It is, but just keep it on emunand and block nintendo servers and you'll be fine. Same goes for pirated games.

I don’t think it really matters, just do a quick checkup online if stuff like atmosphere and hekate are up to the date with 18.1.0 (currently the newest version) and then you can update, if it is I would recommend updating now. I update my switch from 16.1 to 18.1 today and it was a bit of a pain with some error codes so it could save some troubles. Also at the moment the newest version is up to date with the mods

Check if atmosphere says it supports the current firmware. Currently it supports 18.1.0 so you should be fine to update.

If you pirate games or cheat online yes

You will only get banned if you connect to nintendo servers with mods enabled and/or have pirated games. You can use wifi but you can't use Nintendo services until you disable mods.

@@brutal2417not necessarily true, client sided cosmetic mods are safe to use online, I mostly only use splatoon mods to play as rival octolings and wear edited clothes lol, it’s all safe since it’s client sided and only I see it

All homebrew should be made for any modded switch, oled or not.
