@Freedom is over sad this an often cited unsubstantiated claim. Crime rates in New York had already been in decline when this policy came around there is no definitive proof of causation. Look up the numbers. People like to cite the number when the policy started showing a drop but ignoring the years before also showing a dropping trend. This was simply security theater. The problem with this policy when your a New Yorker is they seemed to stop and frisk a select group of people and I don’t like being made to look like a criminal in public when I’m just minding my own business.

@yossarian but after you do all the research and find out NO ONE was hurt (besides Plax) and the person in question has no criminal history, probation plus community service is the most logical outcome. Trying to over punish someone because they made a mistake is the biggest reason why so many young men and older men turn back to a life of crime when they're finally released from prison.
@@tstryker03 Carrying a handgun with or without a safety, and a round in the chamber are perfectly fine, if you have a good holster. If you're going to carry like a gangbanger, it's obviously better to have something with an external safety, but Glocks are some of the most commonly carried weapons in the world and people that carry responsibly very rarely have an issue like this. And if they do, it's because they broke some other rule of gun safety.

I’m an old lady from NC but I do understand the laws are different in NYC. BUT common sense should be universal. Even a suspended sentence would probably have been enough once the DA is given the circumstances around the incident. Like you say, we like to say “what if” too much. If he had hurt someone else it would all be different. That is the law. But he didn’t. He wasn’t. If a small sentence would be enough to keep him from ever doing this again, so be it. But two years??? People who DO hurt others don’t get that!! Raw deal period.

Agree. NYC Mayor Michael Bloomberg went out of his way to make an example out of Burress due to NYC’s stringent handgun laws & publicly called for prosecution & jail time for Burress. Bloomberg knew that it would cost Burress millions of dollars. There was a better way to handle this case & ppl should never forget that the some of the same politicians who speak of social justice today once spoke just as forcefully for mass incarceration & aggressive law enforcement to gentrify entire communities. Even conservative minded prosecutors will tell you that Burress went to jail because he was famous.

I’m a few months late but I did a bit of my own research and the only place I could find the part where he got fined for slapping a ref is on his Wikipedia page, and that specific part doesn’t have any citation. Everywhere else I can find says he was only fined $45000 - $20000 for unsportsmanlike conduct, $20000 for inappropriate post-game comments regarding officiating, and $5000 for throwing a ball into the stands.

As a licensed concealed weapons carrier, the law was broken when Plaxico carried the firearm without proper permits and licensing from the state of New York. Also, you can’t carry a weapon AT ALL (even when licensed) if any BAC content is present. As they were at a night club, I’m assuming Plax had some alcohol in his system. So again, the law was broken when he carried the weapon without a concealed carry license and was armed in an alcoholic environment while engaging in drinking. The shot could have EASILY hit somebody else. Then we would not be debating murder charges.

Because 2A says you can have a gun and carry it open or not because you’re an American citizen. Shall NOT be infringed. States have eroded that amendment with laws and restrictions for political gain.

I get that we have laws for a reason, and that someone else could have gotten hurt. But, that isn't what happened. I don't like punishing people for what could have happened. One of my biggest frustrations with our legal system is that it sees things in a vacuum.

As a gun owner who also carries often to protect myself and my family, I think that this story is freaking ridiculous. If he made an honest mistake (just like anyone else could) the fair thing to do would be a fine and maybe community service (if your firearm is registered) and no violent crime/crime record. Even if you had an expired registration (which is extremely dumb), a first time non-violent offense should be treated as a warning and be corrected accordingly. This was overkill to the max and also why I don't have residence in a state where they are hell-bent on disarming the responsible public.
Punishment wise, all that’s necessary in this very specific situation was a fine. Given the fact that he was otherwise clean and generally a good guy, the injury and embarrassment was enough of a punishment. Also, I appreciate you going into detail when acknowledging that Glocks have several internal safety mechanisms, soooo many people rock with the “GlOcKs DoNt HaVe SaFtiEs” narrative. I already knew you go DEEP on your research, but that’s a small detail that shows you truly do not miss details. Very dope video and amazing story telling, as always.
As an answer to the "Bloomberg punishment question " .... 1. Plax should have been given a hefty fine to be paid to a charitable organization... local Boys n Girls Clubs or something similar 2. He should have been made to do a series of PSAs about gun safety 3. He should have been ordered to take and pass gun safety and concealed weapons classes. 4. Community Service at local youth detention centers to speak against gun violence and possibly mentor a group of at risk kids. Case closed. No interviews.

In NYC it was all over the media for years about being punished for having an unregistered gun. It was used in criminal cases across the city for years. Burress messed up bad. We knew they would try to make an example of him. The local sports media dissected the case over and over. They talked about how the NFL had a personal security service (claimed it was a free service) and how he should have used it etc. The Giants through him under the bus by making it seem like he was a problem player by revealing stories no one ever heard about. He should have been smarter but I'm glad he's over it.
Bloomberg was one of those "law and order" types and had a stop and frisk law that disproportionately affected Black and brown people. I feel like Bloomberg throwing the book at Plaxico was the least surprising part of it given his history tbh

I understand, but this is case of no reciprocity where legal ownership in one state does not follow to another. Even should he had a CHL, they could get him on improperly displaying a gun in public, even if it hadn't gone off. I do think the prosecuting team went too hard, and could have gone for lesser charges.

I’ve watched football for 30 years now and I didn’t know half of these stories. FlemLo’s research is impeccable. He’s got a great knack for humanizing these athletes without necessarily asking his audience to either praise or condemn them. He tells their story and lets us come to our own conclusions. I met Burress briefly before he went to prison. I serviced his house in Florida doing pest control. As a Giants fan, I thanked him for his GW SuperBowl TD. Nice, down to earth guy. At least in my interaction with him. He was way more jacked than he appears on the field too. As far as the shooting, I felt like Bloomberg screwed him over. It was a freak accident, there was no reason to give him 2 years. He was embarrassed enough I'm sure. Slap him with a fine and let it go.
