What can you LEGALLY forage? | Law of Foraging England and Wales

Foraging season starts for me in the spring when wild garlic first starts showing its shoots. So many people are beginning foraging as a new hobby, I thought it would be useful to cover what the law says about foraging- what you can take and what you must leave alone.
Foraging is a great way to interact with your environment and collect some amazing, quality, organic free food. That being said, following the law is important so that our right to forage on private land is not taken away, and we do not damage the environment.
Wildlife and Countryside Act, Schedule 8 : www.legislatio...
Do note that I can only specifically cover one jurisdiction, so that is the law of England and Wales. Many of these laws are the same or very similar in Scotland, but for the rest of the world they are likely to be worded very differently.
Let me know if you think I have missed anything! If you have any questions, or specific foods that you want to learn how to identify when you start foraging, leave a comment and I'll try to either reply or make a video on that topic.

Good video. What about if someone has a plant/tree on there property but is over hanging the fence, can you forage from it as long as you don't take from there boundary? I've seen nice lavenda, rosemary and willow trees I would like to have a pick at, but don't want to steal now. From what I have read it is ok to trim if they were your neighbour so what about forage?

This was eye opening, on a related subject, what is the legality of gathering firewood (without the intention to sell or profit), and i specifically mean deadwood. I live near a railway and the trees are cut back then the cuttings are left on a public footpath.

Fascinating question! Dead wood is not included in the definition of foraging that I've found. I would suggest that the strict definition of the law would make this theft against the landowner (unless you had their permission) but I'm genuinely not certain. You've given me food for thought, thanks :)

@@elventuresuk ikr, but it's on public land which makes it all the more confusing.

Would be worth covering legality of wild camping. My understanding is that you are effectively fine unless you refuse to move after being asked to by a landowner (or agent of) or camp in somewhere really silly (e.g. military site) subject to separate laws. Random members of the public may tell you not to camp somewhere, but I think this is legally insignificant (although often enough to persuade people to move).

I love this idea! The law of wild camping is slightly more complicated but im going to get researching that asap, would be useful to release that video before summer 👀

I'm really glad you got something from it! I'd love to do similar videos on other topics (wild camping was suggested below) so do let me know if there's anything else you'd be keen to see ☺️
