Creating a will and estate planning is not a do-it-yourself project. If you’re over 18, you should have your estate planning completed, and your legal documents created by an attorney.
If your will is not valid, it can create problems for your loved ones. If a will is not signed by the testator and the two witnesses in front of a notary, then the will has to be proven in court - meaning you have to find those two witnesses and they have to sign an affidavit after a death, verifying they witnessed the testator signing the will.

If the husband dies without a will and the wife is the survivor and has one child ( 17 now) from a prior relationship and the husband that passed has one child ( 25 now ) from a prior marriage. The husband had owned a home with his wife. What happens to their home. Does the wife inherits it at 100 percent ?

@Lovely-hb5vj, I am sorry if the person that passed was close to you. While I cannot give legal advice over social media, I can say that the situation you described is governed by Florida Statutes. When someone dies without a will it is called intestate. Florida Statute Sections 732.101-.109 contain Florida's intestate statute. Additionally, Florida Statute Section 732.401 explains what happens to a homestead when a spouse dies without a will. If you would like to discuss this further, please feel free to contact my office.
