Error @ 6.32 No 10% Law is applicable for becoming Leader of Opposition ! According to Salaries and Allowances of Leaders of Opposition in Parliament Act, 1977 , Leader of Opposition is the the Leader in that House of the party in opposition to the Government having the greatest numerical strength and recognised as such by the Chairman of the Council of States or the Speaker of the House of the People.

The act does not mention the 10% criteria. But an opposition without 10% seat usually does not claim the position.. And it is up to the chair of the house to make the final decision.. I think there are some rules (121(c)) which talks about some number equal to the quorum of the house which is 10%.
