+AmericanRebel except a large number on people arnt guilty but still doing the time, I live in Japan and the justice system here is draconian at best, hell even lawyers arent allow to be present during interrogation, unless at the invitation of the police. So the police just interrogate (sometimes weeks at a time) until the accused cracks or thinks that they may not be innocent afterall. It more to do with the Japanese police thinking there infallible.

This video actually doesn't explain why the conviction rate is so high. Studies have shown that it's because 1. Understaffed prosecutors only bring strong cases to trial. 2. Current system penalizes judges that acquits a defendant, but is later found guilty on appeal. Whereas there is no penalty for judges that convicts a defendant, but is later found innocent on appeal.

+incyphe Japanese also tend to become quickly wracked with guilt and an overwhelming amount of people who do commit crimes, literally turn themselves in. This obviously makes it easy to convict. With THAT said, in my 15 years living there, a close friend of mine, (who was caught doing various minor things) says the method of interrogation by the Investigators is one of the biggest contributing factors. You will first sit for hours, days, with no info, then they bring you to a tiny room with two chairs, this room is only big enough for two chairs, like a broom closet. You sit inches away, face to face with the investigator, it can take hours, him questioning you, intimidating you, spitting while he talks, breath smelling, repeating the same stuff over and over, stating you are guilty "just admit it". After a long time, hours, days, etc, you either start to believe it, or you get tired of it and give up and just tell the truth.

+ThePseudomancer yep. As if, false confession is responsible for the high conviction rate. It also would have been nice if the video mentioned that our own US DOJ has conviction rate of 93%, as a point of comparison.

+incyphe Except that Japan's high conviction rate has been 99% for decades. US DOJ conviction rate didn't reach the 90s until the past decade. That being said, investigators gets away with a lot more while interrogating suspects. The fact that you can be held for 23 days WITHOUT a lawyer is very disturbing. When your convictions are built on convictions and rights during interrogation is very limited, then you have a problem.

For those of you who did not take notes, conviction rates are high because: 1) police can detain suspects for 23 days with little to no visitation from an attorney, 2) there is no trial by jury, 3) testimony and evidence that could sustain an exoneration is suppressed (thus creating a presumption of guilt instead of innocence). In contrast to America (which had a 93% conviction rate in 2012) -- 1) the police can detain you for up to 96 hours if it's a serious crime, 2) you have a right to legal counsel as often as possible, 3) you are entitled to a trial by jury, 4) the appeals process has multiple layers (city, state, federal, supreme), so the American justice system isn't as linear or single-sided as the Japanese.

+Gordon Tubbs One of the largest differences not talked about or even hinted at in this video is the difference in prosecution rates. If arrested, in the US there is a 42% chance of prosecution in a felony case, but in Japan there is only a 17.5% chance. Ei, in Japan if their is not hard evidence that someone did the crime, they are far less likely to be prosecuted.

+BeoJack, According to the video, the problem is that the "Confessions of guilt underpin 89% of criminal prosecution" and these confessions come about through harsh interogation method for a prolonged period of time without a legal counsel, leading to false confessions. It seems such was the case with the old man.

+BeoJack You talk to any prosecutor in the US and ask them if they would go to trial without certain evidence. Both American and Japanese prosecutors make sure that they have enough evidence before going to a trial. In the US, it is especially true because crime rates are much higher than Japan and prosecutors have dozens of cases to go through every day. They will not waste their time to go to trial if they are not sure they got enough evidence to convince the jury.

There was actually a video of a lawyer talking about how messed up it is while watching some of the Ace Attorney episodes than the top comment was from someone that practiced law in Japan saying that the game is actually pretty accurate about Japanese Court Systems. It's really kind of scary if you think about it.

One of the main reasons the crime rate in Japan is so low is because of the social ostracism that people know they can expect if they commit a crime, even from their own families. But then again, a society that is obedient to authority also can have very negative consequences, as we have learned with both Japan and with Germany.

+Haru X I am not sure I believe many of the statistics sated in this video, but there is no way it can be lying about the time period for interrogation or prison rules. If you can show me that prison life is different then it is shown here and that the interrogation time period is shorter than stated here then I will admit this is propaganda, but this REALLY does not seem like propaganda. At all. Like even in the slightest. This just seems like you getting way too defensive over some group criticizing the justice system in japan.

Gee the comment that suspects are held for 23 days of interrogation. How about in the USA where serial murderers are held for life with conjugal visits, health and dental care as well as free sex changes. I think you need to visit Pelican Bay or walk the Yards at some of the prisons in CA and see what it is like.

Well I don't know anything about how Japan works, I'm not sure if you're even allowed to speak up against the government and their justice system, but that's what I would do. A single person doesn't have much power, a single person can only try to get more powerless people together to create a voice that can be heard and respected, but even that may not work. I don't know, hopefully someone does

Henry Pfeffer have you seen how Japanese authorities deal with a peaceful protest to try and change policy? people just writing down thier thoughts on sticky notes in vast swathes and putting them all over the city square. And the japanese authorities deal with it with riot police and tear gas. And then 5 or 10 years go past and the goverment stops talking about it, and detain anybody who brings it up on a political scale.They don't send them to prison, because they can't convict them of any crime, but they can still pester them and arrest them wherever they go.

A little advice if you get into minor trouble in Japan. (Not quite like this poor man)You do not want to be arrested in Japan. Trust me. Even if a Japanese person attacks you, and you want to defend yourself, just take the punch (don't even lay a hand on them if you can avoid it).Of course if it's life or death, then do what you have to do. Otherwise, in a non-lifethreatening situation, if you do defend yourself, make 100% sure you have a reliable recording of it, and don't rely on their being a security camera, because even if there is one, you or your lawyer may not even get access to it until at least after the 23 days, in which you'll be kept in your cell for 23 1/2 hrs a day. Do not rely on witnesses helping you out. In jail (as opposed to prison, which is different than jail), yes, you are relatively safe accept for verbal intimidation and threats (just have patience), but it's the boredom! The boredom is the tough part. 1 day feels like 3. Just be patient, don't expect special treatment because you're a foreigner, don't react to threats- after a couple days depending on why you're there and if you stay calm they'll probably drop it, and treat it like fat camp. You get fed 3 times a day, it's relatively good healthy food, and you'll come out looking trimmer. DO NOT sign a confession! Do not sign anything, no matter how much they tell you you have to! Not until you get a lawyer. Repeat: DO NOT SIGN ANYTHING WITHOUT LEGAL REPRESENTATION. Only sign the paper which should be in English asking if you would like your consulate notified so they can contact your next of kin. If you don't, and you don't have a lawyer at hand, your friends and family may think you are dead, because you will simply vanish for a few days. Welcome to Japan. The food is good though. Try okonomiyaki.

I know a Japanese person who had experienced the 留置所(detention center), where non-convicted criminals have to spend there time. He said the conditions are worse than prisons, such as not so healthy meals, guards ignoring bullying in cells, guards ignoring you when you need to use the toilet. He thinks they do this to encourage people to confess quickly. In such conditions, they begin to think it's better off in actual prison, where the food is healthy, and guards are strict against conflict amongst inmates.

Would you prefer your car to be stolen (and probably reimbursed) or falsely be put behind bars for 5 years? Better for 10 guilty to go free than 1 innocent go down. By allowing people to go down with an element of doubt present results in false positives, thus making you just as bad as the criminals.

I imagine the two things they mentioned are their "reasons why" their conviction rate is so high: ability to hold you 23 days for interrogation without being charged and little or no lawyer representation at that time. They might also be alluding to the theory that people don't want to commit crimes due to the awful prison lifestyle.

@@MultiSciGeek malpractices isn't enough to incarcerate a doctor. this is because of the 'guilty until proven innocent' structure. the practitioner could say 'we did everything' or 'his/her body gave out' and 'we cannot show, the medical history for legal reasons' edit: malpractices is enough to incarcerate, I mean ofc, but only if proven.

I guess this is what happens when you have a society that values saving face above everything else, even above truth and justice. They would rather convict innocent people and let criminals escape punishment, than properly investigate crimes and sometimes fail in those investigations. They can't bear the shame of failing to solve a crime, but they have no problem bearing the shame of lies and deceit. They take pride in low violent crime statistics, even though those statistics are falsified. Strange society. I've always wanted to live in Japan and one of the reasons is because it seems so safe. But after looking into it I've changed my mind. Violent crime might very well be much higher in Japan than other countries, we just don't know about it because the police actively suppress information that would suggest homicide to keep their rates low. Seems like the perfect place to be a serial killer. The police would be your willing accomplices.

This guy has been through some shit. I think though a country having low crime rates to be one of the best indicators in quality of life, as people could be generally trusted more. I also like the idea of 'emphasis on rehabilitation', seems actually more to the point.

Somehow make people believe that a first world country with strict gun control and one of the lowest crime numbers in the world is worse than what they're already familiar with. Even compared to America, the worst first world country when it comes to crime, crime statistics and the judicial system. Any rational person would pick Japan any day when it comes to living & feeling safe. ''I might be wrongly accused and get sent to prison for life!!'', statistically that AND police murders happen an insane number of time more in the US than in Japan. This is a tiny pool out of which they've picked examples to show Japanese suspects get convicted and convicted wrongly. Even the entire pool combined, along with the people that DESERVED it, doesn't even make up for a fraction of the people wrongly accused and killed in the US at the hands of law enforcement, not to mention the risk of getting killed at the hands of other civilians, gun homicides among others. Things that don't happen in Japan, at worst you'll do a crime or be around a crime and MAYBE get wrongly prosecuted if someone cares enough to point you at as the culprit with some sort of evidence. And some people seem to be delusional thinking Japan is a small country with a small number of people, hence botching the crime rates (etc). Japan has a population of 130 million, the US has 326 million, and we're talking about crime rates and (gun) homicide numbers that don't even go up to a 1/50 ratio, let alone 1/2.5 to match the population difference. We're talking a literal gap of 1/400 when it comes to gun homicides in Japan and in the US, 300-400 gun related homicides in the US equals 1 in Japan, and that INCLUDES illegal guns and their usages by the Yakuza.

Conviction rate is a horrible statistic to use. If I execute every suspect, my conviction rate is 100%! If Japanese officials use this value to create an illusion of safety, they should be prosecuted themselves. It only tells that if you know what you're doing, you're _safe from being locked up_ because prosecutors won't care. The only statistic that matters is the ratio of justified convictions per all criminal acts, and maybe some derivatives like justified convictions per conviction, which seems to be really low in Japan.

Everyone who cites Japan's low crime rate when they pick on America for its high crime rate should watch this. I'm not saying low crime rates are impossible without injustices like the ones Ishikawa-san has suffered, but I will say that Japan is not the best example to use. I love Japan. I've lived there for years, but they have a messed up criminal justice system. And having studied Japanese law in law school, I can say that even there civil law is a little funky.

Another thing this film fails to mention, is that Japanese police will encourage two parties to come to a monetary agreement on the spot, instead of actually going to court. This helps vastly in keeping the "crime rate" down, because then the crimes never actually enter the system. They simply agree to pay the other person X amount in cash, there on the spot.

TiffanyIndigo, it seems far worse in the US though. You are more likely to end up in prison. If you poor you'll get a shitty lawyer. Prosecution will threaten you with insanely long sentencing to arm twist you into a plea bargain thus chucking you in jail without any trial. Over 70% of all American inmates never had a trial. I live in Norway which I think would be the preferred place to live anywhere with respect to criminal justice, however if I had to chose I would probably pick Japan over the US. Not being able to speak with other inmates seems to suck, but unlike the US at least I likely wont get raped in prison or beaten up by some nasty prison gang. American prisons are notoriously violent places.

As a Japanese, I am saddened to hear that most foreigners condemn Japan without any understanding of the Japanese criminal justice system. Since the prosecution rate in formal trials in Japan is only 8%, it is not surprising that the conviction rate is so high. Japanese prosecutors will not prosecute a case unless there is a certainty of conviction, so 60% of the cases they accept are deferred, and most suspects are released without even a trial. As a result, prosecutors rarely coerce suspects into making false confessions. In addition, 30% of the cases accepted by prosecutors end up in summary trials without formal charges. This is a judicial procedure used in cases where the suspect admits guilt and the fine is a misdemeanor of 1 million yen or less.

I thought our justice system here in India was bad, but this is infinitely worse. It seems in Japan, the chance of a fair trial is flimsy due to police "interrogations", and your life is ruined once you get in no matter if you are innocent or guilty. From news articles, even being in prison for a time (even if you were declared innocent) is enough for companies to deny you jobs, landlords to forbid you from rentable living space, and other such nuisances. ...And that kind of harrowing "justice" is probably fearsome enough that people don't commit as much crime in Japan.

This video doesnt paint a complete and truly accurate pictture, a lot of things are taken out of context. Most of the time in Japan when arrested, you are either released without the case going further(minor cases) or the prosecutor decides not make an Indictment. This is because japan for the most part, will not indict someone without 100 percent proof of crime. So if there is a shred of doubt, the prosecutor doesnt usually go forward with the case. Yea japan has a 99% conviction rate. However their arrest to Indictment rate is rather low. All things need to be considered, because if not, you paint a skewed sense of what is true. Just saying.

As a Japanese, I wanna say this. The reason why conviction rate is very high in Japan, is because most criminals are charged after prosecuter finds enough proof and evidence, so false accusations seldom happen. If prosecuters cannot get enough evidence for crimes, suspects will not get prosecuted. Many people here misinterpret that Japan's legal system usually imprisons innocent persons.

And there are many cases that are not prosecuted. So when a trial does start, it's because the prosecutor always has a number of incriminating pieces of evidence. Those who criticise Japan's conviction rate of over 99%, what percentage would you say is acceptable? About 80%? If so, that would mean that about 20% of false convictions are acceptable.

It's not often, but it is something that is bound to happen. What keeps people from committing crimes in the first place is the fear of being jailed and how they will be treated in jail once they are inside it.

But the whales and dolphins have only other people to defend them so we can at least say something. In the end it's up to the Japanese people but if they don't have a sense that the world cares they certainly won't make some adjustments. So a bit of shaming is not a bad thing. The US deserves a lot of shaming on environmental issues and the rest of the world is doing a poor job in shaming us.
