Hmmm, the tape doesn't actually name names. Evidence in a court case has to stand up to the defence arguments, even when it's bloody obvious on the face of it. A good lawyer could probably argue that tape away without more corroborating evidence. 'Beyond a reasonable doubt' doesn't mean 'It sure sounds like it'.
