I think the right legal proceedings would be an action or complaint against the occupation itself, not just the consequences of occupation. The motion implicitly tolarates the occupation, but is seeking legal remedies which occupation entails. Secondly, what the motion is seeking is only an advisory opinion, as opposed to an executory order or decision or judgement, which legally speaking can be enforced by legal enforcement measures available under international public law. The advisory opinion is just that, it has no teeth except additional political legitimity, but very symbolic legal effect. So the legal affaires of the Palestinans are run exactly in the same way their political affaires have been handled since 1948. That is why is Israel has only showed some anger about. And that perhaps why no one is expecting something practical will come out of those legal proceedings. It is very frustrating in many ways
Israel and the people is such a progressive and great country...where would this part of the world be without them? What are the palestinians doing in such..
There's a UNSC approved determination for Israel to leave the occupied territories (if I'm not mistaken). We must remember that a lot of Israelis fight for the rights of Palestine like did former IDF officers Matti Peled and Isaac Rabin.

The occupier and those that support injustice will continue to act in a way that makes the oppressed feel hopeless Each of these moments and initiatives will be cumulative over time to appeal to and touch the nerve of humanity and justice - but this will take time The turning point to end apartheid in South Africa came about by an uprising amongst ordinary people that stood for human rights and justice , International pressure on the state and widespread support from civil society There is a major difference here , where in the South African context there was never a talk of 2 states where the racist oppressors will have a state alongside the rest of the people. This notion of a so called re rival or reviving peace talks of a 2 state solution is a smoke screen under which the oppressor is flourishing to a point where that will by default not be possible any longer The only hope for the Israelis and Palestinians is one state where all are treated equally. Except no Palestinian state existed in history. Between the fall of the Kingdom of Judea and the re-establishment of the State of Israel in 48, the only state that existed there was Israel. Jerusalem wasn't the capital of anything else except Israel.
@@rxtr664 I’ll explain which international law is the only one that matters in this situation. The national borders of Israel were set in 1922 at the conference of San Remo before the UN ever existed. All of the countries who signed onto the League of Nations agreed to be bound by the international laws that came out of the League of Nations. The Conference of San Remo was a League of Nations conference after World War I that set that borders of many nations now in existence. The only international body at the time voted and all the nations agreed. The borders were set for the Israel, Jordan, Syria, and Iraq to name a few. The national borders of Israel were set at this time during the Mandate system even before they had gained their independence. And what is now called the West Bank sits securely inside these national borders. Nothing the UN says or does later can nullify the international law that set the borders if these nations before the existence of the UN.
*_"This Organization does not exercise any regional sovereignty over the West Bank in the Hashemite Kingdom of Jordan, on the Gaza Strip or the Himmah Area. Its activities will be on the national popular level in the liberational, organizational, political and financial fields."_* PLO Charter, Article 24
This is an example of a Satanic trick in a dispute. You ask a question about your point of view, while acting as if your point of view, or your accusation, were a fact. For example; as a teenager I saw a school mate catch another schoolmate with this trick question; he asked, "John (but any name would do), isn't my pen1s the best you have ever tasted"? My friend rushed to loudly exclaim "NO!", but then when he realized what he was actually admitting to, he changed his answer to "I mean, yes", only to realize a second later than he had moved from one trap to another. The ruth lived in neither answer. The unproven, and actually false, accusation contained in question was slipped in undetected by wrapping the accusation in a question. Another example is a car salesman asking, "In what color would you like the car better, white or silver"? Whether you say white or silver you are in effect taking mental possession of the car, and you are obliquely admitting to liking the car, even when in your mind you are just admitting to liking on color better than another. Word trickery. The same trick is used here because there CAN BE no LEGAL CONSEQUENCES of Israel occupying Palestinian territory because THERE IS NO PALESTINIAN TERRITORY. Israel is occupying it's own territory called the state of Israel. How can there be Palestinian territory when Palestine as a nation never existed? How can someone TAKE FROM YOU something that was never yours? How can you LAY CLAIM TO something that was never yours? If I steal a car, keep it 's rightful owners from enjoying his property for any number of years, and spend $10 000 "pimping out" the car during that time, when I am caught the car goes back to the RIGHTFUL owner WHO DOES NOT EVEN HAVE TO COMPENSATE ME FOR THE MONEY I SPENT ON THE CAR. He does not even have to thank me. I have no ownership claim to the car, neither from my having "occupied" the car it for a number of years, nor from having spent money on changes which I consider to be "improvements" to the car. Theft is not "transformed" into something other than theft by either mechanism of time or money spent. The deceivers, who deceptively mislabel themselves as Palestinians, are trying to lay claim to "International Squatter's rights" - which does not exist. And why are they complaining about the high wall that keeps them separated from the Jewish people when they fire rockets into Jewish neighborhoods, and their leaders have never retreated from their statement that they are going to drive the Jews into the sea? Israel, like all other nations, has certain rights; these include: The right to occupy their own territory without apology or explanation to anyone. The right to self defense when attacked. The right to build out the physical infrastructure on their territory in such a way as to reduce or eliminate threats to themselves; ie; the right to "Physical Security". This absolutely includes the right to build walls as high and as strong as necessary or chosen. The International Court of Justice will prove itself once again to be as useless a UN body as are all the others if it does not dismiss this novel accusation, which is based on the nonsensical premise, that a nation can "illegally" occupy it's OWN territory. There is an Arab League. There should be a Christian League. This means that libtards who are anti-Christian and who block this body from being born, must be removed from the seats of political power.
Besides, I agree with the riddle posed by Dan and repeated by Bill about the "known", "unknown" and the "unknowable", indeed we are entering a NEW ERA in which "fixing horse or dog races" would be far more difficult due to multipolarity, I think it was a sensible warning to the incumbents...
There was Never a Palestinian state. They never owned/controlled the West Bank. Jordan controlled the West Bank. If Jordan didn't decide to invade Israel in 1967 the land would still belong to Jordan, not the Palestinians and not the Israelis.
I would just like to make one point of clarification from a strictly legal perspective. The panel seems to be confused about the nature of the International Court of Justice's advisory opinion on the Wall, and as a result, on the pending question before the ICJ on the legal consequences of Israel's occupation of Palestinian territory. From a legal perspective, any ICJ advisory opinions, as the ones at issue, requested by the UN General Assembly are *non-binding*. Simply put, Israel was _not_ bound to follow the advisory opinion...this is despite the fact that the ICJ determined that Israel violated international law. It is well-established in international law that no state can be compelled to submit itself to the ICJ's jurisdiction, and Israel did not consent to be party to a dispute before the ICJ...these are not contentious cases. In other words, these matters are not brought to the court in a state versus state context (e.g. Israel v. Palestine), which would result in binding legal obligations for the parties. While I commend Al Jazeera for its reporting on the impact of the expected ICJ advisory opinion, I would recommend that a lawyer be consulted before production or, better yet, retain a lawyer who could explain this important distinction, as well as other consequences resulting therefrom.
