I got hit by a car while biking , it was his fault completely because I was on the shoulder, I ended up with two herniated disc and fracture disc , so far physical therapy, injection, and now at a spine doctor , doubt surgery will be needed but won't know yet, Its through his progressive that's he has full coverage, not sure how much the settlement could be , but for now I been trying to get back to normal and it's not easy

I live in Florida. Two years ago I was in an accident. The other driver pulled out in front of me from a side street while I was driving on the busy street. I couldnt stop in time and I hit him on the passenger side on the front of the car. I had the ambulance take me to the hospital to be checked out. Xrays showed no damage The officer told me other driver was at fault 100% for not yielding right of way. I did have some soreness and neck and back discomfort. Got a lawyer went to chiropractis care for 6 months. Had a cat scan showed nothing. No surgery was needed. I didnt need injections. I didnt break anything or lost an arm or leg. No permanent injuries. I was lucky. The lawyer reached a settlement with the insurance company, I got $13,000.00 in my pocket. Husband very irate and wants more money and that I should have the lawyer renegotiate or sue or find another lawyer. I did talk to a another firm and they feel my case is not worth it. Husband and I are not on good terms, I tried telling him that because I am not permanently disabled and had no surgery, my case was not worth much.

You did well for someone with no injuries. You had a good lawyer, and the negligent driver probably had a Policy with high bodily injury limits. Your husband sounds like a bitter grouch, tell him to go somewhere and sit down.

I am happy with the settlement. Husband wanted me to turn the whole settlement to him. I said NO. He got more money than I got to replace his car. I told him before that the money for the car is his but the money for body injuries is mine.

Jz I need help man, am in Florida and I got rear ended. I have dash cam showing proof of everything. My first lawyer was not very communicative, and now my second lawyer wants to settle for the liability amount. 10k is their max. And I have uninsured coverage 10k so the lawyer wants me to settle for 20k total. I have MRI results showing I have a herniated disk and a bad shoulder injury with broken ligaments all around. I will need surgery. But the lawyer doesn’t want me to get surgery and apparently doesn’t want to go to court either to fight for more. Can you advice me here? Can you join my case and get me more than what they offer?

I had a whiplash but now I have neck pain in the front of neck behind the larynx. I have protruding disk but I dont think I had any protruding disk. Plus I have a belly button hernia . I had belly pain and later noticed a hernia . Never had a hernia ever ever. And my shoulder is rendered useless. Had same issues with shoulder but I could use it and do pull ups and now I can't put a shirt on with out server pain. I sure I'm not going to get crap.

What if someone hit and run and we don’t have their details. And I got my patella fracture for right knee no surgery and ACL tear on left knee and had a surgery , I got these from accident someone hit me and ran away. Can I still apply for compensation????? Reply

Mister Gent: My comment only applies to accidents in Florida, which is where I’m licensed. I hope that you get the result that you are looking for. How hard of an impact was the crash? Has a neuropsychologist examined you for your brain trauma? Is surgery recommended on/near the disc bulges? How exactly did you come of with the $300K value? Note: You should get an attorney. @@RealJustinZiegler sorry didn't see your reply in full. Her insurance company told my attorney its 300/500k. The impact was a T bone crash totaling my car. I'm seeing a neurosurgeon in a couple of days. I'm nervous about the idea of surgery. Could I still win if I have surgery scheduled but not actually get surgery?

@@mistergent7 What do the MRIs specifically show is wrong with your brain? Who is her insurance company? I would be nervous about surgery also. Yes, you may still win even if you don't get surgery. Your attorney is the best person for you to ask the odds of you winning. He or she knows much more than the limited facts that you've given me. Just ask him or her. However, all things equal, jurors and insurance companies typically award more money when the surgery has already taken place. That said, there are exceptions to this general rule. Depending on where you live, the state may help you. In New York, where I am, there is a motor Vehicle Accident Corporation that injured people can file claims with. Check with a personal injury lawyer in your state to see what your rights are.

So your client was "placing a parking ticket inside his car" when he got hit by the defendant vehicle? Is it possible the ticket he received indicated he shouldn't have been parked there? Did his own negligent parking lead to him being struck?

In vehicle accidents were the plaintiff has dash camera footage showing the other party failing to yield in a turn resulting in substantial vehicle damage (both totaled), how helpful is that in making a case? Plus the defendant driver was cited for failure to yield and at least two witnesses made statements affirming the same. I'm currently being worked up for potential cervical disc herniation. 40mph impact...

I had surgery 5 months ago been fighting w the insurance company for 13 months now n my lawyer filed a lawsuit in October of 2019 n still waiting any suggestions!!

I was inside in the bank to deposit my money,and finished I got out of the bank and hit the glass,because the glass was very clean/clear and there was no sign or sticker to warn public this was not a door.And the glass broke and hurt my hand and I had to be taken to the hospital by ambulance for surgery. My question is I have the cases ?

Terry Cool: Thank you for your comment. I don't know the value of your claim. A personal injury claim value depends many factors. Two huge factors are liability and damages. Liability is whether someone else (or a company) was negligent. Damages are the extent of your injury. While you've given me some information, I don't know fully know the liability and damages aspects of your claim. An attorney cannot fully understand liability and damages by reading a sentence (or more) about the facts of an incident. You should hire a lawyer who can: 1. Review your medical records, bills and other documents 2. Take photos of your injuries, damages to vehicle(s) and any other evidence. 3. Properly preserve evidence. 4. Speak with witnesses (and get statements). 5. Reduce the amount (if any) that you need to pay back your health insurer for bills that it paid. 6. Do much, much more. I haven't had a chance to speak with you and review your claim. Thus, I also don't know if you have a workers' compensation claim (or other claim). Note: I wish you good luck. Let’s talk about Maria’s case… She got $100,000 ! Attorny gets at least 45,000$ the surgery at least $50,000 and she’s lucky if she got a couple thousand in her pocket … Let’s hope and pray that the surgery was a success, and she will not have any trouble down the line .

I don't call myself a workers' compensation lawyer. However, I may be able to work on a workers' comp case with another law firm who specializes in workers' comp. Also, sometimes an injured person is making a workers' comp claim, and also has a 3rd party personal injury claim. In that case, I can handle the personal injury claim if the accident occurred in Florida (or on a cruise). I also may be able to handle the case if the injured person lives in Florida, but was hurt in another state. (It will depend on the out of state law.) How much work have you missed? Are you disabled from your job? From all work? Those are factors that can affect your case. Talk to your attorney. He or she will have a better handle on what your case is worth.

I have a question I was in Abad wreck with someone else that someone died in it was the person's fault but I own car but I didn't have any car insurance on my car at the time but I had to have surgery and spent 4 days in Hershey hospital am I intilleled to receive payment or can it go against me for not having ins on my car witch I was not driveing at the time

I assume that you're asking how surgery affects a case value if the accident happened at work. If it happened at work, the injured person should understand workers' compensation laws. However, they may also have a personal injury case.
