You had mentioned that the trustee compensation is taxable. What if it is taken as part of a little higher payout from the trust. Example $1 million trust with three beneficiaries. Say the one ghat is administering it will take 1/2 percent or $50k with the knowledge of the other two beneficiaries. Then the rest, $950k, is split. So the admin takes $366 and each of the other two getting $317. As this is comfort the inheritance seems like non of this would be taxable.

What about sticking the IRS on the Wayward trustees, that have expensed everything stayed in expensive Resort housing, since that is all taxable income.. milked every single possible cost out of the estate in Arizona.. pretty much turning it into a full-time compensated job??? One of the latest is to require the two out of four non-trustee children to pay to indemnify them against future issues... Apparently because the contents of the house were not specifically mentioned, they can do whatever they want? ... in Arizona ...My parents were modest folks that had extremely good taste, a treasure trove.. When asking about specific items, some of us were told we were not entitled... The oldest son entire house in El Segundo California is packed, with those items. .. Fortunately my mother tried to move everything she could to transfer by contract, rather than someone's discretion..

Can you explain the tax impact on a foreign beneficiary, both retirement and non retirement accounts if the estate owner is a US citizen? What are the strategies can be used to minimize the tax? Assuming this foreign country does not tax on the inheritance from other country. I have consulted with two estate attorneys, but neither of them gave a satisfactory answer. Thanks

My dad passed away, leaving me and my brother to split his estate. A short time before dad died my brother was named joint ownership of his substantial bank account. Leaving only a house and car. Is there a way to get a judge to look at these accounts and make them part of the estate? He told me at first the money was part of the estate but the longer he had ownership the less he is giving me. I prepared the house for sell and have been maintaining it as I was told that would be part of my inheritance. Now he is changed his mind yet again and is only giving me half the value of the house.

Thank you Paul! Do you have any recommendations or insights into a fraught situation where two estranged adult siblings are the beneficiaries of a million dollar estate and one of them is executor and trustee? Mom refuses to appoint a neutral party to distribute the assets when she dies. Do you see this happening often and is there anything to be done to ease the situation for everyone involved? Thank you warmy.

@@JayN4GO ouch...so from a fiduciary standpoint they WANT to make money for the trust, so they keep claiming 1% on each principal AND income earned? They better make sure they're making at least 10 cents on the dollar lol

You didn’t answer the question!!! As the successor trustee, I was looking for the clue! Sorry Paul, this video did not help me which is in complete contrast to most of your videos. You basically left it at “it depends” which you stated you did not want to do! 😕

Typical situation answer: "most states have a fixed rate or sliding scale." - probate. "vague because no statute... Reasonable compensation." This is an answer. It depends on the situation. You must apply the situation to the trust as stated. This could be free to benefit to the taxes incurred or worth payment if it exceeds a certain amount and there is a fair amount of work. He answered it. It's just not an easy answer.

He totally did. From free for to taxes, or to s fixed and sliding scale. Reasonable compensation, usually. Apply a fair rate to the work required. He literally said, a fair amount might be half of the amount of a pro, and it is always subjective with the standard " reasonable compensation" wording and to communicate ahead of time. He gave a great answer. It's just not an easy answer and you have to think about the situation.
