I want to file a federal lawsuit against the CPS, state trooper, and executor of an estate for false reports of financial abuse that is now on my permanent record because the person that she filed the restraining order for died during the restraint. Complaints to the nursing board through the Oz Budsman was made, claiming that I am medical assistant was financially abusing my fiancé. She claimed that I was just a caretaker and had me ejected from the house.
She mentioned using the words True and accurate copy regarding text messages in a prior video and I did exactly that. When reviewing findings of fact the judge mentioned that I provided a true and accurate copy versus snippets. I am no longer facing allegations in part because I listened to her. Typically no, these hearings are generally forbidden from any type of audio or video recordings other than those in control of the court. Due to the nature of the hearings, there’s an obligation to protect those participating.
Me and my boyfriend are getting a restraining order (in California) against a man who sent ME messages that he would kill my boyfriend. There are several messages that were sent to me and I am protected on my boyfriend's retraining order petition but my boyfriend is the petitioner since the messages stated clearly with my broyfiend's name that this person wants to kill him. Is the evidence of all these messages sent to me hearsay even though I will be testifying on court and also an additional protected person on his civil harassment protection request?
I wish i knew about these when i had the hearing. I keep getting advice to appeal the DVRO as a motion to set aside an order is looked down on. I talked to a lawyer. He said that it didnt exist and then i tiold him that it says i can do that on a self help website. He then said it exists in the books. I could have objected to all of what she said. I didnt know i could do that. She lied about everything and now im forced to 1 appeal it or 2 file a motion to reconsider. In the description of abuse her testimony was completely different than what she said in court. I had only prepared to what she alleged in the desc of abuse. I didnt prepare for anything else because i was under the impression that what she was saying was going to be in the description ot abuse. Well now im being falsely accused and now i have a dvro on my record whifh will likely affect what colleges i go to and potential job prospects.
Do you have any suggestions on who to watch or listen to concerning Washington state? We aren't allowed to ask questions or cross examine at all. She had 5 minutes to tell her story and I had 5 minutes to make my statement. I lost my appeal because she keeps harping on her fears, but I have never directly threatened her with violence or harm. But the judge was swayed by her performance of being scared. I need help!
