travelling public.🤬🤬

This is worrying and stupid behaviour. I have no problem with people who have such hobbies but safety must come first. Stay off the permanent way and stay safe, with such a great zoom and camera they have there is no need to put themselves in such danger or encourage others to do the same. It is these actions that will get these crossings closed for use. Drivers have to report these incidents to the signaller so it will get noted and logged. There is a reason people have to have personal track safety and wear high vis... people get misted.

They are inside the boundary fence and what is on known as “on or near the lone” - I’d hazard a guess as not for the purpose of work etc so that’s trespass. This is the problem with some elements of the community where they believe they can go wherever they want whenever they want with a disregard for their safety and then moan about it when they get told off or injured etc. just don’t do it in the first place

In my opinion, it is fine but it should be done so you are away from the permanent way when a train passes, like stand and record by all means but stand back a bit from the track (to a safe distance for the speed of the train) when you do. I would count what they are doing here as dangerous trespassing though

If your going to get a shot from the crossing stand in a area of safety which is well away from the track, dangerous behaviour seen in this video where the man in the black T shirt is standing in the middle of the crossing most likely checking RealTime Trains.

It’s a crossing for pedestrians, if it wasn’t safe presumably it wouldn’t be there, looking at the vid their appears to be good sighting distance in both directions. Perfectly safe if used properly.

I am leaning towards Trespass, but what if they had high vis clothing and raised an arm to acknowledge the driver? Would that be classed as acceptable? Be gentle I have just taken up steam train spotting in my retirement.

How many times did your video show them filming one train on the far line with their back to traffic that could have been approaching on the near line? With the sound of the passing train would they have heard a warning? There's a reason why the gate line at these crossings denotes what is and isn't the place of safety. I'd like to think drivers were reporting the presence inside the railway boundary as their train passed to the signaller. Text 61016 from yourself would be an option for future reference - 'if something doesn't look right - SiSiSo'd.

@@nickedwards2904it is a crossing that allows the public to pass over private land, in this case very dangerous private land. It’s not an invitation to pull up a chair and have a picnic to photograph trains! Please explain what this is if not trespassing? To be inside the railway boundary fence and 3m or less from the line you need to have a personal track safety certificate, be wearing Hi Vis and no doubt a good reason to be there (ie Working). Just because it is a crossing does not make this area a public place to play. I hope the BTP were called.

I'm not sure how they could have been trespassing as a foot crosssing is in place. In any event, trespassing is a civil offence, in which the Police won't intervene. That said, the two people concerned are acting like idiots, so the BTP may with to investigate since they have jurisdiction over rail lines.

Definitely looking for a Darwin award! Looks like a footpath crossing so not trespass but if you were one of the drivers it's impossible to stop even if you wanted. You have your heart in your mouth and and probably look away to one side just in case the worst happens. They are probably spotters and so know the ropes but you blow for them and can only hope! Better education around railways maybe but all youngsters need to be aware of the dangers as in the case of an accident with several hundred tons of train they are the ones who will come off worst.

Not very sensible but it is presumably a public footpath. Are there any specific laws relating footpaths over railways? If Railtrack see it as a problem they should put in a bridge. Having said that railtrack have put in metal gates and platforms on one crossing that I use (earlswood lakes) where it used to just be boards to stop you tripping on the rails and there is no apparent gain. It has been done with modular 'scaffolding' and could maybe be extended to a bridge structure but for now is money wasted. If there were wheelchair access it would make sense but your have to climb up the embankment so there isn't.

If they are using the foot crossing to actually cross, and there is a public right of way, they are within the law. But just standing on the crossing like that, I think BTP could make a case for trespass. As others have said, clowns like these get the hobby a bad name.
