I've been a cop for 10 years and deal with search and seizure daily. That is one of the most unlawful searches I've ever seen. They either needed consent from the homeowner, fresh pursuit or a signed search warrant from a judge to breach those gates. I'm in total disbelief about what I just saw. I've served hundreds of felony arrest warrants and not once have I entered someone's home without their consent. WOW!
No problem! I have been turned away from so many houses while looking for people with "ARREST WARRANTS" I've lost counts. You sure do have a nice spread. I bet they pay for that gate once the US Attorney looks at this video.

An Arrest Warrent does NOT give Law Enforcement permission to search or even ENTER private property unless they PHYSICALLY SEE the Offender on the property RIGHT BEFORE they enter the property !!!. I'm a retired police officer with thirty plus years enforcing the law under my belt. A arrest warrant does not vacate your rights against an unlawful entry by law enforcement Unless: There has been "Credible" information that the fugitive is on or has been observed to be staying on your property. However, they may enter your property in hot pursuit of an individual or under "exigent" circumstances, i.e. they have compelling information that the fugitive is there at that time and that if they delay entry and wait to secure a warrant, the fugitive would be likely to escape capture. If they claim exigent circumstances existed which permitted them to forcibly enter your property, those "exigent circumstances" must be presented and proven in a court of law. Get a good lawyer who specializes in constitutional law and sue everyone involved. In my experience, what was done on your property was outside and beyond the scope of their authority and the the laws of the United States.
When they lose these lawsuits the bureaucrats that ordered these searches should go to prison for life. I prefer they get the death penalty boss hoggs are the worst cancer.

Get their address and tell your son to change addresses he uses if warrants continue to bless him and you by default. Might have thought about that for the last warrant.

An arrest warrant does not constitute a search of a private domicile. Unless law enforcement has proof the name of the person on the warrant is in said domicile.

First of all, what a beautiful homestead. Love it. Body warrants and search warrants are different. No search warrant they can not pass the gates, if the mailman can't walk up to the door the property is not considered public domain or usage.
So......what ever happened? Did they pay for the gate? Did you take them to court? Usually the only time they can enter if they are on "hot pursuit" or a search warrant. An arrest warrant is not a hot pursuit. It would be preposterous to assume they can bust in on every place one has been known to frequent.
I hope you sue ever single one of them! A arrest warrant does not allow a search of the property! Because they violated your Constitutional Rights, you can sue the Sheriffs office, the US Marshals department and each and every single one of them personally. Dave Martin ** You are wrong. They need a statement or a witness (not an LEO) that the person is on that property to ASK the property owner if he is there. If said owner denies them entry onto the property, a search warrant detailing what they are searching for and where the signing judge says that they may search is REQUIRED. This is upheld by the US Constitution and SCOTUS. I don't know where you're getting your information from, but it is flawed.
what i did a copy and paste of above is the law on entry without a warrant, reasonable belief is all they need for the purposes i copied above, exceptions are always evident in any law too allow for exceptional circumstances.

You need to sue them for every penny you can. Get a lawyer r at least talk to one. This is ridiculous . No American citizen should every have to go thru this illegal search. No arrest warrant would never have a search warrant written into an arrest warrant.
A proper search warrant must accompany the arrest warrant, period! You can demand to see the search warrant prior to them entering. You also can demand that your attorney must see the search warrant prior to them proceeding onto your property, the Constitution is very clear on this. What they have done is completely illegal and must be prosecuted both criminally and civilly. The only thing that will change their behavior is our resistance to tyranny. Did you make a difference by talking with them? No, not in this case! A badge does not give them the right to violate God given Constitutional rights and laws. You have the right to protect your life, the lives under your charge and your property. These scumbags are nothing but thugs with a badge. Let me ask...if these men had been a group of criminals what would you have done then? Wow - so sorry you had to endure such an egregious attack on your private property and person. I appreciate you sharing this and would hope it helps educate the whole of the U.S. on the lawlessness of some law enforcement in every state in the union. This is not a isolated incident by any means... there are attacks such as this on property and on us bodily on a daily basis. Many constitutionally protected activities are declared by law enforcement to be "suspicious activity" and subject to searches, seizures, detainments as well as totally illegal arrests (some with "manufactured" crimes). When we are not safe on our own property from searches such as this, tyranny is the rule of the day. To get a search warrant an affidavit providing probable cause must be signed and sworn to - when they can't get a warrant because they don't have or can't "manufacture" probable cause, they often proceed as in this case. Often times the "education" of the law enforcement personnel is so poor, they actually believe this is legal as well as justified and within their scope of duties - it is not! under many circumstances. This lack of education, or training, can go to the top of an agency and it takes court action to provide it. We are then often at a great disadvantage because of the time and cost of doing so. One final comment, it is a sad situation for some law enforcement to feel their authority challenged because one of the people is willing to stand up for his or her rights - it used to be a badge of the hero in this nation...
