Absolutely he is still married but I would't go as far to say he's cheating on his wife lol. "Legally separated" is an actual thing your guys! We don't know why the divorce hasn't happened yet. Speaking from experience, divorce is a tough process especially when dealing with kids and assets. A little know fact, being "legally separated" could actually be more beneficial than a full out divorce (if the two can agree to disagree). A few example are tax benefits, family insurance plans are usually less expensive than individual plans with kids (especially if one of you are in the military) , and we can come up with our own terms of co-parenting instead of the courts. Long story short, we can't use the phrase "cheating on his wife" because just we don't know the situation. If the guy is actually legally separated he has every right to date other people and so does his "wife". And i'm not taking sides here it just bothers me because I'm in a similar situation.

The couple can decide at any moment to remain married. It just means that you have temporarily separated residence.
