When a joint owner of real estate dies, his or her interest in the property passes instantly to the surviving owner or owners. Before the property can be sold or mortgaged, evidence of the death must be recorded in either the registry of deeds or probate court.

HI WHAT ABOUT THE HUSBAND DIES AND LEFT A ESTATE NOT TO THE WIFE BUT LEGAL TO THAT PERSON CHILD WHAT I WANT TO KNOW IF THE HUSBAND DID NOT LEAVE THEIR PROPERTYS TO THEIR WIFE DOES THE WIFE HAVE THE RIGHT TO SALE THE PROPERTYS WITH A QUICK CLAIM DEED AND TOOK THE HUSBANDS NAME OFF THEIR PROPERTYS AND PUT THEIR SECOND HUSBAND NAME ON THE QUICK CLAIM DEED EVEN THOUGH THE PROPERTYS ARE IN THE ESTATE CAN THE PERSON HAVE THE RIGHT TO SALE THE PROPERTYS ANYWAY!
