The most interesting thing about this incident is how NOBODY mentioned the damage and trauma of the child who was removed from his father - and all that time the child was also held in custody by a stranger while he knew the police were doing something with his daddy. Law enforcement doesn't think they are intimidating when police officers encircle a private citizen. There is no requirement for a private citizen to give a tyrant identification without stated cause, even if the officer thinks it would be better. An ID doesn't identify a perp. Somebody reported a drunk person. The police were right next to the man and must’ve realized he wasn’t drunk. That should’ve been end of contact. But the Gestapo have to ramp it up and escalate.

It can be for the invidual since most cops will hurt them if they don't. I don't think you should give your id, but at the same time look what can happen because of poorly trained cops. People can say oh that is an easy lawsuit to win, but most people don't have the time and resources to persue a lawsuit.

I am a victim of police brutality (was tased 7x) for “disturbing the peace” because I was in savasana on a Sunoco property (WITH manager permission) and I couldn’t afford a detainee fee for a lawyer so the case went to hell because i was uneducated at the time. Since when is a Walmart employee, a certified child care provider for the state? I would sue them on that fact alone! To let a stranger take a helpless child, without any vetting, is absurd, to say the least. Child abuse, and neglect, would be one of the charges.

The walmart supervisor seemed like he knew that was bs. Trying to solicit a tresspass from him and he said "what did he do" and the story they told him was of an illegal arrest. Hey, I need media attention here in Austin TX! I was unlawfully arrested twice AND Austin Police made me homeless by taking away my home where I lived for around 2 years. I have no criminal background and even have 15 years working for the state of NJ. I can't find a lawyer that will help me in any of my cases. I even lost feeling in a few fingers due to the last arrest where I wasn't even charged for anything.

Why does it seem like police want to arrest people that are not breaking the law? If I were a police officer, I would want to arrest someone that was breaking the law, not a random citizen that I thought might be a reported intoxicated subject who doesn't even fit the description. They were protecting the child from entering a car with a drunk guy, although the drunk guy didn't seem really drunk, per se, but was standing, sorta minding his own business and waiting to purchase his goods. That's odd don't you think. He seemed reasonably pleasant although a little annoyed, but he DID have hair. He did have hair. And a kid. He had hair AND a child. I think the cops did pretty good if I do say so myself.
Qualified immunity makes no sense. It was devised decades ago under the premise that government organizations don't have enough money to pay for their mistakes. But, if they can't pay for their mistakes, then the organization shouldn't exist because it means they do more harm than benefit.
Good to know the sergeant educated his subordinates instead of trying to con the victim with an unlawful arrest. He knows he needs to keep the public on their good side.

Surly the whole point of the call was the person was intoxicated, so why was he not breath tested. How does giving a name make you intoxicated. I cannot get my head around why police need a name or/and ID, what does giving your name prove in the case of the complaint. The only thought that comes to mind is a police data base.
@@TheByard It makes their job easier if they can find a warrant for your arrest. That gives them more time to build their case against you for something else.

Unfortunately, in Ohio, according to the aclu web site, one is REQUIRED to provide your name, address, and date of birth if a law enforcement officer asks. One may refuse to answer any other questions.

I agree however. Partially. In this case it’s a matter of incompetence and ignorance of the law. Which is obviously bullshit for a cop to be but here we are. Now this guy is clearly so incompetent that he should be moved into the later category with those who deliberately make a false arrest. As in the know it’s bs and it’s purely a diligent illegal arrest. I do believe in a variance in punishment between ignorant/incompetent and deliberate acts.
What kills me is that this is all based on a single phone call that gave half assed information, and no follow-up was done before they just decided to arrest him.
This is all they do they get a call and they go make an arrest they don't do any type of investigating accept terrorize you for your ID. And this is why people misuse the police system on others
The cops didn't even know if this was same person that was reported! Hell you can go into any Walmart in the US and find a person to fit that description, seriously think about it.
