Charlestown is a perfect example of what you get when your officials conduct the towns business in back rooms. I don’t even know why they bother to have public meetings. That Police Chief wittnessed and allowed an assault right in front of him and threatened to arrest the Auditor if he defends himself. The District Attorney should charge the Chief. File a lawsuit against this city and the PD.
Depends. Some tickets have a location for the speed reading taken by radar,/laser/pacing/etc. in addition to a location for the traffic violation. If you were radar clocked going 53 in a 35 and the cop writes 53 but charges you with 5-10 over instead of 15-20 over because you really did a good job with boot shining, that’s not illegal. Also, if he watches you on radar as you accelerate from 30 to 53 and writes 44 and gives you 5-10 instead of 15-20 over as the charge, also not illegal if the label where he writes the speed does not say “maximum speed observed” and just says “Speed observed”.
And why can't she record her discussion with the prosecutor? Was there a court reporter there? If not then her recording would've been the only record of the discussion right? So who's to know what was said & if she acted ethical or not if there's no recording. But I'm glad everything has worked out for both of you. Keep doing what you're doing.
I am SO confused...I live in MA, but NH cannot be that different. If you want to appeal a speeding ticket you go before a magistrate. There is usually a police "representative" whose sole job is to go to court so that the arresting officers or issuing officers do not have to go to court every time someone appeals a ticket. They present their side of the facts...whether it be clocked speed or captured on Radar, or Lidar, etc. You would then give your side of the facts. If you had a dash camera, which recorded your speed, I would think you would have a very clear cut case and they would dismiss the ticket. Reading about a "plea deal" for going 10 miles over (she said she reduced to 65 in a 55) which includes attending a drivers safety course is ridiculous. That should only happen if you get 3 tickets and lose your license. The biggest issue in my eyes is having points against your license that will jack up your insurance rates. I think it's great that you fought this and won, but until we can take away qualified immunity from cops it's really a shallow victory. That bitch can write tickets all day long...some will go through and some will get dismissed. Nothing will ever happen to her from a disciplinary standpoint until laws are enacted that hold the police accountable for their conduct and performance on the job. Otherwise they have nothing to lose and they will keep screwing with you guys. Maybe a civil lawsuit for Mark being arrested, but even that may not hold water.
When the chief/sheriff and city/county government fail to hold themselves accountable, file complaints with the FBI and US Marshalls. We need to get higher levels of accountability involved.

The ONLY positive I can say about chief dipshi+ is that he didn't arrest you when you were in his face after saying it was all good to be in someone's face. I tried to listen a few times too. I couldn't tell what that attorney was blathering on about; the letter is for outside the court, her little back room is? She isn't even a Judge she's an advisor only capable of taking pleas on traffic offenses, there was no jury there to protect and they weren't offering their own court reporter to make a record for the trial because she's irrelevant. So she saved her boss, the Judge no time by acting like a diva and the Judge allowed cameras at the trial. Sure are big egos there.
We in Australia may have to give up our names and address at the request of police, but we never get arrested for holding a camera in a public place. So much is wrong in your country which is supposed to be the land of the free.

An auditor does this to showcase the lack of knowledge that PUBLIC SERVANTS have in dealing with people on a daily basis. In some cases criminal actions are shown to occur by Servants who should have the knowledge to do their job for us. Without the Auditor filming these discrepancies, these Public Servants will continue to violate our rights under color of law. I view Auditors as an essential tool in bringing these problems to light, so officials who need to be better trained will eventually be trained. Some of these Servants have guns and badges and a bully complex. This is proven true. They continually break the law and will continue to do so until the public stops them. These videos done by Auditors go a long way to making this happen.
