They could court-martial general Millie for insubordination. For any military officer or civilian to be convicted of treason however requires that the US has declared war on the country in question - in this case China. Keep in mind in the 1950s the Rosenbergs were not convicted of treason; instead they were convicted of espionage for the Soviet Union . Eventually something similar will be revealed about that pathetic excuse for a general.
