That kid's first mistake was wanting to play an LJN game.

He settled on a game: LJN’s Major League Baseball Me: Oh no...

They probably later mailed him a picture of the duck hunt dog laughing.

I remember my mom bought me Ghostbusters on the NES at Toys R Us and when we got home, I was so traumatized by its awfulness that we returned it, no fuss. They must've known.

So the family sued Nintendo because the box failed to accurately represent the game. What would've happened if the kid had bought the original Mega Man?

We were poor in my house. My dad only let me sue Atari. I was always jealous of the kids that got to sue Nintendo.

I had that game as a child...I remember being confused by the roster too. I also recall a glitch where you could get your players into the stands...and the ball physics were pretty wonky.

What is funny is if someone released an MLB game today, licensed by the MLB and it did not have any of the players on it, people would lose their minds and it would be destroyed by reviews.

Everyone should learn a lesson from this story: never buy LJN games.

This is why back then if there was a game I thought looked like it would be great, I'd go rent it first. If it sucked you were only out the $1 (what it cost back when I had an nes). That's a lot better than being out $30, $40 or more in some cases. One place I used to rent from was even nice enough to let me switch if the game was really bad (no longer in business unfortunately).

My gosh this is like suing the writers of a cartoon because the plot didn't go where you wanted it to. XD

I am sorry. I remember that game. As a 14 year old sports fan. Being a NYer I was a Yankee fan to be specific. We were absolutely amazed there was a baseball game with real teams and "Numbers" to represent players. We passed it off as the limitations of the system. Even though that wasn't the case. We were happy none the less. Yes, bases loaded was the better game. But real teams and real players ... can't beat it. *And I do not believe for 1 minute the lawsuit was the kids idea. I think it was entirely the fathers idea when he couldn't get his $39 back. I wish I knew him. At 14 with my paper route. I would have given him his damn money and happily taken the game off his hands. But hey. Maybe he should have bought RBI baseball that had the real player names and not the real team names. It just seemed the league and the players unions were not on the same page in the 80s. But each game gave all the players and teams. Just with different ways of handling the lack of licensing. The lawsuit should have been towards MLB and the MLB players association. Not Nintendo. And even if they did sue them. Their lawsuit didn't have a leg to stand on. *And for the record. That kids Dad was an ambulance chasing Sheister just trying to make a quick buck thinking he would have the people on his side. But the reality is ... the people saw him as a cheap crybaby trying to leech off the success of Nintendo. **Furthermore. The ambulance chasing sheister asked for punitive damages. When there was no damage at all. If his claim was 100% truthful. His son was not scarred from the experience. Instead he learned a valuable lesson. That lesson is research before you buy. And before people say, "There was no way to research back then". Nintendo power. Game Informer. GameSpot were all available back then. Also ... video game rentals were a thing back in 89. And every town had 5 Video rental stores. And everybody and their mother had a membership to those stores.

So this continues to affect sports video games even today. whenever you boot a sports game, one of the flash screens that shows during loading will say when the rosters are accurate as of. Sometimes it’s on the packaging as well.

This kid was way ahead of his time, imagine if sports videogames worked like today back then with the limited 8 bit technology. He definitely didn't know about development time and hardware limitations, but cared more about a player full name and current team. This is why I'll never understand sports fans...

Imagine making your kid collect garbage to buy a game then being a lawyer wealthy enough to sue an international company

Aka when you have a cheapskate father, and they would rather sue then take a $40 hit. Kid literally had to save trash for years to buy this, and his dad is a lawyer? He wouldn’t buy a game for his son but he will launch an expensive lawsuit that cost him 10x over. Makes sense.

It's messed up how that newspaper casually suggested that child abuse was a normal response to kids saying something silly.

as a lawyer myself, I would have approached the legal issue differently. actually I would have come to an out of court resolution. 1. not make it a class action... the court and Nintendo did not want to open the flood gates on this or future cases. the plaintiffs shot themselves in the foot there. [if they had approached it as a single plaintiff, they could have settled out of court] 2. this was more of a contract to buy issue. there was not a meeting of the minds, a term used in contract law. the kid bought a product thinking by what was presented there that he could do certain things key to game play. with these aspects missing the purchased item did not meet the reasonable expectations of the buyer. plenty of case law to support this going back 143 years plus. my guess is that both the store clerk and the dad got into it, dad got angry, tried to sue and tried to bring maximum pain and damages to Nintendo, hence the class action suit. which backfired... all of this could have been avoided by all parties coming to a reasonable agreement. store credit, to be used within a set time, and a reasonable restocking fee 10% to 15% if the product was not damaged and in good resale condition. all parties get some relief... that is how the law was originally designed to work... not the bastardization it has become today.
