That's because if a rifle has a barrel shorter than 16" it automatically can increase your K/D ratio by 1300% and is classed as a super ghost gun killing machine designed by the Nazis. Read up before making such an ignorant post, moron.
imagine if you had to do this level of paperwork to vote, or to hire a lawyer, or publish an article on politics? i still dont understand why this is constitutional. can we place a tax on a fair trial? how about hiring a lawyer? or a "poll tax" on voting?
The NFA IS an infringement of our 2nd Amendment....by definition. It Infringes one of our Guaranteed Rights in the Constitution, making us Pay the Federal government $200 per item and 'Hope they let us' purchase this firearm or part? B.S. The problem is WE ALLOW IT. We foolishly follow any law they put forth.....because we've lost the Balls to stand up 'TOGETHER' and say No. If 10,50 or 100 million of us got together and publicly stated we will no longer acknowledge this unlawful firearms act, AND.....(AND) we completely stood behind each other as they tried to arrest some as examples.... They could not arrest us all, and THAT level of public push back changes things quickly !
@@Alan-in-Bama Agreed, people are more concerned with paying their rent. People amaze me when you tell them some seriously egregious story you've heard on the news or something. You give them a short run down of WHY it is such a bad thing and they give you THAT LOOK... You know, that look they give you when they basically say " There's nothing I can do about it, besides I'm dead on the inside already" lol
As some one who just had to fill out several emergency form 20s for traveling across state lines with NFA items due to Irma, could you do something like this video covering traveling with NFA items, how to fill out the form 20, and generic language to use?
We need to do away with the1934 Falstead act Under FDR,.the 1968 Gun control act, under LBJ. When Miller was KIA, in a Gun Battle with the Feds, oh how convenient that was, not to show up In Pearson to defend his Suit against the US on SB Shotgun and ever since this Burden is upon us TAX payers.
Thank you so much for providing clear and concise instructions on something like this. I am sure filling out a Form 1 is a cakewalk for many, but everyone started off with no experience. Its efforts like this that truly help the community. Thank you very much Adam! BTW, you should have my vote in your office by now. Good luck in 2018!
For a suppressor I have a few questions. What do you put for the manufacture name and address if you are building? What do you put as the serial number. Also what all has to be engraved once you are approved and finish building?
@@CarsFitnessMoney to do this youd have to initially purchase the buffer tube because being in posession of a stock than can be readily installed is as illegal as per ATF letters
If you plan on having the suppressor able to be removed, then yes... (2) tax stamps ($200/ea), if youre going to fusion weld the suppressor to the barrel of a SBR; you can use the additional barrel length of the suppressor to overcome the need to call something a SBR & would just be (1) tax stamp instead
If the suppressor is permanently attached to the barrel and the total length from the face of the closed bolt to muzzle end is greater than 16" then it would just be a silencer. If it is not permanently attached or if the total length is less than 16" it would be a silencer and a short barrel rifle.
Hey, thanks for the vid; it was very helpful.. Mind clarifying something for me please? I was under the impression that you cannot (legally) complete the build of a SBR (attach upper to lower) prior to approval of your tax stamp/Form1. If that's the case, how do you accurately get the OAL?
I like The Legal Brief more than TGC News, mainly because every episode of TGC News is mostly full of content I've already been discussing ad nauseum on social media. I'm still a fan, I just "get more" from The Legal Brief because it is usually an informative topic that most don't research extensively for themselves.
GeauxRussGeaux I have to disagree. At least until there is a rediculous amount of emphasis on "crush". Enough to make people wonder if there's something wrong with Adam.
Winston Churchill said that "the destiny of man is not measured by material computation. When great forces are on the move in the world, we learn we are spirits-not animals." And he said, "There is something going on in time and space, and beyond time and space, which, whether we like it or not, spells duty."
That's it!? That's all you have to do to buy an Extra Deadly Weapon!? Fill out a form so arcane it requires direction from an attorney, informs federal and local law enforcement of your activities, and exposes you to potential felony charges with every wrong answer!? THIS IS ANARCHY!!!
Great work as always. One quick question. Is there any legal burden of proof necessary for the CLEO notification? Worth sending it certified to the county CLEO?
Sean Wolff this is a great question, I have always given mine in person, the first time they had no clue what to do, I wouldn't be surprised if it was thrown away. That is also why I had the person at the desk sign a slip stated it was received.
Ok, I never comment but you earned it. I am university professor and also have a RU-vid Channel and business and I have to say well done. A LOT of educators could learn a few things from your presentation. I am looking at getting a SBR and had questions on the from. OUTSTANDING work gentlemen! Thanks Respectfully, Beyond Seclusion
All of this time, hassle, and money just to slap a stock or vertical grip onto a Scorpion pistol. "Common sense" gun laws folks. I'm thinking about moving to MO where they just outlawed all federal gun laws. I'm sure this law would still apply, but it's not like anyone would enforce it.
Since NFA items use your mailing address for engraving purposes, what happens if you move or have to change address? Do you have to get your firearm engraved again?
I found this video educational, and unfortunately useless as I live in "The Democratic People's Republic of California" where men are not free. We fight as the resistance to the evil in Sacrademento.
Steve Endweiss yes and no any weapon with a barrel less then 18 inches long that chambers a shot gun shell even if rifled is considered a "Sawed-off Shotgun" (This is why I had to sell my 10" Thompson Contender barrel in .45/410 out of state) so AOWs that chamber a shotgun shell are unlawful to own. Besides the video was about filling out a form one, you would have to make an AOW from scratch to need to be filling this out. And since you have to have the tax stamp before you do it it steps into a legal minefield most of us want to avoid.
We should form a petition to REPEAL THE FOLLOWING. The NFA of 1934 the 1986 Ban the 1968 Ban push for the UNITED STATES CARRY ACT. To allow you to carry a loaded firearm anywhere in AMERICA without fear of being arrested.
I currently have a trust with a few NFA items in it, but that was before the ATF changes. Now, it seems the trust just makes it more difficult. The next NFA item for me will be as an individual... unless we can get some of these rediculous laws changed! REPEAL THE NFA!!
Hey where is the box you check for Californians to NFA a firearm? Oh wait, you mean a law abiding citizen cannot own an NFA firearm in this state? SEEMS FUCKING LEGIT, fuck!! Hate it here sometimes...
4:20 can your reason be for silencing the sound of farts? Also is a fart muffler legally considered a silencer. The muffler on a car doesn't need a form 1 so I imagine a fart muffler wouldn't either. I think this might be a highly useful legal loophole.
As for the CLEO notification, can anyone clarify how we notify them? Do I just need to mail my CLEO a copy of the form 1 or does it need to be hand delivered? Do they need fingerprint cards also?
Adam, I was wearing the same shirt today. I think you should add an "Expert Tip" for those with their 80% completed. "Manufactured by "ME" Made in the Republic of Texas". (Because God Bless Texas) Would they accept a non-existent place for manufacture? If you need a separate notification to the BATFE for a second caliber, can you submit that with the Form 1? How many signatures have you gotten for the NRA BoD?
Still cloudy on a couple of things. What if we are building an SBR? Do we wait until its built to get final measurements? What is this garbage about our name and address being engraved?
The question of caliber on suppressors keep coming up. Remember that you are registering the suppressor, not the gun(s) you might use it on. Use the caliber of the suppressor, check with the manufacturer to be most accurate. If you made it yourself, use the diameter of the exit hole or of the largest round you can safely fire thru it.
Hi! Great info! Question on Box 4b. It said see definition 2.K. I looked on the back of the forms that had definitions, and could not find 2.K. So, in 4.b, do we spell it out (Short Barreled Rifle), or just SBR? Can you clarify this? Thanks!
So.......correct me if I am wrong, but, to fill the form out accurately with overall length, serial number, etc, i need all parts to make my SBR, but, I cant legally make it without the NFA Stamp?
a lil out in the woods but... #1 Do SBR's not require any additional serializing? (I ask since Im planning on SBR'ing a Kriss vector & theres not really any real estate for this above & beyond whats already in place) #2 What does the typical schema of serials look like as an individual as opposed a trust, or an LLC that does NOT have an FFL?
Yea I’m trying to form 1 thru efile and it’s automatically choosing tax exempt for me and I know I am not tax exempt. I keep trying to change and it won’t let me click it. Any suggestions???? I’m useless in the tech world
Am I the only one who thinks it is hilarious that they have a check box for aliens on the NFA form? In both ways that could be considered humorous. BTW what a pain in the a** I am actually fine with the process except for the fingerprints... and to a lesser extent, the photo. Same reason I wont get a concealed license in my state, they require fingerprints and I can't say I care too much for being treated like a criminal before committing a crime so when I carry I open carry. If I got fingerprinted, with my luck, I would walk into a gas station and buy a pack of bubble gum and some drinks and go about my business... Guy that holds the door open for me on my way out goes in the joint and shoots the guy at the counter. Cops come in and dust for prints... next thing you know you are getting a knock on the door. A million dollars in legal fees later you MIGHT be off the hook if you are lucky.
the only way to beat it is to look at the clauses and what was written originally for the NFA act. I think as far as Iam concerned. I dont think the law written for the NFA act was properly written and suppressors was simply "stealthily shoehorned in" into the NFA without any legal reasoning. And as of course. Poses no risk or danger. Its operation and existence is far more beneficial if deregulated as compared to restricted. Also I think commerce and as well as laws regarding trading related to warranties might be a good argument. I dont know exactly how well the process works for a product that is restricted and the warranty of said item because defective items do exist and what if you are not the original owner? What if the product is well used past its expiration date and suppressors are perishable unless its a very expensive, robust suppressor, the can itself (the serialized part) can eventually have the walls fracture and crack causing it to fail and no longer work as intended. How does it get fixed? More than likely the "can" part needs to be replaced or the baffles must be replaced. What about the serial? does the company just reprint it? but wouldnt that be a duplicate? wouldn it break the law? You cant reuse a serial on a new part as far as Iam concerned because it was written that it must be "original parts" So you cannot replace an old part with the same serial. The military has recognized the importance of suppressors very recently and I think the ruling was in order to remove an item from the NFA list was that it must be applicable to military and hunting purposes and serve the proper function that is beneficial. Well the military recognizes the suppressor and hunting actually sees a benefit in terms of noise pollution and protects the hunter's ears Thats more than enough reason to delist a "muffler" from the list. Also the rules itself are antiquated and arbitrary since it is stated that its a suppressor if it is enclosed device with baffles and allows a bullet to pass thru the device. Well there is plenty of devices capable of doing that. Should we arrest every mechanic or anyone who works in the automotive industry?
What do i do if it is an AR i built? My lower is one of The Jack AR15 lower receivers made by Sharps bro. The upper is also made by sharps bros. So would that be the make and or manufacturer of the firearm? And do stripped lowers like the have serial numbers on them?
So the more I search on what I need to SBR my rifle, the more confusing this shit is, do I need a CLEO signature as an individual? where the hell do I get finger printed? fuck why cant they make this simple as fuck?
Ok so if I’m building an sbr starting with a stripped lower, do I need to buy the lower first so that I can fill out the serial number brand ect? If not then what do I do? Also if I haven’t bought all of the parts do I need to know my configuration of parts I will use so I know the overall length? If I buy the parts before getting my forum 1 back then I will technically be in possession of illegal items right? That’s the only parts that have been confusing me and keeping me from doing my sbr.
I don't understand why anyone would do this if you are building yourself a gun. That is the whole REASON of building your own gun, so as not to do this crap!
Don’t help for suppressors what do u fill out for that ? Especially if being built out of solvent trap do you mean you writethe serial number and model number of gun it’s going on ?? Wasn’t much help at all only helpful to those building a gun
Can someone help me. If filling as a trust why does the responsible party have to submit fingerprints and pictures but the person who created the trust does not? Or am I not understanding it correctly...
Here's a question, do you need a picture of your actual passport or a copy of a passport that you can amend on the document? That's what I am having trouble with.
So much for Shall not be Infringed, this is a lot of pointless bullshit to have a shorter rifle cause oh my god someone in a trench coat might conceal it!
This might be a dumb question but What if you recently moved but have no updated your address on your license? Would you have to update your license before filling the form out?
If the address changed while waiting for F1 approval, how do we update ATF of new address to then mark gun appropriately with correct city of manufacture?
