For simple divorce, no significant assets, just a joint bank account with less than $20,000, and less than 10 yrs of being married (8 yrs to be exact), with a Prenuptial agreement stating that no spousal support from any party in case of divorce and that all assets (with significant amount) acquired during marriage will be distributed accordingly, would you recommend to do it ourselves or hire a lawyer? Thank you!

I would hire a lawyer to at least consult about your rights to be safe. I personally would hire a lawyer to avoid the hustle with the forms and other issues related to divorce.

That’s correct. You need 3 copies when doing so and arrange service to the other side after you receive an endorsed copy.

Thank you so much for this video. I had been worrying about how to fill out my uncontested divorce paper since the wordings on the papers is kind of very new to me. I am very glad that i found your videos. It was very clear and steps by steps to the end. If I may have one question for you is that , if it is the uncontested divorce, all two parties already agreed on properties and assets of which goes go to whom, and don’t need the court to determine or divine. Do we still need to list it on divorce forms ? Does listing your properties, and assets will cost more time than not listing them ? Again thank you so much for a very helpful video.

You are welcome. It does not need to be listed in the petition form (FL-100) if you are not doing a default, however, I suggest to include who gets what in the judgment attachment (FL190 attachment)

Hi, nice video. My wife and I decided to divorce, uncontested. We are in California and both want a divorce. We were married in the UK, is it ok to get a divorce here? Same rules based on California? I do not expect disagreement in terms of finance. Our kids are over 24 years old. Should I file the petition first before agreeing on the financial details? Or should we create a marriage agreement with all the financial details before the petition? How to create a marriage agreement? Thank you. B.

As long as it is readable, hand writing is fine. I had to do it couple times myself.

Thank you for so much information. I was wondering if I have to list my cell phone number on the FL-110 Summons form because changed my number because I didn't like how my husband was calling me with fake phone numbers all hours of the night. Can I use my work number instead of my personal cell or does it have to be the same phone number I used for the FL-100 petition form?

I use Swift Process Servers. If your husband is living out of state without minimum contact to CA, the court won’t have jurisdiction over him for your divorce. That’s correct. Ideally, speak to the clerk directly if possible to ensure all the paperwork and payment is correct.

Mam I was married in san Jacinto county in Stockton in 2013 but me and my wife have been separated two weeks into our Marriage until now which has been 8 years next month. My wife is giving me a hard time about filing. I told her it would be easier for her to file since we were married in California. It would be harder for me to file since I dont live in California. How should I do this. I have filed for divorce before without a spouse, but she lives in the same city as me, this is different. I wanna file, i just want this over. We dont have anything together. I wanna file on my own without her consent. How should I do this

Citizenship doesn’t matter. One of you must live more than 3 months in the county you are filing and 6 months in CA. If not, then legal separation is the way to go.

@billligon4005 1 second ago We both decided to file for "uncontested" divorce because of financial reasons. Our combined net worth makes him ineligible for Medical. The Divorce would make him eligible for MediCAL. ?!?!
