What's next after Ohio voters pass Issue 2 to legalize recreational marijuana?

3News is answering your questions since the recreational use of cannabis is now legal.
Can employers drug test workers? Since Issue Two has passed, it does not come with or include protections for Ohio employees who use marijuana.
We looked into the ballot's language and found where it clearly states, "An employer is not required to accommodate an employee's use, possession, or distribution of adult use of cannabis."
Meaning the passing of Issue Two does not give employees a free pass to go to work under the influence of marijuana. Issue Two also does not prohibit an employer from "refusing to discharge, disciplining, or otherwise taking an adverse employment action against an individual because of that individual's use, possession, or distribution of cannabis."
Akron Attorney at Law and former Assistant Attorney General Adam VanHo tells 3News, that with recreational marijuana use now legal, certain professions will likely be under even more pressure like healthcare professionals and law enforcement.
"You're going to see a lot more testing in medicine and law enforcement. In medicine, you'll see more testing because of the fact that there's going to be constant questions if something goes wrong on an operating table or medications aren't prescribed correctly," VanHo said.
He added, " In law enforcement because you have officers carrying weapons and traditionally those haven't been areas that have been tested in the past, but I expect them to be tested more in the future."
Another question with the passing now of Issue Two -- What will the new law look like for drivers and what possible penalties those could face for getting behind the wheel under the influence?

It's ridiculous employers get to drug-test their employees for substances such as Marijuana. Marijuana stays in your blood/Urine for up to 60 days, sometimes longer. If someone is smoking crack it won't show up on a drug test one week at most for urine, 24 hours for blood. Marijuana should not be something that disqualifies someone from passing a drug test.

I imagine it wont effect you applying for most jobs except stuff like operating heavy machinery or hospital staff stuff like that where you gotta have a more clear head space and fast reaction time

@@TheRealRusDaddy Heavy machinery should be the exception. Something that can put you in harms way if you're even a little bit under the influence. But for your average office worker, it's ridiculous to have expectations to not smoke marijuana when not working in your own private space.

Drug tests only test if you have smoked in the past few weeks. Not if you’re high on the job. Using marijuana recreationally won’t indicate if you’re abusing it on the job. Truck driving and heavy equipment operator are two professions where someone may need to unwind after work. It would be suicidal to smoke on the job. Being a user don’t make you an abuser.

Crazy that politicians have the audacity to say they will change the law AFTER the citizens vote for what they want. Why do politicians get to impose fascist laws on us? Straight up tyranny. During COVID we had laws placed on us by politicians and media pundits "in our best interest" despite not being based on fact or science. Today they apologize and say they were trying to help. Here we are again with marijuana -- you don't have direct negative impacts on health and you don't have easy access for minors. Just like a bar, children/minors can't just enter a dispensary and purchase marijuana. All the arguments they use are strange circumstances referencing driving or a child using --- why are we looking at a small percentage of negative outcomes versus the calmative benefit as a whole for everyone? Those against or politicians trying to embrace control need to study from other states (23 of them legal) and their colleagues in those states to see how the plant has benefitted their state. If you choose to drive under any influence you'll face consequences. Don't place consequences on us all for the actions of a small portion of the population. How many DUI arrests each year divided by the Ohio population? Less than 1% just like covid deaths -- so don't demonize us all for the actions or negative outcomes of a small portion of our society.

Protection from discrimination from marijuana use will be the next obstacle for our citizens. California did great by making a law protecting employees and applicants from this. You don't have employers firing people for home use of alcohol or tobacco. We need to end the overarching political control of personal decisions --- especially those that revolve around what we do in our personal time.

Even in Michigan, there are employers that test for Mary Jane. In my business class, my professor started to talk about the decline in people wanting to work as CDL drivers and other hard working trades. He is an older dude who likes whiskey, and has expressed his disdain for the Mary Jane. I said, no one wants to work where they cant have a work life balance. Boys would rather make less money a year and go home and smoke weed. If there are not enough people who are interested in peeing clean, the laws regarding these types of jobs might change one day. Or they’ll continue to pay cdl drivers 110k at Walmart! I mean that’s a ton of money, my mom who is a senior level accountant only makes 100k! But she gets to smoke weed when she comes home lol

Don't understand why all the negativity around the subject. I use medically for Ibsd pain, chronic groin pain, ptsd and anxiety. Been many times I couldn't function without the help of it.

I dont smoke because I have a job. But i just didnt think it was fair that other states legalized it, and our state acted like they were protecting us. As if we are children and not adults. Same with gambling. I dont gamble either, but fair is fair. This is America. Land of the equal and free right? Thats BS. Free Texas. Indiana. The Carolinas.

Its simple. If a company wants to test don't work for them. Plenty of jobs out there. They can't keep employees anywhere now as it is. If employers want to keep the people they have or potentially poaching great workers from their competition the need to stop testing now and embrace the change people want.

It's not exactly a big hurdle to pass a drug test on short notice. Only a few days is required to pass it naturally. Other methods can be used to expedite the process

@@andrewbrock4636 two issues, if you get a blood test it absolutely will show up even after weeks, in certian workspaces they can in fact require you to take a test urine or blood within 24 hours.

Freedom. I live in VA and the change has been great. Realistically nothing changes. People who use already use, and have been for a long time. We drive, work, and live daily lives. Just because a law is passed doesn't mean the sky is gonna fall. The only thing that changes is that the law is not irrationally ruining peoples lives anymore. Employment testing is fine with me. My local city government changed it's policy. All city employees are allowed to use except first responders, meaning Police, Fire, EMT, and certain positions like engineers. This is the Way....

No, there's a 30 day grace period that's in place so technically the first dispensaries with authorized recreational licenses that have been given out will be the first ones to be able to open at the Dec 7th mark after 30 days have passed. There's also the matter of it going through the State House with edits having been made by lawmakers.

Sure employers can test, but they may be disqualifying qualified people. Qualified people won't even interview. When they disqualify for Alcohol then it would make more sense.

States that legalized still have medicinal marijuana laws. The difference is one requires doctor (medicinal) and the other is recreational. Medicinal often get benefits such as being able to purchase and possess more and sometimes discounted products at the store. In short, no this doesn't do away with medical marijuana.

There is no law that says you can't drink and own a gun. There is a law that says illicit drug users can't purchase a gun. However, this law was recently deemed unconstitutional by a federal court.
