aggrieved person in Habeas Corpus mam please verify. how can it be possible for the person who is illegally imprisoned or detained to file this writ? thankyou
+Nishant Sinha For example you have been detained,then your lawyer will file a writ of habeas Corpus on your behalf.All the writs except for Quo warranto, can be sought by agrieved person.Because the nature of all other writs is personal.Whether transfer of case in Ceritoraari or prohibition,respite is for that individual case just like in Habeas corpus.And in Quo warranty legality of claim to a public office is enquired.which means all the people who can get impacted by that public office can file this writ.Hope it helps?Feel free to post further queries:)
+Nishant Sinha Welcome Nishant.in simple terms if your right has been encroached then only you have the right to go to the court for redressal. But Supreme Court in case of Public interest litigation ,removed this requirement of locus standi. For example if You see exploitation of a group of people,their fundamental rights being violated but they are not able to go to the court then even though you are not related to the case yet can file a PIL seeking redressal for them.Locus standi means right to partticipate (stand) in the court having sufficient connection and harm from the action for which they have gone to the court.Else court will reject the case saying it “lacks standing”.
