Also by not signing on to international agencies such as the International Criminal Court, by passing laws in your own country allowing your military to use whatever means necessary including force to free any member of your armed forces or citizens as well as those of allied nations (even if they are signatory to lCC) from lCC custody or enabling your government to sanction any member of the lCC for investigating your war criminals. Rule 0 of the rule of War. They are completely non-enforceable. On the international stage, there is only 1 rule and that's the rule of diplomacy. international relations dictate. On the international stage, rules are guidelines. They are only apprehended by the interest of both parties, both being equal. When interests shift, and power changes, these guidelines falter. Laws that are not enforceable are not laws. they are guidelines. There is no law. There is no justice. There are only agreements, partnerships and the law of Power.

Opinion: The international stage is therefore more like the wild west than anything else (How would a society without laws look, pretty much like the united nations). Laws don't exist, but people do have morals. However, interests of individuals/nations go above morals and above all else. To solve "the problem of the rules of war" (it being non-enforceable), we must therefore first make laws enforceable internationally. However, this would go against the principle of the sovereignty of nations. To solve the problem of the rules of war, we must therefore solve "the problem of nations" first.

They are completely enforceable if the countries responsible for them are capable of such power projection, and sufficiently driven by interest. Anything can be enforced if one has the power to do so, it's not just some magic area of politics which lacks enforcement capability.

Another way of putting this, for instance, is that NATO can't really prosecute Russia for war crimes, they can however justify military support to places like India, China and their own populations to Ukraine.

For thousands of years, the rules of war were present to provide your own soldiers with a code of ethics that would both make them more mentally durable in the field, more effective, and make it more likely that they can be integrated back into society once war is over. This is less of an issue if you: - are not intending to bring your soldiers home. That is, have a desired goal of killing much of your own army, because they are compromised of ethnic minorities that you wish to cleanse, or other undesirables, and - you are waging total war with a goal of completely eliminating your target population, either by directly killing them, or deporting them.

Morals aside, committing war crimes left and right isn't actually good for the party commiting them. The best thing a commander can hope for is for the enemy to surrender, ideally as soon as possible. Fighting is risky and costly, so a surrendering enemy means you've just saved yourself a whole lot of hurt. But that's a whole lot less likely to happen if you've built a reputation as someone who tortures or kills POWs. Enemy soldiers are far more likely to fight to the bitter end if they believe they truly have nothing to lose... That and war crimes might eventually come back to haunt you if you're ever called to answer for your actions...

That is why you have ROE's (Rules of Engagement), given to us from our Commanders. I was in Iraq in 2003 and the ROE's were kill anything that moves, my last deployment in 2006-07, the ROE's had changed to; you can only shoot at someone if you see them actually engaging you. In the US, I know of two cases of a group of Army and Marines that were charged and convicted of these crimes; they where crimes that you see here committed in the US, the difference is that they add "WAR" to those crimes and that makes it so much worse; and I don't know about the rest of the militaries around the world but in our military we have a "catch all" that even if you get acquitted... Article 134 of the UCMJ.

More like rules you have to follow unless you could get caught and there is actually someone willing to hold you accountable for it while having the power to do so. And any rule can be bypassed with excuses as per Karl Schmitt's State of Exception which is much more easier to utilize now by liberal democracies thanks to the power of mass media influence. Schmitt must be rolling in his grave right now seeing how the "liberal democracies" that he criticized for their seemingly religion-like rigidness when it came to following rules actually managing to make even better utilization of his idea to break laws and get away with it.

​@@julius43461 no, the point is to put pressure on those who have power to do right, and to be a guideline for what is morally right. To make distinction between acts that are acceptable. It for example helps ukraine to deal with prisoners of war. How should they prosecute them? How to distinguish a soldier from some1 who committed a genocide in Bucha? These guidelines help local governments what to do. How to prosecute, and determine what is 'fair'.

My solution is to just disband the council entirely. One nation, once corrupted, can veto any votes that serve justice, and the permanently serve as "superior" to others.

Yes & no. I had family who served in the Australian Army, so much look at a civilian funny has a F*CKTONNE of paperwork. A few of our special forces that did in Afghanistan, got life in prison, it was a huge controversy here a few years ago when the story leaked. Rules of engagement is very strict here in our military.

The administrators do not expect that the laws are effective to make "fair war". Because of the Queen's rule of law, they themselves will break the laws as needed; the laws are effectively regarded as guideline. They are useful when war is ended; the compensation from the loser can be increased with violations of the laws, not more than that. For Ukraine war, media and governments of the West are biased, because they are part of the war, which disqualifies them as the judge. If China steps in as a peacekeeping force, it may make change.
