Hold on! This is a bad title for this video. He was fired because he couldn't lift 50 pounds, not because his boss suddenly found out that he had been doing something for the last 20 years.

he needs to look into a Department of Justice Lawsuit about the ADA considering that the companies are required to make reasonable accommodations to ensure that the disabled people that want to work have an equal chance at the job. This sounds like a perfect case for discrimination against a loyal employee who happens to need to use a wheelchair.

@@epicmomness1974 Agreed. If I were an employer, I'd hire Daniel. We're retired, though. I once worked for a corrupt church/school, on a hill in Orland Hills, IL. My late wife helped me out for free. We gave ourselves to this place, even being on the "worship team". It soon became apparent this "Christian" church was not Christian at all. The board and the pastors harassed teachers, custodial staff, etc., until some of us quit or were forced out. I subsequently made an audio tape directed at the fiends, copied it for some of the congregation and saw four lousy pastors resign. Wish some of David's Walmart fiends would take a hike, too.

@@LadyAriella1960 Thank you! Finally someone else understands. That's definitely wrong-doing on their part. If that wasn't the store manager who chose to fire him after making policy changes...then I want to know who that manager was. Also, if that happened to be the store manager, than what he did was extremely wrong. And I am aware that all store managers have a manager above them (forgot the term used for that) where I'm curious to know what the store managers' manager thought of that. Of course not all, but most of the time, managers usually have another manager above them where that 100% was discrimination right there.

flynn malin Maybe so, but good luck getting Wal-Mart to abide by the law. He could file a suit, and woll likely won. But Wal-Mart is well known for not paying it's judgements without a fight. Wal-Mart even once spent over $2 million in legal fees to avoid paying a $7000 judgement. They did this to show spite and defiance. To flex their muscle and show how much power they wield. Daniel would certainly win the trial, but will NEVER see a cent without several appeals and stonewalling from Walnart. His award will all go to legal fees which could take up to 4 years!

Not me. Being a good greeter does not mean you would be good at anything else, its skill set is near zero. Having the dedication to show up for work everyday on time actually used to be considered completely normal, in fact if you didnt you would get fired quickly...

As someone who worked at Walmart for a good period of time, they literally do not care how good of a worker you are, how hard you work, or if you go without calling in. They will find any and every reason to get rid of you because it's cheaper for them to hire new people then to pay your benefits or whatever else is do to you when the "probation" time is up. They could also care less about family emergencies or injuries. There is a whole list anyone who has been wronged by Walmart could tell you.

That's bull crap. This brother showed up to work, in any weather condition, showed customers respect and dignity. So what he was in a wheelchair and couldn't lift 50 pounds. He was dedicated and loyal to the company. Then you fire him because you change the status and title of the position he had. Sad. I believe he was let go because by being there that long, he was making too much money and they wanted to hire someone at a cheaper rate of pay.Walmart you made a big mistake letting this brother go. Another company will hire home and pay him way more than what you guys were.

I am disability & handicapp too Had Special E. But wa s nothing like Daniel.I got bullied & picked on By management. Wal-mart is a horrible company. & Their managers are getting worse They are so Arrogant That They think They are the law, Quitting was the best thing I could Ever do there. I am happier with out wal-mart in my life.Same would be so disappointed in his company.

This is typical of Walmart. I worked for them for 20years and almost died on the job from a heart attack and stroke. God healed me. Thank you Jesus. I returned back to work about 6 weeks later. Still having problems with my heart. Couldn't work like I use to. I was indirectly recommended to step aside and leave for health reasons after I was fighting every day of my life to continue working for three more years. It's sad but I thank God🙏 I am alive today. I don't have much anymore but I have my life. I have lost so much but it's okay. IT'S OKAY 😥

Shirley please do not contact Ashley. She is most likely in or running a pyramid scheme. Look up Door Dash. It’s my first job that I can actually work because of my disabilities. You can log on to the app and deliver food when you want. You can do it as often or as little as you want. In my area it pays up to 23 dollars an hour. Your area may not have it but you can also go to anywhere including richer neighborhoods to get more money or to another town if you don’t have it in your area. You have to pay for your own gas but they approve you almost immediately if your background checks clear. It’s just delivering food so things like accidents and speeding tickets won’t matter. Most likely simple crimes won’t matter either. God bless you.

Door dash has both a website and an app. I get my kit in the mail in a day or so and then I can start. I’m so excited. You’ll probably need to have a smartphone to download the app on. Also you get paid every day after each delivery.

I am a disabled vet and can't lift 50 lbs or more either so I understand his troubles. I wish him well and pray someone with a heart will hire him.

I only say 16 since that's the age most people usually drive at...or her parents or whoever she's with probably drive her places since there's a chance she could potentially fall asleep at the wheel. She just has to fill out an application on the government website (for the state she lives in) to see if she qualifies for it. And if it doesn't go through she can actually call the ssi company and explain her situation to them. I feel like explaining it might be better than filling out an application and then not qualify for it. I don't know how it was supposed to work, but apparently I learned that I was able to qualify for ssi, but when I talked on the phone w/someone she asked me: "What is preventing you from working?" I don't know who, but I do know someone who works in retail and somehow also manages to receive ssi.

I work for a major pharmacy chain (not saying who because I don’t want to lose my job) and I worked for Walmart back in the late 90’s...the one thing that Walmart, my company and any other major business have in common is that they are making money...they don’t care about their employees and only care about the money going into their pockets...I’ve seen a lot loyal employees being let go due to a legitimate reason and for a completely absurd reason...when I worked at Walmart, my assistant manager was 3 months away from being vested into Walmart and qualify for their retirement benefits...they fired her so she wouldn’t get the retirement benefits...she was dedicated, loyal and hardworking...thousands of people have lawsuits against Walmart for wrongful termination...how does Walmart get around that? They keep postponing their trails and pay more court fees...after so many times, those people can’t continue to afford to pay those legal fees and end up giving up...Walmart could piss away millions in court fees and they don’t care, they have have money to spare...which hurts its current employees by paying them less, dropping them to part time (no insurance benefits or retirement benefits) and replacing them every few months with new employees...Walmart’s board of directors and their “important” stockholders are laughing all the way to the bank...people can hold rallies and protest on behalf of Daniel and others but it won’t do any good...money is all they care about and how much they can stuff into their pockets...it sucks that a great and loyal employee like Daniel got fired as well as all the others who suffered the same fate but in the end Walmart and other major companies just want people’s money...it shouldn’t be that way but it is...

I once worked for a very famous television show. I broke my hand on set one day (their fault) they handled the medical and surgeries and all that but when I was cleared to go back to work they started cutting my hours. They would send me home at lunch or call me in the am and tell me not to come in at all. Basically they couldn't fire me. So they starved me out by not scheduling me to work. SHAMEFUL

My understanding of the law is that Walmart has to show it fired him after they could not make "reasonable accommodation". Meaning if a small percentage of his job was helping with those returns then he should not have been let go because some other store employee could have helped with the returns the few times it happened. Shame on Walmart if this is a factual story.

@@juneosborne862 Same here, but unfortunately I still have a couple injuries back from a car accident I got into in 2017...where a couple days, I tried to lift a 24 pack case of water, and I couldn't do that...but that's only because I can't really "twist," my wrist in a sense in order to lift it. The way I have to lift something is very different than the typical way. Also, apparently, I don't know how to lift things correctly. A while back, I attempted to pick up a big case of paper I think that contained about 10-12 reams inside it and my co-worker was like: "That's not how you lift." Even with the proper way, I still couldn't lift that case. But the 1 24-pack of waters, isn't that only like 10-15 pounds?

My brother had a heart attack a few years ago, he was 8, Idk how! He’s young, healthy, and has no issues, but he did, and he is almost done recovering, he survived and is being taken care Of well.

He LEGALLY and Morally shouldn't have been "let go", terminated really. I wonder in which country this occurred, because, as far as I know, The U.S., Canada, Great Brittain, the E.U., etc., All have laws against discrimination of the disabled. They HAVE to find a job a disabled worker can do, termination for a viable disability is not legal.

The title is misleading. What he did for 20 years has nothing to do with why he was fired. If anything, it should have been a reason to keep him.

It's funny how they implemented the whole "checking the receipt" thing when it, so clearly, violates the Constitution and isn't a legal practice. Yes they should hire back Daniel but they should also stop trying to violate Americans rights.

There's a loop hole in this because "technically" it's still their property as you are still on company property. Even after purchasing it, they can still claim you stole it because you are on their property. And "technically" the people checking receipts are not allowed to look in your bags because that is an invasion of privacy, which is why they receipt check for items not in bags. Then if it's not on the receipt, they call security. Checking your bags is when security feels you have stolen something or had fast hands. It's all in their insurance policy. It's basically like walking into a store (not your ground property) and walking out without purchasing it. That insurance policy they have says they are allowed to check what you purchased to make sure you didn't steal since you are on their property.

The job was checking receipts and keeping an eye out for shoplifters. But then they expected more than before and didn't think the job is often filled by disabled folk. Money became number one. They never learned that if you give people your best then the customers will be pleased and come back to spend money. Kindness counts.

+Alfredo Verduzco 1.) It's ridiculous to make changes like that to begin with and 2.) In any retail company, it's actually wrong of them and/or possibly illegal to fire an employee because of a disability no matter what that disability is. I don't know which Walmart nor which location that particular Walmart was in, but since the manager knew about Daniel's disability, they have to cooperative enough to work around it. Yes, it may be part of the responsibility to lift 50 lbs, but no one in a wheel chair nor anyone else who may have some form of a physical disability should be forced to lift 50 lbs. All companies esp. retail ones specify how they don't discriminate against their future employees no matter what their ethnicity, gender, disability, etc. is. And what this particular location did to Daniel *is* a form of Discrimination. They knew his situation for over 20 years and Daniel never did anything bad. No company should force any of their employees to lift what they're unable to lift no matter what their circumstances are.

Key fact: He was employed by Walmart for 20 yrs, meaning he was probably at the top of the pay scale for his position/title. They canned him so they could hire a replacement at minimum wage, typical Big Business scheme; it's all about money.

Probably true but it's still wrong Walmart makes far too much money already of course they wouldn't offer him paid health insurance so he'd have to fall back on Medicaid which the state taxpayers fund and he could likely have qualified for food stamps on his salary from malwart too it's a rogue blood sucking company and hopefully will fail soon America has far too much cheap plastic stuff made in China already!

@@spritualflared yeah but what would happen if this caused lets say even 5,000 people to stop buying from that one exact Walmart, and lets say to make things worse those 5,000 people went to no store named walmart and just did alternative stores, and every day those 5,000 people spread the word to 1 person each to not buy from any walmart and lets say those new 5,000 people plus the original kept telling 1 person a day to do same! then in that case prolly 15 days go by and nobody at that rate be going to walmart! cuz -5000, -10,000, -20,000, -40,000, -80,000 and so on It wouldn't take long at that rate for Walmart then to see woah we are losing money and customers fast! (and to make it very ironic) everyone lost will return the day this guy gets rehired now wouldn't that be a twist and a half :P Btw I just convinced 10 people to not go to Walmart and then told them to tell others also to not go to Walmart :D

We had someone like that at are local Walmart but luckily the manager lied about her being unable to do that and kept her and when the district manager threatened to fired both of them about 75% of the staff threatened to walk out and never come back and it work both of them were able to keep there jobs

What a sleezy, despicable, business walmart is! I don't shop there for many reasons, and yes, one of them is due to how they treat they're employees! I hope that everyone of those people went "elsewhere" for they're groceries and such, but I doubt it..most people have the attention span of a gnat.

+Leah Jerez Honestly, it really depends on the Walmart you go to. The one I go to is usually pretty good. I have been in there a couple times where it's seemed like a couple employees had been in a bad mood one day, but I didn't think too much into it. And most people shop at Walmart since they're Cheaper than most other places. Target of course has more options than Walmart, but similar in a sense where I've noticed some of their products are only 2 cents more expensive than the same product at Walmart. And while Safeway and Lucky's both do quite a few sales going on (usually when I go there); they're still the more expensive stores in my opinion...but I will mention this where not all Walmarts have a produce and/or refrigeration section nor groceries for that matter.

Walmart in Thornton, Colorado pretty much did the same thing to my Mom. She had to take medical leave, when she returned they said the only opening they had was working the dock unloading trailers! Could you imagine a 62 yr old woman unloading trailers??
