Trump tried to obstruct justice because he thought he is guilty because he used the Russians. The trick is that he didn't conspire and just received help. Cohen actually tried to contact the Russians but failed because od a mistyped email address... If you try to rob a bank and fail, you are not innocent, you are just a unskilled criminal. Trump failed at stopping the investigation but tried to... People should really read the introduction and executives summaries of volume 1 and 2 of the report. @@johan.ohgren That's likely what happened. The guy was mistaken for a suspect. P. tried to arrest him and he "resisted". So he got arrested for resisting an arrest for a crime he didn't commit. That's exactly analog to Trump being arrested/charged with obstruction for a collusion he didn't commit. So Trevor might be measuring with two different scales here. I admit though, counting saying "what for" as "resistance" is indeed far fetched.

The reason obstructing justice for a crime that never happened is a crime is because you are preventing an investigation from occurring which would otherwise determine whether or not a crime was committed in the eyes of the law.

Of course, in this case, we don't know that it never happened. Mueller just couldn't find sufficient evidence to claim that it _did_ happen. That's a very different thing. (And when it came to the crimes that _did_ happen, he decided that the perpetrators were just too dumb to understand that it was illegal. But I don't want to get into that.) If you obstruct justice successfully, you may cover up a crime. That's why obstructing justice _has_ to be a crime in itself.

Doesn't Obstruction of Justice simply mean interfering with the course of investigation?? Even if you were 100 % sure the investigation would amount to nothing the fact that you tried in any shape or form to fiddle with the investigators doing their job is a crime in itself. I'm not a lawyer please explain.

For me though, it's like why obstruct unless you know they're going to find something? And for the record, there was evidence of attempted collusion, and evidence of obstruction. Collusion being "not a crime" and Mueller being unable to actually make a case, citing it as more of a political question than a legal one. Obstruction being cited as Congress' matter to determine how to proceed. Make no mistake though, there's evidence of both in the Mueller report.

There is a nice video on LegalEagle youtube channel about it. The guy is a lawyer and explains in like 10 minutes what it is all about. Long story short Muller was not actually trying to find Trump guilty, he was more like collecting evidence for the future. There are some legal issues with indicting the sitting president so Muller just chose the "safe path" and leave it all to Congress. Also, it opens a possibility to indict Trump after he leaves the office.

Yep, I was arrested for sneezing in a store. It scared an old lady and she dropped a bottle of juice, it broke. My charges were, Verbal assault, menacing, property destruction (broken glass bottle), criminal trespass(detained before buying) and resisting arrest(because store clerks tackled me to the ground). 9 months in jail for a sneeze.

It's close. Really, Mueller couldn't prove that Trump ate the cookies because Trump was blocking him from checking the jar. We still don't know if he ate the cookies, and we can't prove it without looking. Lots of evidence of collusion, but no smoking guns because of lies, hidden evidence, and refusals to testify. Obstruction -> No proof of collusion.

I’m from Florida. The resisting arrest thing is real. Sometimes the only charge listed in the arrest record that runs in the newspaper will be “Resisting arrest without force” which means a person said “No” to being arrested without cause.

It is a crime, Mueller isn't allowed to indict a sitting president and therefor cannot definitivly conclude the investigation. He lays it out at the beginning of the report that he cannot find the President guilty because he cannot charge him. To say the president betrayed America and then be unable to give the president the opportunity to defend himself in court is basically character assassination. The report could have only ever cleared Trump's name, therefore the fact that it doesn't is extremely damning.

@@ms_scribbles Well it was a rule meant to ensure america never inadvertantly weakened it's leadership during any potential leadership crisis. So long as the president is the president he's the leader. He has to be kicked out of office and replaced before he can be safely charged. The problem is that, really, he should have been impeached well before now for sheer incompetence. The bigger problem now is wether or not the Republican party will uphold their proclaimed values, or if they'll go totally rogue in the name of staying in power. Not that siding with Trump wasn't them already siding against the American people in pursuit of power.

Except Trump has totally committed those crimes, Mueller just can't say that because he can't indict a sitting president. If he's impeached or leaves office Mueller will be able to indict Trump on charges of conspiracy.

I spoke with a man with a degree from Harvard Law School, and if I remember what he said correctly, often if there is no crime, prosecutors do not try to prosecute the person for obstruction. Also, if you want to get him on anything, two can play that game. Yes, I am referring to the emails....

It's also possible that by obstructing justice you could successfully prevent the authorities from getting proper evidence to prove you committed a crime. It makes sense that you could obstruct justice even if the crime has not been proven.
