Rico case or not, if it’s over state lines it becomes federal! Rico cases end up like that a lot because they watch for so long and they try to track where shits coming from and get as many people as they can! As far as I know! I burrowed in the system quite a bit! 5 years clean may 21st though! I got out!
No that is not how it works, It would still be state, if part of their gang was in another state or were moving dope state to state then they are either gna bring in multistate drug task force, the dea or the state will prosecute in state crimes. The feds dont "pick up" or "take over" state cases, they will assist in cases if asked. But, with rico you can have both a state and fed case on the exact same charges. The feds have a higher rate of conviction so they dont usually bring charges unless they have either an informant or an agent undercover in the organization they are going after.
The key that activates a federal rico IS A BODY. THE FEDS CANT TOUCH IT UNLESS THERES A BODY. YET THE STATES THAT HAS A RICO DONT HAVE THIS SAME PREREQUISITE
Feds can pick up state RICOs - usually usmnder the clause of crimes committed in another state - but, like Georgia - IF the state RICO guidelines are practically the same as Feds - and somehow folks piss off feds/feds tryna reach a quota/state wants a favor from feds or vice versa - Feds pick up the case.
