If they don't have a proper warrant, no matter what they find, it can be thrown out in court. If the warrant excludes your personal safe, and they open it any way and find 10 pounds of meth, they can't use that evidence against you in court. That's not to say they couldn't then get a proper warrant and get you for a crime on OTHER evidence later, since they'd have something to go off of.

Remember: Lawyers do everything by procedure. The information you get in this story is procedural guidance, i.e. this is what you should attempt to do in this situation (if reasonably practical). If it comes to your word against theirs, procedural violations count for a lot. Particularly when they allow your attorney to show that you are a model citizen who was unjustly accosted by a rogue cop, and if the jury doesn't side with you, then they could be next.

Yeah I'm really confused by this part because if they come in and look for a suspect in a drawer and find coke and arrest you I doubt claiming they broke the 4th amendment would work very well in court. They broke down the door to my hotel room and yelled get tf down I thought I was being robbed by guys with machine guns at first they never said they were the police If I had a gun beside me I would have used it for self defense thinking I was trying to save my life and would have died and that’d been it. @@pepperoni_rolls1327 technically speaking while a warrant does overrule your consent, in the situation described in the video, it was after seeing the warrant yourself, and perceiving the conditions within the warrant. If the searching officers search areas that aren't permitted within the warrant than it's considered fruit of the poisonous tree and is therefore not only obtained by non-legal means but also not able to be used in court or any criminal proceedings. The video is giving real info if you had any background knowledge to perceive it

They will probably force entry if you continue to talk and not open the door , especially if it has to do with murder or some big drug charges, I don’t think that asking them to slide the warrant under the door would help in these cases.

This has literally happened to me. I had swat kick in my door looking for someone that escaped warm springs, "a mental hospital near me" I had in in camera and they confiscated it and denied it in court

I did this before but they refused to slide it under the door. I then opened the door and they waved a piece of paper in my face. I let them search cuz they thought I looked like a guy who robbed a place because of being 6ft tall and brown hair . Kinda irritated though because I shouldn't have to do it just cuz im innocent

Bad advice. Be in the room. DO NOT LET THEM SEARCH UNSUPERVISED. Don’t answer questions, don’t engage, be polite and professional, and remind them of the restrictions of the warrant if they start straying.

It’s also illegal for cops to arrest you even if they see illegal substances, they can only arrest you if they find something inside of the warrant, but if the drawer is already open or in a space that can fit a human and they see it than it’s legal for them to arrest you

Your point? Your still innocent until proven guilty, with the right to remain silent if your guilty. They also still need a warrant to go in your home.
