That's good. However, if you are still in possession of the property, the Landlord is free to file again. Was there some technical error with the filing?

Can an Attorney file a eviction under false pretense and after the defendant responds that they lied until penalty and perjury the switch to their business partner to take their case over! The Attorney never indicated that he was an attorney when the case was filed he only sent a request to have his business partner take over the case so when they show up to court one attorney will be the Plaintiff and his business partner will be defending him, is that legal?

That depends on a few things. What was false? The fact that one attorney is being represented by another is not generally a problem. Also, in which state is this case being tried?

It's in California One Lawyer filed an eviction but didn't say he was an attorney but lied we have a rental program here and 3 of the questions on the court papers asked if I was signed up for the program and he answered no to all three questions, it clearly states that as long as u have a active application u cannot be evicted so he lied and he never said he was an attorney, so basically his Business partner is an Attorney and he had him take over the case after I responded to the order that whoever filled out the paperwork lied under penalty and perjury! So will they both show up in court since the first attorney that filed the paperwork in his name?

Additionally, as I am only licensed to practice law in the State of Texas, I am unfamiliar with Eviction procedure in your state, and I am unable to offer you legal advice.
