What hurts most is the music in UTY is so good I saw it as an homage of sorts to og UT, hoping in some way they could help with Toby's future endeavors. Then this guy comes out of the broom closet to yap about the music

Toby is a Touhou fan. Of course he'll side with the fans. Fans make a series. You work for the fans, and for your love of the fandom. It's just that a lot of the fans are a bit toxic that Undertale gets its hate, otherwise it's a pretty well put together game.

Hell, maybe someday when I'm rich, I'll lobby for a retroactive change to copyright law allowing for more protections for fan works - anything that doesn't make money or profit of any kind is legally protected, and corporations can suck it. Also copyright only covers 30 years now.

im blind to the situation, but it seems sebastian promised to pay money directly to the dev team, toby paid it to " a charity of the dev teams choice". while generous, cant be used by the dev team and is a huge tax write off.
sebastian's promise was more of "yea ill do it when pigs fly" kind of statement, so he was never gonna pay it anyways uty is a fanwork so there should should never be direct monetary profit knowing toby's rep i highly doubt he donated purely for tax write off purposes

The funniest thing in all this for me was all the fans that paint sebastian as some evil person, or an evil version of tobyfox, like one of those baddly writen fanfics, those type of comments are so funny, people really have some imagination.
I don't know what any of this means or why this is in my recommendations, but this Toby Fox dude seems pretty chill. I love the sentiment of appreciating and supporting your fans.
I see people taking this as Sebastian is bad, but Toby's relayed message does say that Undertale Yellow didn't have permission till recently which implies there was a period of time Yellow did not have permission and were in the wrong. Had Sebastian acted reasonably Yellow may have faced consequences which could've impacted the entire community. It is a scary situation.
Not having explicit permission =/= not allowed to do so. Which I feel like was Toby's point that it's technically true what Sebastian said about UT Yellow not having explicit permission, but he generally has no problem letting people use his music as long as they don't make money off it. (It's just that unfortunately most people choose to make legal threats if people use their content in any way even if they're not obligated to do so. Which afaik is only actually an obligation in Japan to maintain IP ownership). But he took issue with the way Sebastian handled it, and the fact that he was speaking for Toby instead of letting Toby be the one to respond to what Undertale Yellow did or didn't use. Yes you could say we're doing the same in the comments section here. But we're not acting as if we're Toby's lawyer.

I mean, did the team ever show this "clearly defined permission"? If Materia Music owns the rights to Toby's music outright, then they can do whatever they want with it and let the whiners eat it. If Toby has signed the distribution rights to his music over, then he has no legal rights to tell Sebastian Wolff "no". Unless there is a clearly written stipulation in the contract that says "Toby has final say", then that's a breach of contract and grounds for a lawsuit. But, these are a lot of "what ifs" and "unknown unknowns" at the mo', so.
