You Can’t Walk Kelowna Beaches...

By law, the foreshore of Kelowna's beaches are public property, and should be accessible to anyone to walk along unimpeded. There are property owners obstructing access to the waterfront with fences, walls, hedges, landscaping and other structures that claim "No Trespassing, No Beach Access or Private Property” The foreshore is NOT private property, and these obstructions are most often illegal. Foreshore is the area between the high and low water marks. Docks with government licenses can cross the foreshore if they have steps up and down to not impeded the public from crossing them. Fencing over the foreshore is not allowed.
Following the flooding in Kelowna, and acknowledging that some private landscaping and docks will have to be rebuilt, now is the time to consider, as a city, how important public beach access is.
This drone video filmed on May 8, 2017, prior to the flooding. It follows the lakeshore from Kelowna's City Park to the Mission Creek Outlet, clearly showing which sections of waterfront have been made inaccessible to the public.
Want to be able to walk it instead of flying over? File a complaint with BC’s Ministry of Forests, Lands and Natural Resource Operations by calling 18779527277, or #7277 by cell phone.

So if the beach is public, can't you just walk up to past the water and use it?

Great job. I did not know this. So we are free to walk around the lake. What about the mayor and police in Kelowna what is their look at it ? Thank u for sharing.)))

Thank you for your support Monika. In BC you are free to walk the foreshore which is the area between high and low water marks. Happy to report that the Mayor, RCMP and most Kelowna residents are very positive about this. Please share the video and join our event August 27th: facebook.com/walkthebeachkelowna/

The city should warn the people obstructing access, then fine them, then remove the obstructions and bill the people, and then put liens with 5% annual increase on their property if they do no pay.

Thank you for your ideas Gerald! I agree that those that put the obstructions up should remove them. It cost not be born by the rest of the citizens of Kelowna. Please help by sharing the video and join our event August 27th: facebook.com/walkthebeachkelowna.

Good video. Hard to believe they have been getting away with this. We tried to pass in front of the big house to the right of Kinsmen Park and 2 very scary looking dogs....and a four foot fence stopped us.. Lots of these docks gone now. Maybe a good time to bring this forward.

I know the dogs you are talking about! They could easily jump that fence.

Walking on the foreshore is no different than someone walking on my boulevard. I live in a Urban area with lots of Pedestrian traffic. Often I do find cigarette butts, garbage, etc. Sometimes people sit down on my boulevard to rest their dog. It's just part of living in a community. I am not allowed to build my patio or a wall out to the sidewalk......if I did....I think I should expect someone might sit on my patio....since it is public space!

I apologize. Please just turn it down. Unfortunately by the time I considered it, was too late to have changed without starting the count over, and it's something I don't know how to do myself.

Kelowna isn't that nice and there is no future because the world is on the brink of the 7year Tribulation. Study biblical end times prophecy and get rapture ready: give your life to JESUS CHRIST while you can! Listen to Dr. Ron Rhodes on end times chronology.

I don't think this is entirely accurate. The beach and water is only public access up to the high water mark. My understanding is that where retaining walls have had to be put in to prevent land from washing away, that is the property owners' land. I'm not 100% sure, but I'm pretty sure. If you're posting videos like this, you should probably have your facts straight though.
@brendabachmann8687

Yes, we have done our research Chris. It's only the foreshore between the high and low water marks that we can walk. Where people illegally block with fences, walls, illegally built docks we may have to swim, lol. Come out and walk with us! facebook.com/events/428996474123142/

Some of these land owners have every right to do what they're doing as they hold not just land ownership but a portion of the actual wateras well. meaning that the portion of beach/water is completely theirs so they can do whatever they want! not all waterfront properties are like this however you can read up about it in many articles

Have searched the City maps with 2 different City people, plus RDCO maps, completed a couple title searches, searched Provincial Government. The only water lot I have found so far is near Fintry. Province says that property lost by erosion reverts back to the province and the new foreshore is created in another location: www.bcnature.ca/wp-content/uploads/2015/03/Section4-17.pdf. We have not come across anyone that has proven (and not just stated) that they have exclusive rights to the foreshore. We WELCOME that someone come forward with proof such exists as our intention is not to trespass. It sounds like you know someone claiming to have that? If so please help us out. Give us an address if nothing else so we can research. Thank you

Brenda Bachmann keep researching or better yet...go door to door, sounds like ya have plenty of time. It's bothersome you would post a video to youtube that could be detrimental to tourism or give Kelowna any sort of negative media! Recent newspaper articles have stated much of what I'd originally posted. Oh and btw I don't really care what you've got to say in your posts.
@brendabachmann8687

This is totally positive for tourism, and for the 127,000 people that call Kelowna home! I gather you must own along the waterfront? You need not read my posts then, and I will not answer you anymore. Would like proof the elusive water lot is not just an urban myth to keep the public away. Our goal is not to trespass. We only want to peacefully walk where we legally can: the foreshore.

When people buy “lakeshore” they are not buying up to or in to the water. They’re paying taxes to own as close to the lake as possible, but not to own up to or in the water. Perhaps if that was possible the taxes would be double what they are now? All over Kelowna people look after the City-owned boulevards in front of their homes without laying claim to them nor blocking people from using them. How is this different?
@lisac9830
@lisac9830 7 лет назад
Brenda Bachmann actually Brenda, some of these property owners DO in fact own up to and into the water....they're taxes are astronomical! these things have been discussed alot since the flooding
