Actually, if a firearm is designed with the axis of the bore to the side or below the grip it would probably not be classified as a handgun/pistol.

Adam, have an AR with SBA3 brace , 11.5" barrel and OAL over 26". Is this a "Firearm" and therefore the addition of vertical foregrip does not require a Tax Stamp?

No stock for shoulderablity, barrel under 16" in length, and overall length under 26". It's a pistol. If the device does not have a stock for firing from the shoulder. And has an overall length of 26" or more it is defined as a firearm. And you can mount a vertical grip. Add a shoulder stock to either combination and it is an SBR

very informative even after pouring over all the rules in my pistol build its nice to go back and look over it all again. on a side note that thordsen customs cheek rest is lovely for getting a good look down the sights while not actually placing it to your shoulder. I've got nothing but love for it.

My new question is about placing an upper receiver with a 16” barrel on my AR pistol. If I don’t replace the stabilizing brace with a stock, can I continue to action the pistol as a pistol, so long as it never touches my shoulder? I’m looking to backpack a longer barrel with the AR pistol and it would be nice to know if it’s legal to skip a step by not changing out the stock if the situation calls for it.

I understand if it's a serialized lower it can be made into a rifle or pistol as long as it was never been put together. What about so called "ghost gun"/80% lowers, what's to stop someone from making that lower from a rifle to a pistol and vice versa? Awesome work by the way! keep it coming!

How would I go about finding out if my lower receiver was started as a rifle? I purchased a stripped lower receiver off of gunbroker and was going to build it into a rifle configuration. The info I just heard from this video leads me to believe I can build it out as a pistol and I've been leaning more towards doing a pistol build recently. I realize this is a older video but I will be extremely happy if I get a response from someone noteworthy! Thanks!

I'm a bit confused about the Arizona laws,so to buy a handgun you have to be 21 but you can buy any other gun at 18,so would Arizona specifically consider an AR pistol a handgun or no?? I've been looking up & reading on it for a few days now & I haven't gotten any clear answers,I'm 20 & I'm planning on buying 2 AR-15 Pistols but I don't want to order then get to the FFL & get told "Sorry,your not 21"

I am going for a sub-machine gun style build. I am thinking about a 10.5" barrel with a brace and front vertical grip. As long as the overall length is at least 26", I think it will be legal. Thanks for the video!

And obviously the forgotten the coat single action Army‘s that come with a 36 inch barrel and other revolvers that come with attachments and forward grips well as Bear bone stock attachment and they also make revolvers that you can remove the barrel and change

It's still confusing some to me on the 26" part.. The only thing I know is anything below a 16" barrel you can't use a vertical grip or stock unless you pay money to ATF and wait months to make it an SBR (Short Barrel Rifle), then you can use a vertical grip and Stock..

Is the Hera CQR a vertical grip or AFG? Also.... does a foregrip that is not 90 degrees to the bore disqualify it from being defined as a vertical grip even though you can fully grip it with your hand?

I have the same question. The ATF does not seem to have a classification for what I would call "Long Barrel Pistols" or lowers that were build as pistols and then formatted with an upper that had a barrel of 16" or greater and a longer total length of 26" that was never designed to be shouldered. Anyone have any guidance here?

I know logic and gun laws in the same sentence is asking for trouble, but you said that a pistol is designed to be fired from one hand. by that definition and the logic of the pistol brace letters am I "redesigning" my 1911 into an AOW every time I get a proper two handed grip?

Speaking of marking the receiver...if you are building an AR from a virgin lower, and it's marked as a 5.56 lower, must you build the rifle as a 5.56 or can you slap a 6.8 SPC upper on it. Will it still be a legal rifle according to the ATF?

Thanks Adam. Unfortunately, Kalifornia has tightened the noise on this one. An AR lower is, under Kalifornia law, registered as a rifle. The only way to get an AR pistol used to be to: 1) buy one, or 2) build one from an 80% lower. In both cases, it had to have begun life as a single shot firearm. That loophole (single shot exemption) was closed in 2015. So, no new AR pistols here.

So I’m building an at pistol, but for certain legal reasons here in Michigan I need to know if OAL of the pistol includes the pistol brace extended (I have a sba3 and is extendable). I know rifles are measured with the but stock extended but I don’t know if that method goes for pistols as well.

I thought the pistol has to be under 26" to classify as such. If it's over 26" it's classified as a "firearm". But a majority of AR pistols I see are well over 26" but are called a pistol so...I'm confused.

It's a firearm, NOT a pistol if it's over 26".. no matter what it's being "advertised" as. Maybe vendors are using the pistol reference as a pistol has all the perks of a pistol in the legal sense (IE can be carried concealed, loaded, carried in a car loaded.)... and a "Firearm" cannot be legally concealed.

WeAreNotAlone69 -I’m not a legal expert but as I understand the law, it’s not considered a “firearm” unless you do install a vertical fore grip on a pistol that is over 26”. I could be wrong but it’s something to look into.

My understanding i:s: Under 26 is considered concealable =Category Pistol . AFG ok. Over 26 is not considered to be concealable so it becomes a Firearm, and you have the OPTION to install VFG, but regardless if VFG is installed or not it's a Firearm... Difference between Pistol and Firearm category is you lose *Pistol Perks of being carried concealed, carried in Or left in vehicle in a LOADED state. (*In Non-Communist, Non-Socialist, Pro 2nd Amendment States / Areas .) .

WeAreNotAlone69 - Yes, agreed about the perks and the the over 26” with the added vertical grip is no longer a pistol with said perks. However, over 26” without a vertical fore grip reads as a pistol still and like you said, in free states anyway, enjoys the liberties as well as rules of all pistol laws. This is just friendly debate of ATF mumbo jumbo anyway but they just aren’t practical to conceal. The value of remaining a pistol at all costs is worth it in my opinion. I think we and many others agree on that anyway. :) Leave em as pistols. That vertical grip is just extra garbage in the way on a short gun anyway. 👍

I'm sorry if I missed it but I didn't hear anything about maximum length for AR pistols, say if your OAL is longer than 26'' or if you put a 14.5'' upper or even a 16'' upper on a pistol lower would that make it an AOW without having a VG?

I see a lot of AR rifle, pistol info but what about this? A Ruger charger pistol in a APG folding rifle stock [ as I know it ] with side folding buttstock. O.A.L. is 26.25" or so unfolded with a 10" barrel and 11.5" LOP. Is it legal in general even though it has buttstock vs a brace? Would a slightly shorter barrel to get my OAL under 26" make it legal if not? Asking for a friend : ]

Pistol = Below 26" in OAL, AFG permissible. Concealed carry, in loaded state. Can carry in your car, loaded. Over 26" =Classification changes to FIREARM... you can install AFG, or VFG Cannot be carried concealed, loaded. Rifle= Barrel 16" and greater, and there is a min OAL as well can install a proper buttstock + VFG /AFG... Most states cannot be in car loaded.

I have a question, is it legal to own an ar 15 rifle and pistol at the same time? I have heard that it is frowned upon because if you have an ar 15 rifle and pistol at the same time you have the ability to make a sbr without having a tax stamp.

It's an other because if you look at the options for what a licensee can select they are limited to: Handgun, Long guns (rifles or shotguns), and Other Firearm (Frame, Receiver, Etc.) In the instance where a licensee marks either handgun or long gun and they transfer you a stripped receiver, they are wrong. There is a common misconception that is running around with licensees that depending upon what the person who is buying it intends to build, that is what it is marked as. That is NOT correct. -Adam

in california there is a handgun roster....if it is not listed there it can not be used to build a pistol....so for california its not true you can just use any lower

So I can build an SBR w/ a hand stop and pistol brace…and that no longer qualifies it as an SBR and is therefore not subject to registration under NFA laws, right?

No. That's a felony. You can build a pistol with a hand stop and pistol brace and then turn it into a rifle (with a stock & 16" barrel) and back into a pistol again, as long as the first build was a pistol. But you can't turn a rifle into a pistol if its originally a rifle. An SBR is a rifle. So that's illegal. Not to mention, you need a tax stamp to build an SBR regardless. As free citizens, we are limited to rifle or pistol without having to get permission. SBR is something you need permission for.

I also wanna know how my pistol permit effects a "firearm" because if I can put a vfg on a 12.5 (not sure if that's true) and it then goes from pistol to firearm what does that mean for me when I carry it in my car?

Going over 26" changes the classification from Pistol to "FIREARM, which means a VFG can be attached.. , but you lose pistol status. Impression I get for a FIREARM is it can't be carried on your person or in your vehicle loaded, and you are NOT allowed to conceal it like you are allowed to do with a pistol.

Question regarding 80% lowers. If you make your 80% lower into ar pistol, being unregulated, do the possession laws still apply?

Can we get an attempt to clarify the new California "Assault Weapons" registration in how it deals with the bullet button. It says that once registered with the bullet button it cannot be removed unless it is converted to featureless and deregistered. Could an AR-15 have a standard mag release installed before registering?

So you can have have 11.5 or 12.5 inch barrel you can put a for grip on it ?

Ok,so my 10.5 in AR build(I constructed it from a stripped lower) has an overall length of 26.5 in so the fact that’s it’s over 26in and that it started life as a “firearm” should make me ok for a vertical grip BUT that’s INCLUDING my A2 birdcage..do I have to get it pinned and welded for that cage to count in my “overall length” or does it count just screwed on? It’s important b/c w/o the cage is under 26 thanks in advance,love this channel
