It is possible they made a mistake. He needs to go to the interview no matter what. Take everything again and see what other documents they may want.

@AudraDoyleImmigrationLawyer thank you. He's definitely going to go if he gets the interview notice. He hasn't received one as yet, so right now he's just waiting. Also the I485 status changed to actively being reviewed after 6 days but the I130 is still saying interview scheduled, so now it's just waiting to see if the notice shows up.

Write a letter to the field office and call USCIS.

They should schedule her for another test. Good job on 5 right, hopefully she can pass the next time. My Octogenarian clients also have to take the test when required.

Dont worry you be ok i been waiting for a response since may 2023. I have no seen any updates on my case... but yea i pass both of my test and also officer had me sign on a tablet the oats and US certificate.. but still said they couldn made a decision yet... weird but true... so im still waiting

I guess mine kinda, did get improve we didn’t walk out with no paper or anything. The supervisor did sign off on a paper that we had to sign but other than that he was saying if you see some type of approval online but I’m still waiting.

It is typical for the system to not be updated in a timely manner.

There is a 5 year rule, unfortunately. You can consult with a lawyer to see if the officer if correct.

On the other hand RSC Africa told me to upload a certain documents on our first interview and they told us what is meant for this document you should be stated what you meant for this document and they are not indicating that USCIS is requiring certain documents.

I am so sorry to hear this. It is a huge problem. First, see if you can stop the Embassy from sending the case back by fighting hard to show why the application should be approved. Send a letter to the Embassy (e-mail) or call as a U.S. citizen. This is a huge problem and why I am hesitant to suggest F visas these days.

@@AudraDoyleImmigrationLawyer It has already been 2 weeks already wouldn’t it have already been sent?🥺. I wouldn’t even know what to say. I sent emails saying why is the reason and what can we do to fix it and they wouldn’t teply to us at all. They just sent that email to us saying it was revoked. And then i asked why and they said if i have any other questions to contact the department of state

Welcome! You need to submit a service request if the case is past processing times. Next I recommend start writing letters to the Field Office on a regular basis and keep proof of delivery, and finally, contact your U.S. Senator or the USCIS Ombudsman.

Oh my I am so sorry. Unfortunately if the officer says "refused" then you should expect the denial in the mail. You need to read the denial carefully and see if there is any room to make an argument for an appeal/motion to reconsider.

New update via email: The embassy said AP is complete. Still reviewing will contact for next steps. Oh. I thought refused in this case is because still in admin processing. No?

@@lynnbd182 For the state department, there is only approved or denied. Administrative Processing means denied for now, and they will revisit the decision. I would send a lot of good evidence and then ask what other info they need. AP can be for a national security issue, immigration violation check, background check, or an investigation about the relationship.

@@AudraDoyleImmigrationLawyerYou're so helpful. Here's the thing. I sent in great evidence. Pictures of my wedding. The witnesses there. Pictures with my step children. Affidavits from my son and my dad. He got one from his ex and brother. Like no fraud on our part at all. The CO was really picking with my husband. I use to work for the federal government. I kind of know how some employees behave. He tried to tell us, that my husband divorce decree is fake. No it is not. My husband is a business guy. He doesn't do any bad business nor do I . I work for the police department here in Indiana. Like no. It's so sad. I've been to Lagos six times all because I miss my husband and family so so bad. I provided proof of travel. My tourist and STR visa. My hubby and I even traveled to Abuja together. Showed proof of that. The embassy did say administrative processing is complete and still reviewing the case. Contacted with next steps. Does that still sound like a denial? I am going to fight them because this is not right. It is more likely than true of a bonafide marriage. So much evidence. Plus, they have to provide the evidence they used in their investigation. Also, they can't guess or speculate and use any prejudice. It has to be beyond a reasonable doubt that we committed fraud. There's absolutely no way they can prove that.
