Just to get back at Marvel DC should create characters called: Private Marvel, Sergeant Marvel, Colonel Marvel, Admiral Marvel, Commander Marvel, General Marvel, President Marvel, Prince Marvel, Princess Marvel, King Marvel and Queen Marvel.

Billy will always be Captain Marvel for me, mainly due to the popular superhero parody here in the Philippines called Captain Barbell. He's this frail teenager who turns into a super-buff hero whenever he lifts his magical barbell and yells "CAPTAIN BARBELL!" It's beautiful.

MysteriousTomJenkins I pointed out in other comments that it was a lot of little things that added up. But the biggest one probably being how Roscoe Kent Fawcett told his team to specifically create a Superman character, only make him a boy. That definitely hurt their case.
***** I did hear that and figured that would hurt it but it's still not really much of a rip off. A similar costume and similar powers but their origin, powers, alias, and stories are different. Sounds to me like they were simply mad Captain Marvel was a bigger hit. I noticed that when ever him and Superman are in any sort of conflict Superman wins easily or Cap is taken out easily, at least from instances I have seen.
It's funny because it's actually the costume, powers, alias, and stories that were the biggest factors in showing that Captain Marvel was a ripoff. The costume is the weakest to me, it's just a hero that wears red. Big deal. But the powers were pretty similar. You have to remember at this time Superman only had the power of super speed, super strength, and invulnerability. Captain Marvel basically mimicked those powers with the added bonus of him flying as well. The aliases was similar too. Both Clark Kent and Billy Batson worked in the newspaper industry. And the deciding factor in the trial made by the judge was that the stories told in Captain Marvel and Superman were too similar. In this case, it was simply a lot of little things that added up looking bad for Fawcett.

As I knew the DC version first as I recall, SHAZAM was an anagram for Solomon (Wisdom) Hercules(Strength), Achilles (Courage), Zeus (Dominion or power), Atlas (Stamina), and Mercury (Speed). we learned this in the old 80s cartoon intro.
Personally I hate that the Marvel movie is being titled Captain Marvel. Mostly because (like im sure plently of people), I always knew her as *Ms* Marvel. And I was one of those who actually know "Shazam" WAS Captain Marvel. So in my opinion the new movie should REALLY be called Ms Marvel, not CAPTAIN Marvel.

raggarharry I don't believe that's the case in the New 52. He has to say "Shazam" like he means to transform. But back in the day with Captain Marvel Jr., he transformed by saying "Captain Marvel" and he couldn't say his name because of it.

Vicktoria Thomas I think it depends on the tone and volume of his voice. If its a casual way of saying "Shazam" it wont activate the spell turning him into billy and vice versa, but if he said it in a loud more serious tone like "SHAZAM!!" then the magic would turn him back and forth. Well thats how I see it as anyway.
Shazam/Captain Marvel is an awesome character IMO and I will never see or be able to take any other character of that name seriously. But to be quite honest the name Shazam is growing on me, and I've always thought Marvel was a lame name anyway.

I acquired a copy of the limb-splitting guy. To be fair, his backstory isn't too bad. A sentient alien robot, posing as a college professor (remember James Marsters in Smallville?) here to observe humanity, and he is committed to helping out where he can. There was a disturbing aspect to a story in that issue: there were 6 booby trapped pens out there and he had to retrieve all 6 before it was too late. The hands had an easy time of grabbing pens, and his head grabbed one in his teeth. I don't know his legs grabbed pens since he wore boots, but I have to keep pushing out from my mind the image of how his torso must have grabbed one.
shazam is one of my favorite heroes, and while i had always known him as captain marvel, i honestly like that it's going to marvel, even if that is entirely because of the name Marvel.
Actually Captain Marvel was originally called Captain Thunder, until Fawcett comics learned that they could not trademark the name due to it being the title of a historical-drama released by Warner Brothers nine years prior. Because of this the characters name was changed to Captain Marvelous in the second issue which the editors shortened to Captain Marvel. This also lead to DC briefly creating a character named Captain Thunder pre-Crisis in the mid-70's after they bought out Fawcett Comics so that they could publish Marvel Family characters without continuity questions. This is why the Character in Flashpoint was called Captain Thunder, the six kids also traced back to the character's original concept of a group of six each with a single divine power

Fawcett Comics should have won the Captain Marvel lawsuit. They had the Captain Marvel character and the Captain Marvel name first. That was really stupid of DC Comics for stealing the rights to the Captain Marvel character and changing Captain Marvel's name to Shazam. And that was really stupid of Marvel Comics for stealing the rights to the Captain Marvel name. DC and Marvel need to be sued. And by the way, Shazam is the name of the Wizard, not Billy Batson's alter ego. And the Shazam family is called the Marvel family. And one more thing: Billy Batson is 12 years old, not 15 years old. The reason why Billy Batson is 15 years old is because his origin was rewritten by DC Comics.
Dustin Nunn 1) Fawcett lost the lawsuit because Captain Marvel was too similar to Superman, who was created way before Captain Marvel. 2) DC had to change Captain Marvel’s name to Shazam because, by the time they purchased the rights to the character, it was already trademarked by Marvel. To be able to use the character, DC legally had to use a different name. 3) Marvel didn’t steal the Captain Marvel name. It was up for grabs at the time, before DC realized that they wanted the character. 4) Since DC cannot call Shazam by his original Captain Marvel name, technically Shazam is Billy’s alter ego. Sure, comic purists may prefer to call the Shazam family as the Marvel family but DC cannot refer to them as such for legal reasons.

I love Captain Marvel for many years. She’s absolutely the best pick from Marvel to take on the mantle. The name in marvel has a meaning, a legacy. It’s not just thrown there. Also, it means a LOT more when he character who use the Captain has a meaning, a history to it and a military background. She has all of that. She is a woman of Air Force, a Colonel, somenone who made her name and her own legacy ( Ms marvel kamala lives it) and was already living the legacy as for her being Captain Marvel is being your best version, the best you can be. She’s so inspiring and has overcome many many problems like prejudice for being a woman, had powers and memory stolen, abuse, alcoholism and had even sacrificed herself to protect Earth. That’s what a hero is about. My CAPTAIN. Shazam fans should accept the mor name as it fits very well to the caharacter and learn that the hero makes the name, not the other way round.

I'm surprised you haven't gone over miracleman aka marvelman who was created in the uk because Fawcett had reprinted many comics of captain marvel. When dc comics put a stop to captain marvel, they had recreated captain marvel as Marvelman, making his powers science based instead of magic.
Mar-Vell will always be THE Captain Marvel to me. Carol Danvers is great, but I liked her as Ms Marvel. I suppose that she is the best option to step in and take up the name since Mar-Vell's death, though. Shazam is cool too, but his name is still Shazam (sorry, DC, you missed it).
Personally my favorite is Rogue whom permanently absorbed the powers, memories, and the actually psyche of Ms. Marvel (Carol Danvers). Rogue always fought with the multiple personality disorder of Ms. Marvel trying to take over Rogue's mind and body and Ms. Marvel always haunted Rogue! If you can't tell I've always been a HUGE X-Men fanboy! I was always interested in the X-Men vs. the Skrull/Kree crossover galactic battles and seeing them meet the Starjammers in space and meeting other characters like Deathbird, Guardian, etc. while fighting enemies like the Brood, etc. This would make a HUGE new opportunity for Marvel crossovers in space besides just Infinity War/Infinity Gauntlet where you could have a crossover with the Guardians of the Galaxy too! But if I had to pick my favorite actually Captain Marvel it would indeed be Ms. Marvel (Carol Danvers) herself, sorry DC and Shazam! But to me having a DC character called Captain Marvel always puzzled me even when I was a child reading comics in the late '70s up through the '90s which during that time he was called "Shazam"! I don't really know anything about the new Ms. Marvel but I'm not really feeling the new change to a Muslim Pakistani teenage girl, I have no issues with Muslims or Pakistani but I'd rather see them create a whole new stand alone character and I'd rather see Carol Danvers get separated from Rogue and resurrected as the original Ms. Marvel! To me the original Captain Marvel would be the Kree superhero from which she got her powers from!
For me, Billy is, and will always be the Captain Marvel . No character with similar name comes even close to him. It's kind of sad how it lost its name to Marvel, and now it's almost impossible to regain this name with Marvel introducing Carol Danvers as Captain Marvel in MCU. I wish they had gone with Ms Marvel, and Billy got to keep Captain Marvel.
Wow. Based on the comments, Batson is the runaway favorite with Danvers a far, far distant second. But, for me, Make Mine Mar-Vell! He was perhaps the first comic book character I ever fell in love with way back when he was a simple Kree captain in that gawdawful green and white uniform. in the 70s before DC owned the rights to Captain Marvel, they created a character in Superman named Captain Thunder, who was looking for Whiz radio station , but only found the Galaxy Building in Metropolis. He and Superman fought, but saying the word Thunder turned him into a young boy named Willie Fawcett. It later turned that he was from a parallel world and had been brainwashed by an enemy to turn evil. Everyone knew who was being referenced, by the obvious clues, but it was a way for DC to have the two heroes fight (and Superman win), a few years before they won the rights to the original.
I think he should be called Captain Shazam. It’s still catchy and it means that you can differentiate between the different characters. Ms Shazam, Captain Shazam Jr, etc.
It will be interesting to see in the upcoming Shazam movie if the Wizard pretends to be Billy's friend on the streets that would always refer to Billy as "captain" O_o

In my opinion whoever has the character that was created first should own the rights to the name. So being DC’s Shazam aka Captain Marvel was created way before Marvel’s Captain Marvel then DC should own the rights to the name being their character was technically created first.
For Me the so called SHAZAM will always be Captain Marvel. I'm Ol School as they say. I use to watch the TV SHAZAM! series of the 70's and I got the chance to watch Adventures of Captain Marvel serial of the 1940's. I can't change that. He'll forever be Captain Marvel just like Carol Danvers will always be Ms. Marvel to me.

Shazam was given powers from greek gods, he was also known as Capt Marvel, this was in the 70's for me as a child. Then came another capt marvel, danvers, sister or cousin of kara (supergirl) and seems Like 2018 movie will run with that, God I wish the Marvel and DC movies would keep the story lines correct, ruining my childhood of comics.
Reading the comments, I find I am more favorable of Carol Danvers becoming the new Captain Marvel. To be fair, I first knew her as Ms. Marvel but I love the idea of Carol Danvers being Captain Marvel because I personally like progressive movements in comics. Besides, we have a new Ms. Marvel named Kamala Khan. I never really cared for Billy Batson/Captain Marvel/Shazam in the end. Probably because I never grow up knowing the character or recognize the fact that he is literally a kid transformed into a man's body and watching the X-Men film series and the Sam Raimi _Spider-Man_ trilogy as the years pass. I cannot wait to see Marvel Studios and Brie Larson will bring to the character. I hear they will create a new origin story for Captain Marvel. We'll just have to wait and see.

I actually like Ms. Marvel's conception. A love interest, then becomes the hero's distaff counterpart, then became a main member of the Avengers to the point she's a close personal friend to Captain America and Iron Man, to taking her ex's name and owning her own comic in present day, complete with a girl so inspired by she took her old alias. Kind of a shame MCU will take a different spin of her character, considering they don't want her story to be similar with Green Lantern.

From a black-haired white guy superhero who wears the color red and is super strong, fast, and durable (at this point in time, Superman only had those three powers. No heat vision or super breath or anything like that), plus mix that with the fact that Billy Batson worked selling newspapers kind of like Clark Kent working in the newspaper industry as well. It was a bunch of tiny things that just added up.
MonarchsFactory Horror/fantasy writer Manly Wade Wellman who wrote for Fawcett at the time testified in court he was instructed to copy the Superman formula for Captain Marvel. Wellman who also wrote for Wil Esiner's The Spirit, always had disdain for his comic work & considered it an easy paycheck in-between his "real" writing, which at the time was stories in the pulps.
Black Silver Other companies can use it, but they can't advertise or promote anything using that word. That's the nature of a trademark. We can all write our own comics that contain the word "superhero" inside the story, but we can't use it as the title of the story or for any other promotional purposes.
