If a protest petition fulfills the requirements of a complaint, the Magistrate may treat the protest petition as a complaint and deal with the same as required under Section 200 read with Section 202 of the Code. If, there is no list of witnesses as such in the protest petition. The prayer in the protest petition is to set aside the final report and to allow the application against the final report. While we are not suggesting that the form must entirely be decisive of the question whether it amounts to a complaint or liable to be treated as a complaint, we would think that essentially, the protest petition in this case, is summing up of the objections the second respondent against the final report.
The aggrieved complainant file a protest petition before the magistrate as the police submitted the charge sheet FF as insufficient evidence.my questions is can the magistrate direct the police officer for further investigation?

Sir In my case police had filed closure report in the year 2017 so we filed Protest petiton Hon'ble Magistrate rejected the police report and passed the order for reinvetigation ....but we had lost trust on police since reinvestigation was suppose happen by the police only and accused are going to Manage them by giving BIG PACKETS 🙁.....so we had requested to the Hon'ble judge that plz don't send our case again to police for investigation and Keep the case with you and furtehr procced u/s 202 but Judge said order u/s 202 is not possible in your case coz already privious magistrate has given the order u/s 156(3) etc etc....is that true ??? 202 is not possible ???
Respected Sir , filing Protest petition is mandatory ?...coz in my case we have appeared sumoto after filing the Closure report ( Second) by police and opposed for Closure report of Police ....later on Judge was managed 🙁and she had accepted the Police Closure report and Disposed off our case 😐 .....Now v have filed revision petition N Now PP ( Govt lawyer) is saying you didnt filed Protest petition at the time of Police closure reports... so u can not go for Revision....and This Judge ( District Judge ) Can not hear your Revision petition etc etc is that true Sir ? Please Guide how to Restore the case which is Disposes of now ..... Plz.suggest the best Option ...since Accused r using Money power to Close the Case . Thanks

Sir, there is a case (u/s 420,506,304/34IPC)..ordered by the Magistrate u/s 156(3) to treat the FIR, but police submitted his report u/s 173 (2) to the Magistrate complainant want to file protest petition against this FR, but the fact is that one of the accused is the leader of the ruling party , that is the reason complainant's lawyer doesn't want to help the petitioner to file the protest petition Sir.... after receiving the notice...kya aapko apne lawyer ki help chaiye hoti hai..matlab yeh petition kiya petitioner khud Magistrate ko de sakti hai ya phir lawyer ke through dena parta hai yaa GRO ke through dena parta hai..??
Sir , In my case police had submitted closure report and it was rejected by the Hon'ble CJM court and the judgement was passed for filing fresh FIR since it was a M crime U/S 156(3) ......So Fresh FIR was registered and Further investigation was done by again the same dept.i.e. Crime branch since it is Financial Fraud ( we dont have seperate EOW dept. ) ....and again 2nd time also Police has submitted closure report by taking a birbe but this time judge was different and that lady judge has accepted their Closure report as Accused got successful to Connect the link with direct judge .....now what shall i do ?? Please Guide me on this .....Accused are using the system loop holes and managing system every time n keeping away to us from the Justice ....please Guide us on the same ....now v have filed revision petition in district court but this time also they trying to Contact PP to manage the case 😐😐
सर मैने एफ आय आर मे 2018 को दाखल किया था आयपीसी सेक्शन 363 452 504 506 323 और 34 सन 2018 मे मैने लेटर लिख दिया था पोलीस को आप आरोपियों का सीडीआर निकालो पोलीस ने मुझे लिखित रिप्लाय दिया की हम न्यायालय को दिखा देंगे चार्जशीट फायनल होने के बाद लेकिन 2019 मे चार्जशीट दाखल हो गई है चार सीट मे सी डी आर का कॉफी नही लगा हुआ है पोलीस बोलती है कि सीडीआर नही निकाला है पोलीस के ऊपर हम क्या कारवाई कर सकते है
