UN Members Sign Biopiracy Treaty: End to Bogus Western Patents? | Vantage with Palki Sharma
All 193 United Nations member states have signed a new treaty on intellectual property rights involving genetic resources. The law is designed to stop instances of biopiracy. Biopiracy is when an individual or firm tries to patent the ancestral knowledge of indigenous people, usually from the global south. There are numerous examples of the west patenting ways to process medicinal herbs or crops or animals, which were developed by communities in the global south centuries ago. The west tried to patent and exploit traditional ways to use turmeric, neem, the hoodia cactus, quinoa and countless other products. The new anti-biopiracy treaty mandates that all patents give credit to any traditional techniques that were used as inspiration.

I recently saw a news where some german or European researchers patented leaf based plates as a biodegradable replacement to plastic plates when Indians have been using leaf plats since thousands of years. I am glad this treaty came. Let's see how effective it will be in ending bogus western patents.

Vietnamese and Africans use leaves too. This particular leaf in my village is used for eating rice, it adds flavour to the traditional rice. And it is used for a lot of things.

@NidhiSinha4U Educate yourself. Fact: You can't patent a leaf. Plates created using leaf based fibers isn't a leaf plate. And the patent would only apply to the process used in fusing those fibers together in a specific manner. You could in fact create your own patent using a different process. Like everything else. You can't patent an internal combustion engine. You can patent a specific design or technic. Also note that patents are for 20 years from the date the patent is filed. So after 20 years, you can copy it. But people seldom do this. The money is always in the latest product. And this is true even if the old design is better then the new. So the real problem is peoples vanity.

Ayurveda without medical evidence and proof is complete garbage. Reading some old dusty book written in 100 BC is not medical evidence. It requires modern trial techniques and Double blind RCT. Ayurveda as it is practiced now is complete garbage and harmful.

Thank you for reporting on this injustice and its ending. No one else seemed to care. Another area of junk patents that India and other developing nations needs to challenge is in software. Such patents are used to stifle competition and the US in particular is aggressively pushing for their wider adoption.

A patent is important because if they were not there, big companies would just wait for small companies or start ups to invent something and they would steal the invention and start producing it at scale and so they would always be at an advantage. You can't patent a natural plant what people patent is a unique process for making the finished product like if I was making nails if I decided to forge them using a space laser I could likely patent it I'm not patenting the idea of a nail I'm patenting the process of using a giant laser in space to forge my nails on the surface of the planet. Now if they created a new variation of a plant they could likely patent it like companies do with GMO seeds.

There should be also a law for benefitting software developers which have created open source projects. These big tech giants use this free software and make billions and also remove jobs of those developers. Many masters students does research on new technologies for free many times so they can get a degree and these big companies uses these papers to benefit from them. I am from Brazil , every now and them foreign companies try to patent natural resources under the sheets (here we have a somewhat strong institutional opposition to this robbery, most of the times we can actually prevent them from happening); yet here is a list of things that were subject to patent attempts by foreign companies - just to show you the size of the bull shit: - açaí: world known berry , it was domesticated by natives hundreds of years ago - they don't charge us a thing. - cupuaçu fruit derivates: another fruit domesticated by natives from the cocoa fruit, locals have developed a way to turn it into chocolate; - copaíba and andiroba oil: natural oils from native trees with numberless cosmetic and health applications - these trees have been used by natives and other local people for centuries now; - boldo tea: very good for the digestive problems, a natural hangover killer that is cultivated in many home gardens; - guarana: another berry known by its stimulant properties - like coffee. It's been traded and prepared in various forms at least since early colonial times; - ayahuasca: psicoactive substance used in shamanic rituals , been used and developed by natives for millenia now;

The Indian Hindu Khumbars have these things already written within the many Hindu scriptures as part of an ongoing law system. This mean that the western law is not applicable as the greater sense belongs to the Indian Hindu Khumbars. This keeps the international market free and identifys the wannabe officials ( westerners ) as misusers of law that can longer present any form of command. As the world and universe is layered in Hinduism not English language. Many of the westerners should take a step back and think ethical grounds.
