Best explanation ever! So, not only does one have to be mindful of beats sounding alike... how the melody arrangements are used is important as well. I'd suggest chopping is the best way to avoid this from happening: try using one measure of the eight, or chop them and rearrange; merge one bar of the sample with another, to create something different. Everybody wants to use what they hear in the sample track... but, the creators of the samples wants the users to tear the samples apart to create something new! This is called Arrangement: re-arranging something that already exists, to create something totally different. Speed or slow the segment(s); change the root key into a note in the root key chord to make a different frequency within the sound. Lastly... use effects: because this will help in not sounding like the original sample; Learn to use your mixing tools. The only hard thing about mixing is, letting go of the belief that you can't do it! I was 55 yrs old when I got my DAW; it dawned on me that in January 2021, I was now mixing. I had grown into my craft. Be patient... and search for what you need; it won't happen without your own effort. Keep Chopping!!! Peace

Another way to maybe get around this is to take the melody, pull it into Ableton and turn it into Midi (or do it by ear), and use a different instrument. Or, chop up the melody like you say and change it somewhat, or change the pitch of it, or anything. Just dragging and dropping with making any changes to the melody sets you up for copyright issues, but I believe can be resolved if you fight the claim and state that you used a royalty free loop. But who's got time for that? : )

This and another video on this topic I just watched have marked the end of me using full vocal acapellas and/or full melody loops off of Splice and Arcade. On top of that, here is my recent story. I have just finished a song, one of the very few I am legit MEGA proud, and it's in the genre I usually don't write much (Alternative Indie). So I submit that on Labelradar, and one of the big labels actually liked it. I was like 'F**k me sideways! No way! Wow, this is it, I made it!!". But then... as the conversation with them continues, they ask where I took the vocals. As soon as I mentioned Splice, they had to reject it... And they were right because they had to protect the copyright of their artists and the viability of the label's channels. Anyone reading this, hope this gives you a spark of motivation (like it did for me) to actually put more effort in making certain elements truly your own :P Stay gucci

They also were not interested in your instrumental, but the vocalist. So u wasted everyone's time, I think you know what 2 +2 is. I honestly call BS. Even without that, it's evident they were interested in the vocals if the story was true ( which it is not ). Stop blaming plugins and companies for your lack of understandment. You wanna be a big shot indie man who made it? ( Even though that in itself is controversial ) then do the work and don't lie to yourself. You can use melody loops. Just halftime/reverse/pitch/chop/change the chord progression.

I usually run a loop through melodyne and change it a bit if I ever use a loop from splice or anywhere else . That small change will save you a copyright claim .

I failed to mention that these kinds of run-ins are bound to happen, not only because so many are using the same samples, but due to the style and concepts. You can go only so far in Rap music, that's why it all sounds the same. Learn to create different styles of music... like, thinking outside of the hood and hood-life. This is how to become a music Composer, Writer, Arranger, Producer, Musician; you have get out of the BS Zone of thinking one way Mind Control. Love on all music and it will, love you back... its a universal langue, and you speak to all cultures when you create in the genre the music belongs to. Hope I made sense. Peace

In my opinion: it's alright to use drum loops, SFXs and one shots. But it's not OK to use melodic loops. The melody of your track is the core and the identity. Everybody wants an identity. Nobody wants to be fake. You should always make your own leads and melodies imo

Yes this has happened to me. With both Splice and several other samples sites. The answer to the problem is to be more creative. Don’t let the sample you chose take the spotlight in your songs. You could chop it up, reverse it, reverse the chopped samples and arrange them in reverse again, or try some of my favorite techniques. I like to run the sample through a delay while I twist the time knob back and forth then pick your favorite parts from what you recorded and cut then out to fit your track. From there you can either leave it at that and find a neat in the samples you created. Make sure to keep the delay in sync mode with your track though. Another favorite of mine it to let the sample or even my finished track play in a sample like kontakt and use a real keyboard with midi to play it it in the original key and pitch. Then work the pitch wheel up and down during parts that sound good being shifted up and down like hi hats and snares and piano or strings. Maybe some vocals but be wary not to go overboard with it. If you don’t like your track being slowed and sped up during pitch shifts most samplesers now have a stretch or pitch setting to change to your preferred taste. Also make sure your pitch wheel is shifting between notes in the key of your track. Set it to go up and down 2 notes and try that first. Another is I like play some samples through my battery powered fm transmitter and pick up the transmitted music through a handheld ham radio that can receive fm signals and record the sample that comes from that. It cuts the bass very hard and makes it sound like you’re hearing it through an old telephone from the TDM days. Try using something that isn’t normally used for music or use your music stuff in a way that it was never designed to do. The results fail often but sometimes they win and win big. Give it a shot guys. Don’t just drag and drop. That’s not making music. That’s just playing with premade music. We grow out of it as we progress typically anyway. Good luck you guys!

The proposed solution is without a doubt a great one for people who aren't good at making melodies. Something else you can do if you like to use loops is alter it to sound completely different than the original. Chop it, reverse it, rearrange it, put effects on it, slow it down, speed it up. And even if you do get a copyright claim, you can easily dispute it by saying that you both used a royalty-free loop and the person who's claiming the copyright doesn't have the rights to. I've done that before and it works. Go make something great!

Yeah but if someone got it placed then I personally wouldn't want to use a sample that has already been solidified n the industry unless you chop it up a lot and make it unrecognizable like you said. @Vollarti There's nothing wrong with that approach at all; that makes complete sense. For me, even though I've heard other people use some of the same loops that I used, that's never stopped an artist from leasing any of my beats. Almost all of the artists I've happened to work with don't care if I used a loop or if everything is original. Of course, everyone has their own experiences. I'll check out the video too!

splice & loopcloud are the future of music no matter how much you generate original content there will always be someone who did it first the important thing is the combination, the composition and not just publishing the beat but the final production with the singer. And if they claim you, you defend yourself, it's royalty free. Today you can rent beat and several artists can have the same music on spotify, youtube etc. In 2022 that is no longer a problem, it is just an adaptation process, the only thing I recommend is to maintain your subscription with these companies so that when it comes to demonstrating that they are free they support us. Excuse my english but i don't speak the language use the translator

You’re assuming that something is going to be a hit so you’re paying someone who either owns the copyrights or they are paying a lawyer. I say make the hit first and worry about who gets paid later.

Either your music would get taken down or you would get sued if you didn’t clear the sample Samples on Splice are created for Splice and not recycled material like “crate digging” vinyls or CDs

@@HaeloThere I still don’t think small artists need worry about clearing samples. Make the song. Make it clever sample or no sample. If you have a team let them hear it and advise. The other option is just to make original music learn theory and practice the lost art of patience.

Ive never had a copyright claim last longer then 15 days after disputing it... Just write you have a membership to wherever u got ur sample form and you need the copyright claim blacklisted

Very true in terms of RU-vid being quick with disputing claims. I don't think it would fly with labels if it becomes a big hit though. Not the best move to use something that has been established. If you flip and chop the sample so much that it isn't recognizable and create something new then sure do it. Doesn’t matter if you get a claim on a splice beat because they will have a non exclusive license- you can dispute the claim and squash easily on RU-vid by ticking the license option on the copyrighted content. You will need to have bought it on splice though and have a license to use it yourself - no panic required just administrative.

That’s one of the reasons why I don’t mess with pre-made loops. The other reason is because I like to create my own melodies from scratch. If I were the type to mess with loops, it would either be from sampling a loop myself or I would chop up those pre-made loops. I rather mess with one shots and come up with my own thing and avoid the headaches.

I think the solution to this would be to disagree with which ever platform raises the copyright issue. They usually ask if you have the rights to play this song, which you would answer yes as all the sounds are royalty free.

The "copywrite claim" one got me months back when I published a song I made called "Get Over Here" which had a sample I've used from looperman. Because of said BS claim, I literally deletes the song since I had neither the time or patience to deal with crap like that

I was wondering when these non-musicians would run into royalty and copyright / copycat infringement issues. Your explanation is simple. Hiring a real musician whom can write and play a real instrument preferably from piano. That's the best start. You can download any type of sample. But it's not yours to use in a commercial forum. And if you didn't get publishing rights and permission - get a good lawyer.

I respect your view.I wish you gave a clear example of an arcade problem as well. The reason being is that when you bundle up different companies and say they’re alike,you then put a damper on something without knowing if it’s true. now unless you have something that’s true towards an arcade loop or arcade sounds, I don’t take this as gospel according to arcade. I’ve heard of splice issues, but they weren’t really heavy simply because they’re used by so many and they generate money in the music industry.now in terms of RU-vid that is probably different but that’s probably also because the sound hasn’t been manipulated to your own way.

Really interesting... So it will be the same logic for the loops of Cymatics or others. But my question is: If i'm are not good in melody and you don't know anyone in the beatmaker game, it seems really problematic (if on top of that the loops shops don't give you any guarantee, concerning the rights). We have never been as free as in the past but in opposition as slave in this new Rap 2.0, because of all this business.

There are people saying that they got rejected just for using splice. When you try to get beats placed for artists or on tv they avoid splice. Go on the clubhouse app and go to my video where I have an A&R come on my show

@@Vollarti I have ran into the the tv submission thing. I've seen ppl who don't want any samples or loops used so they don't run into clearance issues. But it goes back to how flipping and layering. I flip, I drag and drop, play keys whatever

aaaaand thats why u take a loop/midi and change it to make it unique. If u just drag and drop of COURSE ur chances to get a strike is going to happen. Same method with any loop or sample....

Yeah but there are people who still get caught. Look it up in an app called clubhouse where all the A&Rs for record labels are they talk about this all the time. If you chop it up and completely switch it with gross beat or another program yeah you can use the splice. You just would have to be careful for legal problems

Splice now allows you to generate a certified license for a loop you downloaded.

I chop and screw everything so much that this would never be a problem for me. The samples are still useful even if you're going slice and smash them.

The problem is the right now no matter in what key you play that loop...is a big problem and affects a lot in your releases even if you are so interested to have your song or track on facebook id or youtube content id library

You're supposed to chop things up and mix so you don't get sued. The idea is to find something that inspires new ideas, not to just take something and claim it as your own. You have to MAKE IT your own. I appreciate this video, but honestly I can't imagine finding myself in the same situation in which, something I did was so similar to the original it was ground for legal action. Frankly, I think by doing so you would be missing the whole point of why the concept of Splice was so amazing to begin with. Just grab some one shot glitch transitions and bang, hours of time saved that would have otherwise been spent making these things from scratch. But finding a loop or melody and using that exact copy as a full verse in your song? I can't imagine doing that. Sucks all the life and fun outta making music. Splice should be used a time regulating tool that helps you tidy things up a bit. And thats it. The second you start relying solely on splice to make your songs, you lose. Not only from a legal standby, but artistically. You'll sound stale and unimaginative (and you might get sued, to boot)

But you can chop, pitch and flip loops and vocals in crazy ways.. I don’t see a issue really as long as you know how to make that particular loop unique by pitching it up or down or even better loading it up in serato sampler and setting the slicer to random and just using the sounds that way.. I’m 💯 calling cap on what your saying even tho I know what you are saying, you are telling people not to use these techniques but i don’t see why you can’t use loops and samples as long as you can manipulate them to a very different or even unidentifiable level 😂😂 but I hear you without making many changes this is gunna happen..

My biggest issue with this "Whole Splice / Arcade" issue is this: Why are we purposely making Artists lazy? Imagine the loss of knowledge created by making writing music off of someone else's work. Example: You will never be a good plumber by taking someone else's work and calling it your own. Not to mention you have no idea how to Plumb. This is VERY DANGEROUS GROUND. You could destroy the entire industry and knowledge passed forward behind it. This is COMPLETE laziness and dumbing down artists to oblivion. The only people that benefit are those making the money on your laziness. Is your knowledge increasing on these techniques? Or is it someone is getting rich off your laziness? Not to mention you have no idea how to create your sound and you give the "essence" of your writing over to someone else. Bottom line: Learn how to do it for yourself. The path to knowledge and success is YOURS to make and create. Then pass that years of knowledge on to others to sustain the industry...NOT destroy it. This is complete Laziness in my opinion and doesn't make ACTUAL artists. It's like hiring a mechanic to work on your car and then he sends it out to another mechanic that actual rebuilds your engine. No one is benefiting or learning. This is SCARY! Figure it out on your own and actually learn.

I understand what you are saying but have you ever seen how Kanye works? He will have a bunch of producers in the studio with him playing different things (beats, melodies etc) and they will all vibe. However Kanye will ultimately be the one who decides what goes where. Maybe someone is playing a certain melody and Kanye likes it but wants it slightly different so he tells them to add something or change the key. This is essentially what people should use things like Spice for. Not to fully take but to bring things together, tweak bits to create something unique. At the end of the day everything has already been done, all the beats and melodies someone has created already once before but putting it in a particular order is what makes something unique. Now the reason I am saying this is because I am getting back into making music after nearly 20 years not doing so. When I did I didn't know how to use the equipment so my friend would bring up the instruments etc and I would create the beat but he did a lot of the work. So for me something like splice is great as I get to put things together in the way I want, make tweaks and it saves me masses of time.

I'm not shooting down that effort as it relates to Splice, Arcade or any other product out there. I think it's great you're getting back into music and that Splice might help you take the dive again. It certainly gives great ideas. Hopefully someone will teach you how to produce and create your own ideas. Learning how it's done. Piece by piece and step by step. Instead of Artists hiding those ideas and abilities...we should be sharing those ideas with others to protect an industry. I'm not saying to "steal" someones secret sauce in writing music. Let's be a group of learners. It is only with knowledge can we carry our industry forward. Having someone do your homework for you when you go to school is only going to leave a large gap of knowledge and produce one thing....."everything sounds the same". If you want to be recognized as an artist and have the higher probability of getting discovered, make sure this one thing is done. Make your sound....YOURS! If it is unique in nature it will resonate and cut through the noise in the industry and in the charts. Using "Pre Made" loops is not going to do that for you. So for ideas...fine. To plop those into a track into your music....not fine. Learn it and understand it. More importantly, pass that knowledge on to someone . Lets grow the industry not make it lazy. That would destroy not build up.

@@MarkWalmsley Mark, Sure, you can edit and tweak the files or drag them into a sampler. The issue is copy right usage on larger files. If I were you, I would check out Native Instruments - Exhale. Good bang for the buck and plenty of vocals to use there with no copyright issues. As for full vocals to make a song, you need to find a singer.

Arcade isn't as bad with this because it's designed for you to edit the sounds as you use them (obviously not everyone will and it can still cause problems).

ok but like, this is a stupid reason lol. entire genres exist based off of sampling drum breaks. the claim has to be released anyway, its royalty free they cannot do anything to you. the hassle maybe is not worth it but like, this is silly. use whatever you want to make beats. kenny beats will make legit bangers off of splice loops some drums and an 808. i agree that if youre just a loop picker and you cant do anything else youre just a one trick pony its not good to be that but like, use loops whenever necessary. copyright claims on royalty free material are not enforceable. just contest it.

Mine was a copyright on RU-vid. I remember having this talk with lawyers tho on clubhouse and same labels don't even want to use the beat if it gets placed because of it. I did an update video though. I've changed my mind on a few things.

Yeah you can use it but if someone get's it copy written and cleared with a label and it's out for purchase then it's legally there sample. That's how these companies get your money but you can still use them samples. I would just change the sample up so much that it is not the same. Here’s why I don’t like to use royalty free stuff. 1) Real life hip-hop producers use samples from real life records and clear them and pay royalties. Real artists are paid royalties. 2) In order for me to avoid the “sample police”, i’ll create my own 16 bar melody samples and chop “them” up. If I do want to use royalty, free stuff, I’ll stick to either chopping up royalty free drum breaks or use one shots while the harmonic content is original made content. 3) I can actually play my instruments.

You're kidding! Royaltfree means you can use it in your song, right? Just like I can use Bach or Beethoven or any other shit that's 70 years old. Royaltyfree means: Do what you want with it, no one can touch you because of copyright, can't they? Or does it just mean: You have to be the first one to use it, however, because after that this sample is no longer royalty-free? Can we please clarify this once and for all? Please don't come up with any "you should make your own samples" stuff or "use only a part of the melody or make it slower or faster". That can't be it! I want to know what I can do with the stuff if I pay money for it. I really don't want to offend anyone, but I would like to know how free royaltyfree really is. And that must be defined.

I find it really sucks balls that it's this way because all it does is put limits in the way an original song or tune you made with your own knowledge and beats (you bought) to have this rule of not using particular sounds or arrangements is bs why are these companies selling royalty free loops with the potential of so called copyright issues it makes no sense. My understanding is if you pay for royalty free sounds then there shouldnt be any copyright issues at all. There should be new rules otherwise it will become so saturated that nobody will be able to make S.F.A. What a world !!!!

Wait, wait, .... Are you talking about a RU-vid strike or an ACTUAL Copyright Claim from a label or label's lawyer? If you are talking about a copyright claim from a label, then something isn't right about what they did to you. In both Splice and Arcade, you and (everybody) are getting the license to 'USE' those samples. They are not 'SELLING' anyone those samples. The 'USE' is subject to their (SPLICE and ARCADE) compliance and in this case it includes public works and commercial releases. Another person who "USES" that same sample can't sue you for copyright and it doesn't have anything to do with who publishes the song first because they don't own it. They only own their original work around that sample. Now if you sample that melody from their work, then yes they can sue. But they can't sue you for a melody that both of you cleared because neither one of you own the sample. Here's a example, Isaac Hayes' version of 'Walk on By' has been sample and cleared by hundreds of labels and artist, sometimes in the same year. If what happened to you was legal, one label could sue the other label for using that same sample. All the labels could sue each other for that matter but they can't.

It said at the bottom of that beat I made with the sample that the beat was a song. All I did was use the sample from splice. If someone copywrites the sample from splice you could get get a strike. My strike was from youtube. Also I hear lawyers talking about how labels don't even want to use your beat if you use splice or arcade because of the issues. I did an update video tho. Now I think if you flip a sample well enough and make it new and your own you can do that. Check the updated video

But take it from me man, you DON"T and I'm saying this with 100% confidence, you don't have to flip a sample or anything from SPLICE or ARCADE. They do NOT give exclusive rights to anyone. You , me and five other people could use the exact same loop and any lawsuit wouldn't get anywhere near a court room. I've been down that road and it literally cost me nothing for our attorney to do nothing but send a letter in response to a cease and desist we received. Now, you are right, some labels are not accepting tracks, but most of those labels have a practice of not clearing samples either, especially small indie labels.
