Regarding the first example with shorting a correlated stock: based on my understanding of the material non public info section, I'd say it's a violation of the code and standards if it's known that the person intentially tried to benefit from the material non public info. In other words, the correlation doesn't matter, its the intent that is main point

I love your videos. I am sitting for my CFA II at the end of May and I am so nervous! But videos like this make me feel like I'm not the only one that gets confused by some of the material.

Hi, I'm a new subscriber to your channel, which I’m really liking it a lot. A have the following question: Which one is better, to pay for the IMC and pass it, or register and pay for the Level 1 CFA Exam in order to access the curriculum materials but without any intention to sit for the exam? My intention is to at least access the oficial curriculum materials for me to slowly start preparing myself for the CFA Level 1 Exam, since currently I do not have the skills (lack of English full proficiency and maths skills) or time to actually pursue it. I’m aware that the curriculum is constantly updated, but I imagine that it doesn’t change much every year, so I have no worries there. The price for the IMC or the CFA Lvl 1 Exam are almost the same, so I’m actually considering it would be best if I just start slowly preparing myself for the CFA instead of earning the IMC. To give you context, I’m a young in-house legal counsel at a South American stock exchange with the securities broker certification issued by the same local stock exchange and currently coursing the derivatives broker certification that is also issued by the same stock Exchange. I’m currently transitioning to a financial role at a local brokerage firm, most likely as the head of trading and treasury. In that sense, since I do not have a financial academic background (I’m a lawyer) I’m in the need to actually earn knowledge in the field and also a respected certification that would make no one wonder about my qualifications in the field. Besides the CFA I’m thinking of getting an MBA and a Master in Finance or an MBA in Finance instead. All of this would serve as a “replacement” to a financial academic background (economics, accounting, etc.) that I do not have since I’m a lawyer. I have always been passionate about the financial and legal aspect of the capital markets and I’m determined to earn the CFA since it is the most respected certification in the investments field. The local capital markets is not that complex (fixed income mostly and the mutual funds are kind of new) and that’s why I “have the balls” to make this transition into the financial field. The idea is to start in a trading or treasury position and in the future to be a portfolio or fund manager. Sorry for the length of the comment but I would really appreciate it if you could give me some advise in the matter.

Hi Gonzalo, Thanks for subscribing! I would not tell you to sign up for the CFA until you are really ready to seriously study and sit for an exam. But you're right that the CFA will help a lot in the field of finance law.

@@straighttalks-ajsrmek323 thanks for your advise! But I’m actually currently leaving law aside and transitioning fully into finance. That’s why I’m in the need to acquire knowledge and accreditation in the finance field and that’s why I’m already aiming to pass the CFA Lvl 1 Exam in a short-mid period of time from now. Although I’m not ready to really study and take the Lvl 1 Exam as for now, I’m thinking that is actually a good idea to register and therefore access to the curriculum materials for me to begin studying slowly at my pace and once I feel that I’m ready to do it I can just register again to fully study and take the exam. Yes, it would cost me twice the price, but I’m thinking to do this instead of doing and paying for other lower tier courses or certifications that may also help me in giving me some base before signing up for the CFA Lvl 1 Exam. In that sense, I just feel that since I’m already aiming to pass the CFA Lvl 1 Exam, I should just start studying the curriculum materials instead of doing other courses or certifications that will have no value once I pass the CFA Lvl 1 Exam. What’s your opinion on that? Thank you very much!

I'm the CFA ethics course content developer for one of the major test prep companies. These simply sound like poorly written ethics questions without enough info provided and too many assumptions required.

@@straighttalks-ajsrmek323 I would really like to help promote your channel by providing some value-added content. However, like all instructors and content developers working for test prep companies, I have a strict non-compete agreement with my company that prohibits me from discussing course material outside our online teaching sessions and written course materials, or even offering tutoring (via, say, a RU-vid interview) without prior consent from our legal staff, which I am unlikely to obtain. I think it would be difficult, if not impossible, to avoid discussing issues that would either violate this non-compete (and thus the Standard re duties to employers) or potentially the Standard re discussing questions found on past CFA exams that have not previously been released by CFAI. But as you know, expressing opinions related to CFAI's policies and procedures are fine. I am happy to provide my own opinion on specific ethics questions in your chat, but I would need to see the questions in their entirety in order to comment on them, as context and inferences in the questions are often keys to the correct answer, or why some answer choices can be eliminated. I sometimes disagree with CFAI's own "correct" answers because they require assumptions that cannot reasonably be made with the information provided, and thus unnecessarily create the grey areas that you and your subscribers refer to in this video and comments.

In RE: Hedge fund manager, he has to get approval from his firm to accept the gift from the client is what I recall from the studying for Level 2 right now

For "gray area" questions, is it preferable to chose an answer confirming an ethics violation, or is there no pattern nor "hard-and-fast" rule?
