I think,you wrong about the Supreme court,the arguments does not satisfy the legal requirements under witch the courts can strike down the 8th amendment of the constitution, the Washington post has recently disclosed they have been sitting on alitos flag controversy case for 3 years,if the post is acting as an advocate here,well then alito will be out before the Supreme Court retires for the summer ,without the full court pending cases will be impacted including Trumps appeal if any coming out of this fiasco.
