Unfiled Tax Returns: Four things you MUST know

In this video, I'll be talking about the 4 things you need to know about filing back taxes with the IRS.
The first thing is that if you don't file your taxes, the IRS will do something called a "substitute for return." In IRS speak, we call this an SFR. With an SFR, the IRS tries to assume the worst tax bill you can imagine.
But an important thing to understand is that when you file a correct return to lower your SFR assessment, what that technically is, is something called an "audit reconsideration." The IRS does give a bit of extra scrutiny to the return processing, so it is important that the returns are done very carefully. When you file past due tax returns, your returns processing needs supervision. Either by you, if you are up for it, or a tax resolution professional.
The second thing is time. Did you know that if you don't file your taxes, the IRS has forever to assess taxes. For example, if you didn't file taxes in 1988, the IRS could, actually file your taxes with an SFR. Now if you do file your taxes, the IRS effectively only has 6 years since your filing date to assess you anything additional.
So what you need to know is, if you don't file your back taxes, you are leaving a potential tax bill open -- indefinitely.
The third thing is time again. If you have a refund coming to you for a tax return, you only have a limited amount of time to claim that refund when you file your return. The 3 year rule works like this:. You can not claim a refund for a tax return that was due more than 3 years ago. So right now it is June 2013. If you tried to claim a refund for 2010 and you never filed a extension. Guess what? If it is after April 15th 2013, if IRS owed you one million dollars they would keep it all. And there is not one thing you could do about it. Or I suppose there is one thing.
The fourth thing you need to know about unfiled tax returns is documents. You may be wondering, well I'd love to file all my old tax returns but I lost all my tax documents. Well, tax attorneys like ourselves have a couple tricks we use to file old tax returns properly. First, we can request any missing tax forms, like W-2s, 1099, mortgage interest statements, from the IRS. Second, if you are missing business records, there are proven, legal ways to recreate documents that will be accepted by the IRS during your "audit reconsideration."
So hopefully you get it now. If you have unfiled returns, act quickly. Don't let missing documents get in the way! All of that can be dealt with totally legally with no problems down the road. Remember, when it comes to unfiled tax returns, the IRS rules are written to favor the IRS. So do yourself the biggest favor you could possibly do today and take action. Great question. Going to pin this comment. As it is often the obvious next question of so many people looking to get unfiled returns filed. You can contact the IRS to get something called a Wage & Income transcript for the tax year in question. Then file accordingly. If there is state withholding, that is information the IRS will not have. You can go here and request that transcript yourself. www.irs.gov/individuals/get-transcript Even if no one paid your withholding you are still entitled to act as if it was fully paid. Good luck!

the IRS could assess tax for you? Last I read, in the code, the secretary of treasury is supposed to be the one notifying a person of due tax, not the IRS. Also, it has been proven through a copy of the IRS Certificate of Incorporation that the IRS is actually a private business, not a branch of government as we have been told. AND title 26 USC has no positive law. So tell us how they do what they do and get by with their tale of taxation? Because people allow it to happen. Research shows in congressional record going back to the intent of the 16th amendment, that taxation is for corporate and federal officers and employees. Not the American citizen. They're crooks plain and simple.

Actually the research and documentation shows that the 16th, 14th and 17th amendments were NEVER properly ratified, by the required number of states, which ones didn't is irrelevant, and it is just "another" issue, not a bigger one. Your problem is that you are complicit in the fraudulent deception that is believed to be the "supreme law of the land" but isn't and hasn't been since 1939, when common "law and equity" was essentially removed and replaced by the USC ( statutory jurisdiction ) and then further distanced by adoption of the UCC which assumes voluntary jurisdictional submission, without a specific reservation of rights having been asserted in a timely manner, and bars its assertion anytime thereafter. Since this fraudulent deception has been in place since 1939, the methods have been consistently improved by the IRS and so called Tax Court and with the help of "facilitators" like yourself, who participate in the yearly fear fest which begins in january of every year. As a result, many of the arguments "raised" .....and heard by this court, and which have "failed" for any number of reasons......were over time added to a list of so called frivolous arguments, which are then dismissed out of hand as "frivolous". The primary reason for these determinations is the effect of ( statutory jurisdiction) which if entered into "voluntarily", precludes the use of court decisions made prior to 1939. One of the effects of this fraudulent deception, however, is that since the removal of "law and equity" was not done by amending the constitution as required by article five......a means had to be made available to access common law and equity jurisdiction......so the deception here, was to obscure the means required to do so by burying as deep as possible within USC and UCC, as well as obfuscating the language, rendering it unintelligible to ordinary people, and even those "educated" in the law, since this knowledge was not "need to know" for attorneys, as they are barred from using it, both as "officers of the court" and further co-opted by admission to the "bar", upon which their privilege of "practicing it" relies. J GALT I'm not in any way tax law competent, but I do agree with your comments. I believe the IRS and taxation on labor is illegal. I believe most tax specialists are only educated in how to collect and obey these fraudulent "laws." they for the most part never study the actual validity of this procedure and therefore are more ignorant than myself even though I have never had any formal "tax education." I have done a small amount of studying this and do feel that Americans are being fleeced of their labor. Thank you for posting such an intelligent, interesting comment. Perhaps one day, Americans will finally wake from their slumber and say "enough is enough! "

TL R......The problem with an "illegitimate tyrannical government" is that it really doesn't care much for the niceties of the "legal" system, especially after it has devoted almost 8 decades, perfecting the elements of the "confidence game" that is the United States Code, and when it, thru the IRS, can intimidate "third parties" such as "banks" to seize assets, or "employers" to "withhold taxes", even when it can be demonstrated that that "the law", contains no such authority or requirement. The "entire legal system" is an exclusive privileged class, so all of its members ( attorney's licensed by the "bar" ) are FIRST "officers of the court" and 'all those who ascend to become judges, elected or appointed, are first required to become part of that system, to gain entry to the third branch of government. It only at this point, that judges "need to know" their "true mission" as it regards the "fraudulent deception" that is the "legal system" and their singular task, which is to avoid "reversible error" that will be overturned on appeal, and become a "precedent" that can be cited by "anyone", even 'citizens" acting as their own 'counsel'. It is possible for individuals to "win" on the first level, and have the charges "dismissed" if they can establish a framework, where "error" would be "unavoidable" if a guilty verdict was reached, but every effort will be made to "intimidate" anyone who tries this, and the if a "dismissal" does occur, it will take place, quietly and with no or limited " public persons" present to witness it. If you take the time to watch the videos above, the gentleman who made them, began the process in 1995 or 96, and twenty two years later, he has reached the final appeal stage in the 9th and 11th circuits....so it will be quite interesting to see what the outcome is here.....and quite an education for you, if you can manage to "follow his work".....as he finds where the fact that "wages are not income" was buried in title 26 and the "language" that was used to further obfuscate it. As far as the "public perception" of all of this, so many changes has taken place, with regard to the "constitution" since 1939, without using the Article V process required, that anyone who bothered to read it should have many questions, as to how these "changes" took place.....and yet there are no questions, by anyone.....in the mainstream. Even Ron Paul, tiptoes around it, in limited fashion.....with regards to the Federal Reserve.....and he was essentially useless as a voice in Congress when he was there.....because he was just "ignored" and he didn't have the courage or integrity, to state directly what the cause of all of this is.....I will ad a few more links to explain it, that deal with the other aspects.....so you can read them directly and pass them on to others, if you wish. I'm sorry, Mr. Parent, but you made a serious error. You said that an original return for 2010 tax year filed after 04/15/2013 is too late to claim a refund. As you know, you have three years from the original due date, so that deadline would be 04/15/2014.

Hey, man don’t make this into something bigger than it has to be. This tax stuff can seem unwieldy at times. Seek good counsel. Call a CPA to help you get it together and find out “what’s what”. If you’re in trouble, consult a tax attorney. Peace of mind is more important, and you’ll learn a lot from the process.

Why don't you explain to people that their "employee" taxes fall under chapter 21; and that "self employment" taxes fall under chapter 2; Both of which fall under "FICA/SS" and which are for the "possessions" (Virgin Island & Puerto Rico) of the "federal" United States. Per "Section 7651 & 7655. And that chapter 1 taxes DOES NOT explicitly apply to "Citizens" of the United States of America and it only applies through "Regulations" which is not law?

I stopped paying income tax in 1980. The IRS is not a department of the us government. It is a department of the federal reserve which is a private banking cartel that controls our money. There is no law requiring a citizen to assess thereself for any tax. This is self incrimination, which is a direct violation of the U S Constitution , and they know it. This is why the IRS uses intimidation to coerce you into filing this unconstitutional tax return. If you talk to an IRS agent be sure to ask him how long he's been a Jesuit, then watch his face.

Re: SFR - what if someone was a drug addict/ alcoholic was not employed and have a W-2 or a 1099? 20 years straight of no employment therefore no employer sending in financial data on the individual. Basically a indigenous individual - disabled by drugs, alcohol and poverty. Would the IRS or State tax board Levi consequences I'm such an individual?

You can’t squeeze blood out of a turnip. If there’s no income, there is no tax. That type of person wouldn’t necessarily need to file a tax return. Although it’s probably a good thing if they started. I would say getting their life together is a higher priority.

I have a question and I Thank You in advance if answered. I haven't filed a return in over 12 years. I been completely off the grid & don't even exist on paper. I get paid with cash only & unfortunately I kept no record of. So in my case how would I even get started? I feel like I've fallen too far down the hole. Again thank you for any help on the matter.

There IS NO LAW. because TAXABLE YEARS ENDED AUGUST 16 1954 PASSED INTO LAW BY THE 83rd Congress AS LAW and published AS Volume 68A of the United States Statutes at Large as Law! Google 26 CFR 1.0-1 paragraph (d) of the IRC OF 1954.

Hi. I have a question for you. I have been paying tax for long time. And this year I file my tax 2020. And I noteced I didn’t pay federal tax . And I never knew I did it. I thought I payed. And my employer told me that oh computer glitched. And it’s automatically didn’t take your tax . And I asked other employee their fine .only mine is no pay. But I never agree with that. And I without knowing file my tax . And usually I always refunded. This year I need pay. Please help me. ????

My LLC had no transactions last year. I only made a deposit just to have money in the bank account (8K). I am from Mexico and my partner too. Do we need to file a tax return?

Great question Ricardo. Even if you don't have US sourced income there will be a new tax reporting requirement starting in 2018.. There has been a recent change that will go into effect next year. If you and your partner are NOT US persons for tax purposes, the IRS in December 2016 creates a requirement that foreign-owned LLC file a Form 5472. That is your US LLC will be treated as a foreign owner US corporation (even tough it is an LLC) for reporting requirements. This 2017 5472 won't be due until 2018. So now would be a good time to get an ITIN if you don't have on already. I can warn you if you do hire someone to prepare the a Form 5472 for you, the cost will seem rather disproportionate to the $8k value in the US account. The US makes things far more complicated than they need to be.

I believe we are US persons under Tax Code because we lived and work in the US with a TN visa for more than 183 days. We created the LLC to apply for an E-2 Visa but we have not done just yet. We got SSN. Can you tell me what we can do to file the zero income tax return?

Because you are a US person, then your LLC in not foreign owned, thus there is no Form 5472 requirement. This is good news. As far as a Form 1065 goes for your partnership, you have a capital contribution yet no income and no expenses. So I can't see the reason why you would need to file a return. The IRS reports that their are approximately 70 million Non Filers as of 2016 possibly more now. How is this possible ? Does a signed 1040 Form have you voluntarily waive your 5th amendment right? Is not the income tax a fraud and its just the continuation of the Victory Tax imposed during WW2? What is the definition of income in the IRS code?

1. Not everyone has a filing requirement and many who do choose not to comply. 2. You can claim whatever you want, a court would claim that you have no 5th Amendment rights to waive. 3. It was passed through entirely fraudulent means and is completely dehumanizing, however, it is more accurate to say it is a continuation of the Revenue Act of 1913 which was vastly expanded during WWI and hasn't stopped being a worse and worse POS than imaginable. 4. 26 USC 61 is largely defined by Glenshaw Glass as the test for income. en.wikipedia.org/wiki/Commissioner_v._Glenshaw_Glass_Co.

So if you don’t receive a 1099 and they don’t have any third party info, they cannot do an SFR? Do they often send out a letter first before they conduct an SFR?

An SFR is pretty much impossible without any third party information. Yes, they send out letters. One telling you they will do an SFR. And then another telling you they've done an SFR.

That is odd. Usually SFRs are done quickly (within two years) by the IRS underreporting unit. Do you have income that doesn't show up on a W-2 or 1099? If the IRS doesn't have any third party info on you, they have no way to automatically do an SFR. They must conduct an exam.

@@irsmedicthat’s not always true. I’ve dealt with people who haven’t filed for decades and the irs just never got to them. Of course their income was in the database but no action was taken until the guy decided to file the previous 6 years.

I am a US citizen, living (with permanent residency) in Argentina for the past 10 years. I am a freelancer here and my income has never been more than 10,000 USD per year. Of which I have paid taxes on locally. The problem is, I was completely unaware that I should also be filing taxes in the US - isn't there a law against double taxation? Now I would like to return to the states and want to make sure all my ducks are in a row. Could you point me in the right direction?

I am becoming a bit aggravated with this IRS Medic. Please do everyone here a favor and show the exact code that requires the everyday regular US citizen to file and pay a tax on their income. Do you know there isn't one but you make money off of the clients you serve so you go along with it? Or, have you simply never actually looked that deep to see if that law actually exists or not? You really need to show that law on every video that you do, once you find it. If you can't find that law, then you probably shouldn't be telling people how to file and the other crap that you talk about in your videos. I would love for you to do what the IRS has never been able to do, simply show the law that requires us to file and pay. Yeah Yeah Yeah, we all know how good all of you tax preparers are at helping all of us file and pay, but how good are you at showing us what requires us to file and pay? I can't find a single tax prep person or company or tax attorney that can produce a law showing it. In fact, I've had several in-depth conversations with tax attorneys that have agreed with everything I'm saying with almost the same response, "what are you going to do about it, fight the IRS!". That's a normal response from them and that proves to me that they are knowledgeable and intentionally holding up this lie of deception upon the people.

@@norml.hugh-mann There's almost nobody in jail for not filing. I've chewed out IRS agents and slammed my did in their face. They don't show the law because they can't. Yes, they do try to mess with me, but I'm okay with that. I know their system and methods and they exhaust them and disappear for a couple years then they start all over again. If you know the truth and stand firm, the little weasels don't know where to go from there. They expect you to get scared and jump though their hoops as you do. Millions before and after, what a lie. If you aren't filing you're much safer than those filing. They will use your tax return against you at every little chance they can.
